Almost always, white collar criminals are allowed to remain free on appeal; Scooter Libby was inexplicably denied that right. That is why Bush's commutation was justified. Also, Scooter Libby's life is bad. He can't practice law, vote, or do hardly anything.

Libby defense wasn't allowed to call memory experts. And before the trial even began the prosecutor KNEW that the source of the Plame leak was Richard Armitage, not Libby or Cheney, but he went after Libby anyway because Armitage wasn't linked to Cheney and Fitzgerald wanted to link Cheney to wrong doing even if Cheney had done nothing.

It wasn't proven that Libby lied. He only remembered a conversation with Tim Russert differently than Russert did. The Jury believed Russert. Libby defense was not allowed to present evidence of Russert "remembering" something else wrong, though there was video tape to prove he did so.
