    The neighbor sued the debt collection agency and won a pile of money.

  • Correction. It is illegal to contact "your neighbors" or "your relatives" these practices our outlined in the Fair Debt Collection Practices Act. I run a legitimate collections agency and in my experience, if you treat customers like human beings and work with them, they are more likely/able to make efforts to repay. Otherwise, you are just making matters worse both to the client and to the company that you represent in your efforts to collect funds.

  • The real issue is and the truth to it is that 95% of the ones doing the collecting are fresh from rehab, jail or trying to get back on their feet....Makes you just want to give them your credit card number right! I never pay a collection agency. If I owe, I pay the direct account, NEVER and agency. The workers are way worse off than the ones that owe. I was in the business for 13 years, I saw way to much behind the scenes stealing from clients to trust any of them.

  • it's not illegal to contact neighbors or relatives to find information such as: address,phone number or place of employment. some states require that the person you speak to offer to take a message rather than you asking them to take one. it IS illegal to inform them of the debt w/o prior consent from the debtor. collections cant sue you,but the original creditor can.

  • @eka1029 ERROR> Collection agencies can refer the account to an attorney for a lawsuit. The creditor can, too. HOWEVER, the MOST important part is...if they SAY they are going to sue you then they better have the intentions on doing it because you cannot make threats to the consumer/debtor.

The banks always ask for references. Because if you skip town on your debts they want to be able to find you. I've had an experience with a medical collection agency who was trying to bill me after the hospital and doctor got paid by me and my insurance. They could never explain to me why I owed it so I never paid. Long story short it came off of my credit report and there was nothing they could do.

  • I would disclose the message to the relative or the friend so that they could use it against the collection agency. I would further ask the collector to refrain from contacting me since a collector has no privilege to contact me once I instruct him or her not to. If they insist on contacting me after I have conveyed that message, then I would sue them for harassment. Simply because a friend or relative owes a debt does not give these cocksuckers the right to contact me about it.

  • If any moron like the ones on this video would call me referencing a friend or relative's debt. After sending them to go fuck themselves, I would provide the recorded message to the person they were trying to locate. You owe the debt, if you a. acknowledge the debt, or b. a court of law orders you to pay the debt, until either of these two things happen, the debt is disputed, and due to that fact, these assholes can not disclose that information to a third party.

  • A lot of these collection agents, and due to the fact that they do not know the law are misguided. In several states, contacting anyone other than the debtor is not legal , and the collection company can be sued. If you are experiencing creditor harassment contact an attorney and if he or she feels that you have a case sue the collection company. Every state has statutes as to what types of conduct are allowed and which are prohibited by collections. You do have rights as a debtor.

This happened to many people when the economy went downhill. How does people pay something when they no longer have income? I'm not saying people should not pay their bills because they should and some people do bring it on their self, but the collector should be ethical.

I honestly don't see how anyone would be liable for a accidental fire, Only way I can see that would be someone is lying to someone. I never worked for a third party collection agency like this but we never broke the law. If they call you they are calling for a reason. They may have the wrong # or something and if that is the case just tell them.

  • @loganachilles1982 when you agree in a credit transaction, lets say, a car.. there is an initial contract to pay which includes phone numbers, social security info, references and such in the credit application. This is their loophole for legality. If the company is unable to resolve a debt within it's own credit department, then, yes, it goes to a 3rd party agency. Im sure they have loopholes of their own, but I have never worked for a 3rd party. We rarly missed our mark, and had little need.

    this is usually included in most credit applications. there are references where you list 3+ people. usually family, neighbors, friends. If you are knocking on someone's door, and they dont answer multiple times, you can give a contact card to their neighbor, and ask them to deliver it to your customer.

    its sleazy, but legal.

  • @brabon1 ive been a collector, and place of business is fair game. ive done it hundreds of times. if they dont respond to notices at home, then you have to seek other menes of contact.. that is what a credit app is for. they willingly give you information about friends, family, and business, which now makes it legal to persue them via these resources, should the need to do so arises.

They want you to pay them back but they make it hard for you to get a job to pay them back. They already fucked up your credit now they want to fuck up your life.

  • If ever I had to pay these cats again, I'd tell them that it would be by check only and write on it "endorsement of this check constitutes payment in full bla bla bla". Fortunately I have a pro bono family member lawyer, and an uncle who was a superior court judge in Napa for legal consultation. Incidentally, my uncle did say that most judges look at debt collectors as swine and if you have a case, sue em. You'll win if the collectors deviated at all from the FDCPA.

  • I paid the full amount....then got a call from Mumbai a month later saying that I owed more. At that point I was ready for them. I told them I was recording the conversation, that they needed to send me proof of debt, that I was sending a cease and desist, and that any further contact with me be only done through the mail. Haven't heard from them since, and they didn't ding my credit. I guess payment though resets the clock, and they've got another four years now in which to bother me.

