Which still leaves the question: Why would a person with no history of abuse kill a random person to begin with? If this gets a murder conviction, there is more evidence that we don't know about. My best suspicion is that the DA feels they have enough evidence to prove an intent to kill (how? I dunno).

My worst suspicion is that the DA knows that it will eventually be bumped down to some form of manslaughter, and so they are caving into public pressure, and they can look like they did everything they could. Very bad for the DA's credibility, since how the hell would they prove intent to kill?
