What I and others have done is considered Fair Use. The gray area is the fact that this is being hosted and distributed by them. This is no more "copyright infringement" than the other Mario levels that are -- last I checked -- still online today. They may use the fact that they serve the levels as a sticking point.
I have an email to Sony about this right now actually. Hopefully I will get a response before our radio show this week.
is this not copyright infringiment? I'm curious to understand what MM and Sony consider as C.I.
If everything can be deleted from server 'cause potentially everything can infringe copyright (just a picture of Batman..or Mario...), they should remove the word "share" from LBP claim...and it's a shame if we consider that this game perfectly exemplifies the blending practice of cultural meanings (both Mario and Batman are part of everyday lifes) of nowadays society.

That is a tune in the game. I don't think you can use outside music. You may be able to record something from the PS Eye.

yes..but A&O XXL2 is not an UGC based game and everything concerning Mario in it was paied from Sony (or whateverelse) to N.
In LBP things are different...and what is important to understand how gray is the gray area between fair use and copyr. infringment.
