UM/UIM coverage has always been "at fault" coverage. You are not covered when you are "at fault." To say that "years ago" UM/UIM would have covered these people is false.
The story also doesn't tell you that PIP is $5,000 "per person," not "per occurrence."
The real problem with Ohio auto insurance is that the UM/UIM family exclusion has been extended to cover persons "operating" unscheduled family vehicles, whereas it was previously it only applies to those "occupying" unscheduled ones.
The point of Insurance is to financially protect the person that pays month to month on such insurance....a total ammount of covereage is agreed to when you sign the contract, now....why can it not be that simple? it like a bugs bunny cartoon where it happened to be a tuesday the day of the full moon and the horse that hit you was missing a left horse shoe....
this story is full of holes. UM/UIM coverage is always there if the other party is at-fault. if you cause the wreck, that is why you have health insurance.
the real issue is why did this guy kill his daughter by driving in a legally negligent fashion?
