The fly ash argument isn't valid. Waste coal is just as dangerous as fly ash. Waste coal is leeching just as fly ash would. Although, the filtering that will take place after waste coal ignition will remove many of the dangers before the fly ash is processed. The fly ash will not contain many of the dangerous chemicals that the waste coal is now leeching into your watershed.
