  • I see nothing wrong with the way the officers acted. That was fair. They saw you had a firearm, they asked if they were allowed in the building, the owners said no, they asked you to secure it or leave. That's fair.

  • South Carolin has it codified in law that a sign must be posted at ever public entrance and must conform to a certain set of regulations

  • Some one with a cell called in a complaint so you get cops and then the questions. It may even be the one with the gun that called in the complaint to try get the cops in trouble.

  • @samten10a One of the troopers was already sitting in the parking lot when I went into the restaurant. He waited 15 minutes before getting his two other friends there as well. The one who approached me was not the one who harassed me.

  • My concern over this issue is that you guys are doing this to get a reaction from police. Regardless if it's the State or local officers, they're morally required to do something. You can't expect them to sit there and watch someone walk into a crowded restaurant with a gun and do nothing. The next thing you'll see is a person walk into a public place and not get contacted because the open carry guys are trying to prove a point and get some media attention.

  • I cant find if they are required to post a sign. actualyl maybe the `owner` isnt even on teh premise. It`s reasonable that if thats teh case, then whoever is at teh register is `in charge` of making that decision.neither the officer or carryguy did anything wrong here. turning this into a harrasment/wrongfull seizure situation is off base and doesnt help the cause. the protest calling for the LEO firing or discipline is way too far given what happens in this video.

  • Businesses are not required to post a sign, but they can post one and they can ask you to leave if there is no sign up. If there was a sign posted, I would have never walked into the restaurant to begin with. There was no call to the police, but the officers took it upon themselves to intervene in making the decision for the business.

  • If there is a sign, I'm not going to patronize their business. As for the law, if you are not willing to leave, then you can be arrested for trespassing.

    Only asking because I have virtually an identical setup (M&P45 fullsize and blackhawk serpa) and it doesn't make a peep. Though i can only carry at the range and private locations so have limited time with it. (Tx resident)

  • You can carry in Milwaukee County, but beware of the school zones as that is illegal.  Wisconsin Carry, Inc. has filed suit in federal court to strike down the WI GFSZ. So hopefully sometime in the future we can carry in more locations for our protection.

  • thats awesome!!!! i was totally unaware WI was an open-carry state...i am told, however, that in the city of milw., ed flinn has directed mpd, to put anyone open carrying on the ground, take there weapon,, and run a check on him/her...is this legal!!!??? i want to be a member of your Wisconsin Carry, Inc...how do i go about it-thanks and great job-you are a true American

  • Flynn said that publicly, but internal documents said to not interfere with law abiding people. If you want to join Wisconsin Carry, go to their site and sign up. As for any other get-togethers, watch the OCDO WI section.

  • I`m really dissapointed sir. I spent today wanting to get invovled in open carry awareness and volunteer to help getting concealed in WI. if this is how these carry groups react with LEO then forget it. I`ll have to find a more mature group to do it with.Like it or not, this is a change from the norm in WI. Its going to take patience and some getting used to from all parties.

  • I have got to say. There was nothing rude about the officers actions or attitud ein my opinion. He didnt harrass you. He asked if the PRIVATE business allowed firearms. they said NO. You were respectfully asked to leave. wich you did.Also respectfully this is EXACTLY how this interaction should have gone. unless something happens off camera im not aware of. sounds to me like the officers last words to you were " Have a good day. "

  • It's not the officer's business to ask people to leave unless he owns the restaurant or the owners tell him a customer is refusing to leave.

  • Nothing like a cop with an attitude.  This little prick thought he was something special. Love the way he walked away and then turned and stood with is arms crossed. Obviously he's never learned anything about body language. Spent 37 years in law enforcement and guys like this should be fired. PUBLIC SERVANT is a term they are not familiar with. They are jerks, power hungry buttheads.

  • i too and from sussex and this did not help our name at all. after seeing this video i was a bit upset. the officer did nothing wrong he simply asked if it was ok to have a gun in the restaurant. The owner did not seem to have ever thought of whether or not he would allow guns in the store. i do think the police out hear over due stuff all the time but this was not a big deal at least not enough to go on the .news. cops did the right thing

  • @SgtSchroeder26 I have been in there many times before and nothing has been said to me and no police were called and have never been called on me before. The owner originally said she did not know, meaning they have no policy one way or another. A week later, we (Wisconsin Carry and many of those who support people who can legally carry), ate at that restaurant. Guess what? No police were called. Seems to be perfectly legal to carry there.

