  • PLEASE be aware that in some states, refusal to blow constitutes an automatic one year suspension of your driver's license. My state is one such state, and it is not the only one.

    The reason they can do this is that implicit in obtaining your driver's license is a passage in which you give your consent to be subjected to a breathalyzer. Failure to do constitutes an actual crime for which the punishment is a one year suspension of your license. If you know you're not intoxicated, BLOW!

  • What pisses me off, not to glorify drunk driving, but how is a fat ass soccer mom with one hand on the cell phone, another hand messing with her retarded kid in the back seat steering the wheel with her cottage cheese leg any less dangerous on the road than a drunk driver?? Why don't the police ever set up a "safety checkpoint" near a school, mall or a church??

  • Driving drunk / under the influence is a danger to your self and to the people around. Since police are forced by law to protect the people, they have to pull you over if are DUI. And those medications that impare your driving, have labels that say do not operate vehicles (or something like that). Do not blame the cops because you are drunk, if you are drunk you are a danger and as cops they have to remove the danger.

  • I wonder if most people realize that a DUI in most states is not drunk driving...dui = driving under the influence,not driving drunk or basically being over the legal limit which probably varies in states...,while DWI= driving while intoxicated,is considered drunk driving.Basically in my state even if you blow below the legal limit,the police can still get you for DUI,AND if you refuse any tests,its an auotomatic 1 year suspension no questions asked,so yea,many DUI cases are complete BS.

  • I don't think that any of us want drunk drivers on the streets. My problem with the laws the way they are is two drinks and you are legally drunk. So honestly, they could arrest most anyone leaving a club/bar and they could be charged with DUI which really messes up someone's life. It is LEGAL and taxable....the State makes lots of money off of alcohol. It is a huge gamble to think you are not legally DUI if you have had most anything to drink.

  • never take the field test or blow in the field. but do blow at the station if they ask. not blowing at the station is basically an automatic conviction. at least in illinois it is. chicago cops will most likely physically rough you up or verbally by screaming in your face. ignore it and let them take you in, or they may just let you go.

  • Now, I don't drink..actually I can't due to health problems so I tell people to just don't comply..you have that right. I was pulled over and harassed to give a field test and I refused. I would normally tell people to refuse the breath test as well but knowing I had nothing to drink, I enjoyed blowing a 0 for this bastard cop after all the sh-t he put me through. Don't mouth off but do not comply, period.

  • I hate it when things happen to people where they make one mistake that has the potential to screw them over for life. DUI is one instance where that can happen far too easily, because of the possible danger presented and the possible penalty.

    It's all avoidable if you get the mind set of "I will not drive if I've been drinking", or at the very least STOP DRINKING and allow the time needed to sober up so you CAN drive.

  • I witnessed a lot of those road side sobriety tests, and have to say the police do things that always makes a person look drunk. Never saw an officer administer it properly. In fact the whole road side sobriety test is ridiculous, and I would never comply to doing one. I saw one test where the officer had a guy stand on one leg. When the guy asked How much longer do I need to stand like this. The officer said when I tell you to stop. I watched this man stand on one leg for 5 minutes.

  • Well you are screwed either way. If you take the test you are making it easer for the cop. Fine 250 lose of lic for 6 months . If you don’t the takes your lic for 2 years and fine and you get higher insurance 4 years. Not only that the cop usaly got you on dash cam weaving or some thing else. You being unsteady on your feet, slurring your words red eyes. You loose any way for the most part.

    It's called the Implied Consent Law. Getting a PA drivers license indicates your consent.

This was done to curb people who were drunk and refused everything to keep the state from having any evidence. Obviously your best choice is not to drink and drive. Your next choice is remember your rights. Do not say ANYTHING. You have the right to refuse. In FL you loose your lic for 1 year. But you are not branded an alcoholic and you can get a temp.

  • no, you can politely refuse to:

    1. answer any questions ("have you been drinking tonight?", "do you know what the speed limit here is?", etc.)

    2. take any field sobriety tests

    3. consent to any searches

    4. take a breathalizer test

    If a cop wants to arrest you, he can do so. But if he does so with no evidence against you he'll look like a total idiot. Consenting to searches or sobriety tests or breathalizers, or answering any questions, is just HANDING HIM EVIDENCE that will help him.

  • From what I've read, IF YOU GET ARRESTED, then when you get to the station they will ask you to take a blood or breathalizer test. If you refuse that one, you will automatically have your license suspended.

    But field tests and you and should politely refuse. Doing so helps you to avoid getting arrested, because few cops are going to arrest you on no evidence. And as long as you weren't swerving, they will have NOTHING against you.