  • My only experience with a collections agency was for a $800 ambulance bill which the company never sent me which had passed the statute of limitations. I had no problem with paying it. But christ did indulging these douchebags open up a can of worms. They told me I could only pay over the phone; and being completely naive on this subject, I did. They told me they'd send a receipt, of course they didn't.

The problem is that they know people cant afford to pay, or if they did they would have been making their min. payments so its kinda pointless.   • I collect on students loans and there is no statue of limitations on student loans, they cannot be discharged through bankruptcy, FDCPA may be your friends but there are always ways to call your neighbors or relatives agains, say if we "believe" they have new information, so you think we are scum bags, pay your bill, you had money at one time when you werent paying, so why should we feel bad now because you were retarded and dont know how to handle money, enjoy your garnishment asshole

One of them actually had the nerve to call me after I sent the letter so I got the damn BBB on their ass. They never called me after that.   • The program is very effective in tracking people down. Its called "Accurint." However the motivations and personality type of these collectors are terrible. Everyone hates collection companies until they actually need one. However, I would never hire those two at my agency. They're an FDCPA disaster waiting to happen.

    Sure they do. My boyfriend has a debt from over 10 years ago for 700 which they more than likely bought for 50-100 dollars. They don't call very often but I love it when they do. Most debt collectors are morons. They know nothing about law or what they can or can't do (garnishments, liens, lawsuits, so on) considering the laws of the state you're in. If they had half a brain they'd have a better job.

    We do call the neighbours, we do not disclose anything. If a debtor is ignoring our calls we just call everyone in the neighbourhood and leave messages,,,,its embararissing and they pay.

  • I'm a collector too, and I love it. The money is great and you learn a lot. In most states it's perfectly legal and acceptable to contact neighbors and family for the purpose of location information.

    Most of the people that complain are the ones that drive themselves into tens of thousands of dollars in debt and can't get out. Not my fault

  • I understand that. All they can say is that they are trying to get a number for you to contact. No, it's illegal to tell them about the details (just as your example with the doctor) but they can call asking for the person's location information.

  • @neil9327 see, here is where the grey line begins, because you are 100% right. It IS illegal to inform your customer's debt to anyone besides the customer and spouse. That is why you convey a message of "matters of great importance" to the neighbor, rather than disclosing private information. The neighbor obviously knows, but hasnt been told anything. Keep in mind that these tactics are usually used when your customer has been avoiding you via not answering, or cancling contact info.

  • It actually is illegal to call the neighbor/boss/relative, genius. The problem is most debt collection agencies deal with people who do not know the law and usually feel very desperate.

    A janitor at my building actually had a collection call for $800 once and they called his mother. Too bad one of my colleagues is a law freak and gave him directions how to sue.

    Result? The debt collection agency was successfully sued for $700 + legal fees.

    Know ur rights people!

  • I worked for a collection agency for 15 years. Never pay a collector. Contact the original creditor. Dispute the bill with the collection agency with certified mail demanding validation and verification of debt. Also place in writing that you do not want any phone calls and all communication needs to be sent through mail correspondence.

  • I agree with you to a certain extent. I am saying that because many debtors don't care to pay their bills. Sometimes debtors need people to push them to pay their debt. Nevertheless, there are those who have graduated from college who want to be able to pay off their debt, but can't because of difficulty finding jobs right now. At the same time, the lenders don't want to offer deferments and prefer to use a collecting agency to threaten and harass the students who are in debt.

  • When they garnish wages there is very little a debtor can do? Check the FDCPA and your state laws and you may be a able to get a collection agency on a technicality?

  • I got sued but they cant garnish my wages because i only make 115.00 a week and in illinois you must make 349.00 a week for them to garnish from me they will never see anything.

  • cost of borrowing is disclosed upon approval.. people are told what their getting charged, it's their choice if they want to acknowledge what their actually paying or not.. in business a company seeks to maximize profits, if people are willing to pay 20% then why not charge it. when i worked at a retail bank i saw first hand how people lived outside their means and then worried about it when it was too late.. btw the stonr is not what you think, its an acronym, so go fuck yourself

  • @stonr500 Banks are duty-bound to carry out SENSIBLE LENDING - aren't they supposed to be the ones with all the financial smarts?! They screwed up US and UK financials BIG TIME and had to go crying to the governments for a bail-out. They are also insured for bad debts they can't collect on - people do die you know - you CAN'T collect on every debt! So they risk assess them - or they damn well should. Don't blame the consumer. The banks NEED us to want credit. Parasites always need a host...

  • A debt collector called my mother about back taxes that she could not pay because she was in the HOSPITAL. They also called the neighbors and her job. Finaly they made threats of jail time. I counted 37 different violations of federal law in their messages and phone calls. Imagine their surprise when the debt was paid with their money given to us when we destroyed them via a quick and just lawsuit. Protect yourselves. If they threaten you once, they can be sued.
