The Federal Court of Appeals did not rule that the Holy See can be sued, but rather dismissed a case of sovereign immunity so that the definition of the scope of employment could be determined in the lower court. It must be proven that the Holy See was responsible for an employees pay and benefits. It will quickly be shown that the local Church, not the Holy See, was responsible for pay and benefits.
