    Speaking of lawsuits: Being an English teacher, do you know whether this poem is available in the public domain for use in songs like this, or would I need to pay royalties if I were to sell it?

  • You had better consult a lawyer about this, and I am eager to know the answer, too.

  • The poem is in the public domain the United States. Under the U.S. copyright law in effect in 1951, the copyright expired on the 28th anniversary of the date of first publication, unless it was renewed before then. The poem was first published in The New Republic issue of March 7, 1923; Frost did renew the copyright of the poem by March 1951. He instead renewed the copyright of a book published later in 1923 that contained the poem. Too late!