  • @garrett1118 The Constitution is suppose to protect you from things such as this but the reality of it is that there are many in law enforcement who don't support the US Constitution and force these types of tests on people. Case in point; Austin & Houston,Texas where fascist jack booted cops think it's acceptable to forcibly remove blood from individuals on the side of the road.

How this is acceptable is beyond me. I'm all for road and highway safety and stopping drunk driving but law enforcement but respect and obey the US Constitution.

    On that note according to the US Department of Transportation this is a test program, the hope is to obtain funding to start a nationwide program.

  • Yeah, what you left out is that even though you can't refuse the test, instead of a field test you can choose to be taken to a hospital to be blood tested instead. Why would you leave the most important part out? Don't you think your odds of passing are a tad bit better if the cop has to transport you to a hospital before testing? When I turned 18, it was legal to have a beer while you were driving. 1979. Couldn't act drunk though. I bluffed my way out of a dozen stops before I turned 20. Hard adjustment but times change. People abused these "loose reigns" and now we're hobbled. Was nice to sip a beer on a road trip. Bummer. Now just smoke a joint.

  • Usually its represented as square box that you must check when your feeling out the forms to get your driving license established or renewed. You must agree to these rules or your not allowed to obtain a license. This box basically states that you will give your blood/breath/urine upon request to an officer of the law, for the purpose of evidence that could be used against you in a court of law. This is against the 5th Amendment and so it can be challenged.

  • If you were PBT tested while not driving, then you were suspected of Public Intoxication, not DUI. The fact you put a .04% into the PBT indicates the obvious, you were responsible that night. I don't know the whole story, if you were a passenger in a car, going crazy at a college party, or simply just needed police attention. Police do not randomly pick citizenz to PBT. As far as writing reports to intimidate people. That is not exactly accurate.

  • My facts are accurate, believe me. Refuse at the scene and the cops are already planning their report of how you were unsteady on your feet, had glassy and bloodshot eyes and refuesed to comply with field testing. Refuse away at the scene and see who wins. The cops. The three cops that will be there for your tests and all write the same report will sink you. Also, by the time the PBT is used, you're getting locked up. Refuse or take it the outcome is the same. You are in custody.

  • Drunk drivers are more likely to swerve into oncoming traffic, run red lights, run stop signs, drive at excessive speeds, etc. which is what makes them so dangerous. If you KNOW you are drunk and get caught, yes, you are better off to not take any tests. However, at least half the time, officers decide to let the person go after passing field sobriety tests (or having them call a friend if they are borderline). Refusal to take the test is a definite trip to jail.

People should be responsible for their actions and be aware that when they make stupid choices, it doesn't just affect them, it can affect anyone. My friend was not killed by a murderer who happened to be drunk, he was killed by a drunk who didn't obey the law. It could have been avoided had the driver followed the law. Murder is a plot.

  • I think that if the driver that hit my friend wasn't intoxicated, the accident MAY have never happened. There's no way to really know. All I was trying to say is that people should be responsible for their actions because their actions don't just affect them, it can affect someone else too. I'm not trying to be ignorant, but like you, am entitled to my opinion.

I had a friend DIE from being hit by a drunk driver. I understand that you have a disclaimer, but at the same time, if someone is dumb enough to get behind the wheel, then that person deserves what is coming to them.

  • no your friend was killed by a murderer who happened to be drunk. Murder is allready a crime dui by it'self is not because there is no victim. Police often push cirmcumstances to get a conviction where there is none, the machine is totally not accurate in any sense of the word & the process can be corrupted to gain thousands of dollars for the state. Also this helps bolster that these lazy bums who are supposed to serve & protect, justify their existance. no victim no crime.

  • Yea, but if you fail there, you're screwed.But, it is given about an hour after the arrest. So, if you're lucky, you could get the BAC down enough to be free. So, they only "arrest" you to take you to the station.

  • Great video. The policeman was always in control. The suspect was obviously unable to operate a motor vehicle safely. If the suspect refused any tests the officer could have easily and legally arrested him. At the very least it would take him from behind the wheel for his own safety and the publics safety as well.

  • The laws against drinking and driving have been getting tougher and tougher since I was a kid first learning to drive in the 60's. The push and pull between individual rights and the safety of the individual and that of the public needs study and evolution of knowledge and laws. The police do a great job in the area of DUI and could do even more IMO. The goal is to save lives and even property

  • Especially here in the South where many states do not allow Sunday sales of alcohol. Of course this does not include drinking in a bar, which is perfectly fine.
