Down here in canada we have something called ''Charter of rights'', I believe similar to violation of civil rights, I had got a lawyer, and paid him with legal aid,& money on top of it, and the police officers and crown didn't want to go to trial simply because my lawyer pulled charter applications, so they dropped the charges
@jojo24love See but that's the thing - police can arrest on any kind of false charges and make up basically whatever they want. Even if they know that they have no chance on getting a conviction, most citizen will still take a plea deal to avoid all the heartache and time. But even if you do take it to court, they know that you will still lose all the time and money you spent to defend yourself. So you still lose in the end.
They will word the criminal complaint in their favor, as long as their is some type of material evidence (in this case marijuana) they have the upperhand. They will just say you gave them consent.
All is not lost tho, you will have to go through the system and they will most likely offer you a ACD (Adjournment in contemplation of dismissal - stay out of trouble for 6 months) at arraignment.
If you have any shot of beating a case by a jury of your peers it is in NEW YORK CITY. People in this city know the cops are SCUM and even before that the District attorney will not really care to make a strong case against you for some weed and will most likely be dismissed at a grand jury hearing.
Fight it in court. Although you may have to go to court a few times you can win these cases.

What probable cause did the slops even have to search this guys car? When you get pulled over keep your doors locked, windows open just enough to pass papers. If the cop asks you to exit your car, LOCK THE DOORS, and close the door. Without your consent, any search made without probable cause is inadmissible in court.

It's evident that those servants for authority, New York police plain clothes officers relied on race as the primary reason for this ''Stop and Frisk'' of those men, & illegal search & seizure of the motorist vehicle. The officers went through the entire car without any legal reason. I'm growing tired of police officers using these misconducts and tactics, unlawful tactics that is. These officer's are simply pulling over black, and latino men en route and they can accuse them of anything

@Maserati7200 They will claim they had reasonable suspicion to conduct the search. Or they'll just lie and say that you consented and if it's not on video, then it will be your word against theirs and you will always lose.

@1775novten you are so right, I had a white female undercover officer walk away from the vehicle I was in, radio in for back up & stated that I was refusing to identify myself,when I already did identify myself. Why would I refuse to identify myself? I had no prior record, I was not committing any crime, this was her way of validating her reason to search my back pack, and the vehicle I was in. The police will always try to find distortion of the facts in trying to justify their reasons. liars.

And even if you are able to prove your innocence, you still can't beat the ride to the station and all the time and money you spend to defend yourself. They are straight up crooks and they know you will lose regardless of the outcome.

@1775novten I hear you on that, but on that particular situation I was falsely arrested for obstruction of police officer, marijuana possesion, & I actually beat it. Down here in canada we have something called ''Charter of rights'', I believe similar to violation of civil rights, I had got a lawyer, and paid him with legal aid,& money on top of it, and the police officers and crown didn't want to go to trial simply because my lawyer pulled charter applications, so they dropped the charges

@jojo24love See but that's the thing - police can arrest on any kind of false charges and make up basically whatever they want. Even if they know that they have no chance on getting a conviction, most citizen will still take a plea deal to avoid all the heartache and time. But even if you do take it to court, they know that you will still lose all the time and money you spent to defend yourself. So you still lose in the end.

You will be arrested there is no doubt about it.
They will word the criminal complaint in their favor, as long as their is some type of material evidence (in this case marijuana) they have the upperhand. They will just say you gave them consent.
All is not lost tho, you will have to go through the system and they will most likely offer you a ACD (Adjournment in contemplation of dismissal - stay out of trouble for 6 months) at arraignment.
DO NOT PLEAD GUILTY.

If you have any shot of beating a case by a jury of your peers it is in NEW YORK CITY. People in this city know the cops are SCUM and even before that the District attorney will not really care to make a strong case against you for some weed and will most likely be dismissed at a grand jury hearing.
Fight it in court. Although you may have to go to court a few times you can win these cases.
All that "you cant search my car" shit is useless unless you have it on tape.

@Maserati LOL.They would kick your ass. Then you would spend three days in jail waiting for judge. If you have a free lawyer they are going to want you to plea to some thing did not do. If you have a paid lawyer they are going to make that case last for 9 months. That means you are going to have to pay that lawyer every time you went to court. Just ask the guy who made these videos. The line at 161th court is long every morning. Now tell me are you going to go though all of that?

If you dont live in the city, making 100k+ a year the mayor does not want you here. Police officers get way too many perks. This allow them to infringe citizens rights. They have the 2nd/4th amendment rights. We dont... Police officers can do what ever they fuck they want do in this city. I hope more die off.

They were about 5 D's in my own building just last night making sure they do they job by harassing everyone in there sight. Idk how that is legal, even regular bystanders. They've become very dangerous and a threat to peoples safety even more so than criminals.
