Nintendo owns the rights to Donkey kong. Rare used to but since Microsoft bought Rare (Stupid B-K N&B) Nintendo owns the rights to DK. Remember DK Jungle beat?

I so miss DK64 and Banjo-Tooie. I loved the way those worlds were shaped with all of those little details. Banjo-Kazooie for Xbox doesn't really appeal to me at all. Part because the new design seems ugly and part because I don't own an Xbox

Despite these replies saying he's not entirely a Nintendo character. I believe it's more likely he was taken out as a playable MP character because he's technically very larger than Mario and the other characters. His size was also inaccurate in other N64 games, like MK64, where him and Bowser were generally the same size as every other character in the game, including Toad, who's technically, supposed to be smaller than MARIO!