You have cameras rolling, along with live audio recording everything you and others say in order to use it against anyone, including those who you start shit with, yet somehow manage to lose those video tapes when you violate someone's civil rights, as has happened numerous times!     Oh, and on that day, I was wearing clean blue jeans, with a white sweater, a clean coat (but that was hung on the back of my seat), shaven, short hair cut (.5"). I am a law abiding citizen (100% clean record). There was nothing that would even show a probable cause to even question me.

    The lady said "I don't know" when the cop asked if they allow guns and still made the dude take ti the car? I'm glad I live in Texas, but even Texans can't open carry.

  • I thought the trooper was very professional, and I was impressed to see that the other 2 officers didn't get involved. Shows that it wasn't an issue for the trooper, just the guy who set up the scene....

  • This cop was a jerk. The cop should have had zero interaction with this man UNLESS the store owner complained. This is harassment and the cop should be reprimanded for it. The other two cops didn't get involved because they knew better.

  • And for those of you saying that he didn't run him to check for warrants, or anything. How do you know that? Were you sitting there with the trooper watching his every move. They do more for the safety of people than people realize and then they come under attack. I for one would rather have someone question someone carrying a gun and make sure that intentions were good rather than have a tragedy occur.

  • They did run my plate and came back clean (of course). The had to reason to question me as I have no committed a crime, was not committing a crime, nor was about to commit a crime.

  • It would do you well to study the State and Federal laws you live under. Whether you like it or not, that officer had no legal basis to approach the customer. You cannot detain an individual without "reasonable, articulable suspicion" that a specific crime is being committed. That's the law. Run for office and you can try to change it.

  • If there is no "reasonable, articulable suspicion" that a specific crime is being committed, an individual cannot be lawfully detained.

    If he is not being detained for questioning, he has NO OBLIGATION what so ever to even respond to the officer.

    When the officer says to him, "Owner says they don't allow guns in here", if he responds, "Am I being detained?", and the officer says no, he is advised to say, "Thanks, but I'm not interested in talking to you".

  • I don't think Aaron knows what he is talking about. If he is carrying a firearm which is in plain sight, and refuses to leave a business who doesn't want him in it, he can be arrested for trespassing.

  • I was never told to leave by the owner. The owners never called the police, they just happened to be there the same time I was.  If I was asked to leave, I would leave and never buy anything from them again, and I would tell others to not support their business.

  • @sickofgameplayers They ran my plates and everything came back clean and yet they still decided to enter the restaurant to question the owner if OC was okay in their restaurant to which she originally replied as, "I don't know." He continued to ask her and of course with most Chinese people, you don't question the police. Of course, if I were a criminal, wouldn't I be carrying concealed rather than obeying the law on transporting my firearm and carrying it?

  • This is true considering i don't think i can say in my 17 years i have ever seen a person with a gun or at least like you said i haven't noticed. You did however help me with my Current events article for school. lol. ironically we are studding the amendments right now.

  • If somebody came in crazily shooting up the place, you'd be just fine with a law abiding citizen carrying because he would end the rampage BEFORE you were all shot dead (assuming those cops didn't show up for lunch). An armed society becomes a polite society when criminals aren't the only ones with guns.

  • Further, the trooper did not ask his name, run him for warrants, search him or his vehicle (not that he should have). Which just further shows this trooper wanted to make a statement to this oc'er that he's got his eye on him. Essentially that if this oc'er wanted to play the 2A 'game', that's fine but it wasn't going to happen without a challenge. Personally, I would have been embarrassed to have been called out like that, which I think is the minimum the trooper was trying to achieve.

  • And I fully expect sooner or later to have a LEO interaction (not looking forward to it frankly) which is precisely want I want evidence in my favor that I was not doing anything wrong. But for sake of argument, let's assume this oc'er was hoping to make waves with the troopers. According to the video, he did NOTHING overt to warrant LEO interaction. He didn't wave the handgun, he wasn't acting nervously or suspiciously. He was in fact eating, in a restaurant, like everyone else was doing.

