There needs to be state laws regarding mismanagement. However, many homeowners in HOA's are ignorant of the rules in many cases. Read the by-laws before you agree to the home. These people who move in with a big truck and complain that they are getting fined for their commercial vehicle are just stupid.

Sadly most HOA's don't hold up to their end of the bargain, either, and steal money all the time.

@richflocker An HOA is designed to protect your interests. Whether it does, or does not, is an entirely different issue. It is the same as, "Read the contract before you sign it." There are plenty of bad business deals out there, you just don't do it.

If you want to live life your own way, then buy a house out in the woods. That is what I plan to do.

When COA's are self-managed by fair, reasonable people, and when residents play by the rules that they agreed to, things work well. Buyers opt to forfeit a degree of freedom to know that they won't have to deal with dog crap, cars on blocks, junk on the lawn, etc. The restriction/benefit balance is clear up-front. Sadly, though, there's little recourse w/malicious or ineffective boards. More often, though, boards are placed in untenable positions from residents disregarding the rules.

I tried to post this on Beazer Homeowner HOA. I live in a Beazer community and it looks NOTHING like this. We have NO amenities and we are harrassed about violations that aren't in the CCRs! We are forced into the HOA just because we wanted to buy a home, we sure as heck didn't want to live in a corp! The mgmt cos are only out to get as much money as they can from the homeowners, so they have to constantly look for something to not be perfect and pounce the moment you fail at perfection.
