Failing 30% of the time is more than "slightly unreliable". Even those who have been working it only get a 90% success rate by the sounds of it. It makes a fun "test" with friends but it's not a worker.
I don't think most outs work with the trick's premise either. You go from "I have X-ray vision" to "No? Well, um, I made a prediction earlier." That doesn't jibe.
There's an old, well known method for influencing a cut. That and a shuffle gets you the same effect with 50% reliability.
Lay people do not handle cards often and find things like cutting cards - things that we magicians find easy-very difficult. Another example is that you only have to ask a spectator to simply name any card in the deck and their face screws up in agony. Lay people do not work with cards every day of their lives. Magicians need reminding from time to time about things like this.
@andyfieldmagic Hey Andy, im really glad i found a way to talk to you. I know people such as your self and mismag get so many messgaes you cant answer them all. Hopefully we can chat though. I'm a huge fan and a loyal magician and was wondering perhaps if maybe we could bargain with a few tutorials such as cups and balls? I'm 15 and not many people on youtube respond to me so I'm glad you have :D
My advice is to make sure your volunteer is capable of following and executing the basic cutting instructions and is also not difficult or trying to mess up the trick. A test would be to get some of the audience to cut the cards at some point maybe to "mix them up". Then just watch each one and see who would be better to use when you perform X Ray.
@andyfieldmagic That’s excellent advice Andy, I had a play with this effect for the first time last night and I must confess, I really am very impressed with “X-Ray
