Well, yes, actually gays do care about getting that "stamp of approval." According to California Family Code 297.5, domestic partnerships already share the same equal rights as married couples. Whether they actually get those rights is a topic for another debate. At least in California, civil unions have been offered where gays would have the same rights as married couples- only a change in the name. I think it was Newsom who said that this was unacceptable, and that they would pursue marriage.

PROP 8 in CA is an Amendment to the state Constitution. It can't be overturned by the state Supreme Court or any court. Repealing a constitutional amendment can only be done with another amendment, just like the U.S. Constitution. That would require either another ballot initiative or a two-thirds vote of both houses of the state legislature, after which the proposed amendment would be submitted to the voters.

But see, if gay marriage is passed, then society will be putting their "stamp of approval" on the gay lifestyle, and in every aspect of societal life it will need to be seen as good and equal to a heterosexual relationship. Well, yes, actually gays do care about getting that "stamp of approval." According to California Family Code 297.5, domestic partnerships already share the same equal rights as married couples. Whether they actually get those rights is a topic for another debate. At least in California, civil unions have been offered where gays would have the same rights as married couples- only a change in the name. I think it was Newsom who said that this was unacceptable, and that they would pursue marriage.

Many would argue (though not many want to hear the argument) that marriage does affect society. If Jane and Sue down the street go get married, it's of course not going to affect me directly. It's the fundamentals of this- how marriage as a whole is important for society, and changing it would have effects. Again, I say how these people can get any rights they want independent of being granted marriage. Remember, marriage is just a name- they can still get rights otherwise.

PROP 8 in CA is an Amendment to the state Constitution. It can't be overturned by the state Supreme Court or any court. Repealing a constitutional amendment can only be done with another amendment, just like the U.S. Constitution. That would require either another ballot initiative or a two-thirds vote of both houses of the state legislature, after which the proposed amendment would be submitted to the voters.
Like it or not, that's the way it works.

prop 8 won, not cause of the children ad, but because of the Knights of Columbus SMEAR campaign, where they sent ads of obama saying he was not in favor of gay marriage (although he was AGANIST prop 8). Cause of this, 70% of african americans voted yes on 8, cause of SMUGGY SMEAR BULLSHIT THE KNIGHTS OF THE COLUMBUS SENT OUT.

I didn't vote for obama but what they like to shove in our faces is "the people have spoken." i'm pissed... but it's true.... i think prop 8 was a very sensitive subject but i think what truely killed it for the No on 8 folks was Gavin's speech "like it or not." that sort of shows it forces you to think a certain way.... which most people dont want, doesnt mean they hate gays, they just want their views respected. there is civil partnership with same rights and i would take that over nothing.

How in today's society- where divorce rates are at a high. Children are being abused. Wives are battered. Why does one care that someone two houses down is married to someone of the same sex. Don't say it's unatural- condoms are unatural. Don't tell me the bible says it wrong- it says one shall disowned for lying to your parents.
Marriage is recognized everyhwere. Civil Unions arent. If my "partner" becomes sick I wouldn't be able to visit him. All rights would have to be fought in court.

I have no problem with giving gay couples 100% equal RIGHTS (legal wise) but the ACT of marriage is one that has basis in religion and not not a legal right in any way. There are 1,049 federally-given rights, privileges, and benefits that are routinely provided to married couples. Civil unions only apply in-state and do not include those 1,049 rights, privileges, and benefits. Anything that you come up with to afford homosexuals the same legal rights will, for all intents and purposes, be considered marriage.

Can't do that, ever heard of DOMA? It's a federal law that explicitly states the following:
"The Federal Government may not treat same-sex relationships as marriages for any purpose, even if concluded or recognized by one of the states."
Calling it a partnership and affording it the same rights as a married couple is treating the partnership as a marriage, even if you're not calling it that. Creating an entirely different law for something that is exactly the same is impractical.