  • I would also add that this oc'er has been accused on some forums of setting up these troopers because he had a camera. I also carry a camera when I oc to protect myself. I also have not oc'd at places because I felt like it was too likely to make a stink, and I'm never looking for trouble. Some have state that because oc is relatively new in WI, you have to expect LEO interaction at least at first. That's also EXACTLY why I carry a camera. It is new. (cont)...

  • I strongly oppose the possession, open, and concealed carry of firearms. However, it is a constitutional right and these officers had no business even approaching a law-abiding citizen eating his lunch. That man carrying a firearm is just as legal (or illegal for that matter) as people picketing outside their employer, a journalist publishing an article, or my right to go to church in Sunday. It's complete bullshit and I agree that the cop was asking a loaded question of the employee.

  • It would be nice, if just once! Cops would read the "oath of office" they took when they signed on. Cops have guns for personal protection! (not to protect us) Why do they think we need to be sitting ducks for the 3-10 minutes it takes for them to arrive on seine? Cops fill out murder, rape and robbery reports (after the fact) more often than they ever will... fill out reports stating how they (ever) stopped (any) crime in progress...

    I'm so glad I live in Utah...OC or lose all your rights!

  • And I don't know if you read the link in the sidebar but this oc'er had 3 Sheriff's deputies show up at his house later that night to question him about possibly impersonating an officer. I don't know if you're from Wisconsin but very recently we've had developments in the open carry area politically speaking, which continues.

  • He could have just as easily walked in and said to the owner, do you allow red-haired people in here? Why pick out the oc'er? Because he had a personal agenda to harass the oc'er who was simply minding his business and enjoying his meal. Clearly the other two troopers aren't concerned- they go directly to get their food. And I can quite easily say thank you as well, but in an fu sort of way as he did.

    I'll grant you that he could have been way more of an a-hole than he was, but so what.

  • @ExitRomeo I agree with you that these cops had an agenda to fulfill. However, the two cops--According to the Waukesha County Freeman--who were at the buffet getting food were there for that reason: to get food. They were State Troopers who met there for lunch and just happened to see this guy with a gun.

  • I agree fully the other two troopers were there to eat and also appeared mostly unconcerned about the oc'er. I read on one forum a poster claiming to be a LEO that the trooper was probably fearful of the oc'er especially considering the coffee shop shooting in Seattle(?). The video would dispute that as two troopers appear unfazed by the oc'er and the 1 trooper making the fuss even turns his back to the man-with-gun.  Neither of which is likely to happen if you're in fear of your life.

This patrolman had every intention to engage the oc'er, despite no complaints being made by anyone, Almost as an after-thought it bothered to stop and ask if they allowed guns in the restaurant(he practically fed the answer he wanted to the owner). It's clear to me no matter the answer he got he was going to engage the oc'er. And then he stands there with his arms folded. Was that a friendly gesture? Why did he single out the oc'er anyway, is the biggest point?

  • If they don't allow guns then the LEOs should also go somewhere else to eat. Unless the restraunt manager asked the cop to remove the law abiding gun carrying citizen the cop should go about his own business. Also think the restraunt should post no guns allowed sign if they infact do prohibit them.

    As I said in the video, I have been in there several times with no problems and there are no signs for or against legally armed citizens in their business.

  • Personally I am not a fan of open carry. But this cop was just looking for trouble. If the restruant owners ask the cop to remove the OCer, then fine. Otherwise the cop needs to mind his own buisness.

    Seriously...the cop was asking an employee a question of a person that did not speak English and kept asking the person till he got the answer he wanted...either way it didn't sound like they had a policy on guns...either way.

    I've said it before, I'll take seasoned officers over young ones any day, Generally, the seasoned officers know what life is about and are past the point of wanting to play cops and robbers. They just want to do their jobs and go home.

  • No, one was sitting in the parking lot when I pulled up and put my XD45 in my holster. He was waiting for his friends (two other LEOs) for a good 15 minutes before the third one (in the video) approached me). The camera was in plain view (Flip Ultra HD).

  • On a second viewing, he really was an ass. I'm just relating it to my past experiences where 10 seconds into the video I would have already been spread eagled on the ground :)

  • Nice job, but I hate that you even had to be bothered by it to begin with. He seemed fairly decent for a LEO after initially telling you to get out.

    So I missed it. Did they get called on you or did they notice you with it?

    Also, did he see you had a camera or was it hidden? They always get nicer when you have a camera.
