that okay anyway DMCA (Digital Millennium Copyright Act) is basically fancy talk , in my estimation, for copyright infringement claim. hopefully that answers your question.
My problem with the paid review would be that a full scale assault could be waged on the channel owner's wallet. The DMCAer could use phantom accounts to easily abuse this, no?
All I can add to this is that we can't be hopeful. My policy is make substantial videos, mention channel abuse in passing at best. Basically ignore them. Whether that will make it worse or make them bored and move on, that's another question.
I read somewhere that the larger a group is the less likely it is for someone to help a person in need. The smaller a group is a person from the group is more liekly yo take action. If it is a huge group everyone assumes that another person in the group will take action. I forgot what it was called but I'm sure someone knows :)
I would think media exposure about false dmca being against the law etc would help (especially to the parents of the younger kids doing it) so perhaps instead of presenting thousands of names on these petitions to YT how about presenting a petition to dawkins - hitchens - harris et al so that the next time they get on cnn they all bring more media exposure to this issue - or a rich atheist could just hire a super expensive PR firm and blitz the issue out there - but not on the side of a bus :)
@ debbieomi these are people that are afraid of people that can see through there lies and inconsistencies. so you see there is a small crowd pulling these BS DMCAs
So, I'm wondering if hugely subscribed accounts like Nigahiga or Fred or WhattheBuck ever get false flagged. There are enough haters out there, so I think it reasonable to assume it does happen. But, are those weblebrities ever suspended? Does youtube remove the flag immediately without reviewing videos of those high profile users? Again, you have to assume they do since we never see them suspended. If so, why the double standard? Interesting question for you tube.
IP tracking waste of time, Open letter to youtube, been done since May by starfedrogue, 30k hits, 1k signatures a month. Passport & Driving licence ? cant be done, maybe as a deterrent, but the profile age of false flaggers, they wont have relevant documents, 20 hrs of vids an hr uploaded, work out the manpower needed to monitor & review. Try stopping the insults, I have free speech, but I dont go telling people on the streets they are retards. c'mon matthew, u know all this, its been done.
I think there just needs to be a token case against a false flagger or DMCA. Cost them a crapload of money or jail time - don't just make them apologize on camera like VFX. I think if someone gets sued or ends up in the clink that the amount of false flagging and DMCAs will drop.
It would be nice if they actually had some sort of punishment for the person filing a false dmca. Right now it's pretty much only punishing those that are being filed against. The problem is, the filing system needs to be changed. I'm not sure if the filing system is YouTube's very own, or if it's written within the law. There should be punishment though... just difficult to enforce since when a person files they are pretty much anonymous.
an advanced IP tracker is probably beyond what they are willing to spend they must get 1000s of dmcas a day too - PLUS - you can walk into an internet cafe pay in cash and file a dmca there to get round it - they cant track that if theres no cameras. I like the ID idea to file but what ID you choose is tough as this is a global site, not everyone has a passport or drivers license - under 18s would be a problem too as the law has to give them the right to file but they dont have ID`s
When I use notepad, I've found that keeping word wrap messes up a post, but if you turn it off before cutting it turns out okay. That's just my experience on a few forums, I can't be sure for hubpages' posting.
It'd be cool if you could EARN a way to completely get any DMCA or flags dismissed based on your track record. A year on the tube and it's obvious you're not a troll, you're immune! hahahhaha
I agree with TA that loss of youtube privileges may not be a strong enough deterrent, given how easy it probably will be to circumvent any workable banning scheme.
I think the problem with penalty-of-perjury deterrents is that they don't seem REAL. It's like the ToS for a website, or for World of Warcraft -- anytime there's a ToS update, you scroll down without looking. It's not REAL.
Perhaps by making it real, or at least SEEM real, we can stop this.
The ip tracking is a little more complex than you might be thinking. I've personally been behind 12 proxies before[not on my main computer]. Also I had a program that would swap proxies frequently.
Perhaps yt can trace it though, using some advanced algorithm. Unless I'm mistaken...
If you want to stop false flagging on youtube, subscribe to my petition channel. Let Youtube know how you feel!

If everyone were using Josh's program to protect their channel from votebotters, the bandwidth required to do that will probably bring Youtube down.
