Just so you know, Advance Security are registered with the BSIA, who issued guidelines to all their staff last year regarding photography in public, so these guys KNOWINGLY lied to you, and knew full well they were acting out of their authority.
The guidelines were in a document called Photography & Hostile Reconaissance, and are available (with complete permission from the BSIA) online.
People should be aware these 2 are primark security, thier job is to stop poor people stealing pants & socks, they shouldnt even be that far outside the shop
They have NO legal authority to approach you as you are in public. And they are NOT law..but anyway, they have got in front of your camera and thank you for sharing your video of their ugly mugs here on YT. If they kept their unauthorized noses out they wouldn't be on film.
1. You should have pressed charges against the security thugs, or at least required the police to take a crime report.
2. Concealed cameras - a pen camera in a shirt pocket for instance - are invaluable for recording what such thugs say and do one they think they've forced you to stop recording.
3. I'll have to make a point of visiting Basildon next time I'm in the UK. It's a real bugger when people like that try to manhandle someone with martial arts training...
what concerning is people in security and positions of authority like this dont really have much knowledge of the law and where it stands on photographing in a public place. fact is, they cannot do anything other than make their concerns heard to you. best thing to do for anyone viewing this is to download the relevant acts of law, print it, along with some id (always be upfront) and keep it with at all times. once they have been informed that they legally have no control, kiss them goodbye
The country is rapidly going down the toilet. People exercising powers of arrest without even knowing the law. Its a great time if your a control freak, it really is... not so good for the rest of us though, as we watch on, witnessing the authority becoming the 'terrorist' in our society.
it's not about where you're filming m8, it's about who you're filming. I'm not sure about australia, but it is illegal to film police officers during an arrest in many many places.. With good reason too, just be smarter next time. I will admit that "license" bullsh*t was made up and those two guys are dickheads, just be carefull with that stuff, when they approach you with their cocky authority things can get outta hand :/

why the hell would you film people getting arrested? they do have the right to detain you, and every single one of them has the right to sue you, by slandering their image which may result in future income loss due to this video. more importantly why be a fucking dickhead and film people in this situation. if you did that in Australia you'd get bashed by every ethnic group present as we respect one another.. btw I have received a legal education so i do know what i'm talking about

Dear Billyboy. I have contacted the echo regarding this and have sent them the link. They may be in contact with you. (just make sure they don't take a picture of you if you are in public...joking)
This is disgusting. Can't film in a public place. I can believe that a shop may ask you to not film in their store but mr team eastgate seems to have swallowed some jumped up twit pills.
I have shared this vid on my Basildon memories page on facebook to show how basildon has changed, i hope you don't mind fella. When I see that guard I will get my camera out and start filming him. I am twice his size, lets see him wrestle me.lol
Did I correctly hear one of the guards say that he works for the police and proceed to caution you? If so, i would have laughed in his face. Photography and filming in any PUBLIC place is legal in the UK - the only places that require a license or permission to photograph or film for commercial purposes ONLY are Trafalgar Square, Parliament Square and The Royal Parks. I too would have pressed charges for the assault that took place in the video as well as false imprisonment had they detained you
The private security sector must be the first port of call for employment for those who are too mentally inadequate to pass the police force's aptitude test. And that's saying something given the low level of intelligence of most of the newer generation of police officers.
I've seen this argument before over whether shopping centers constitute public places, as other youtubers have also been prevented from filming or busking on the grounds its private property.
You have it all recorded on camera, you were detained against your will for a non criminal offence, believe me you have a case in any court for wrongful imprisonment or false arrest. You civil rights were violated. They will be hoping you don't report them let me tell you. I worked in loss prevention for 14 years and i would have just left you to it.
what a pair of dickheads, u should have just kept filming and kept walking away and every time they touched you make sure it is recorded and charge them with assault, and if the cop said he was not going to arrest them make him on his oath!! these little hitlers on minimum wage need to realise they have absolutely no power over anyone
EVERY case is ALWAYS only as good as the VICTIM asserts in his WITNESS STATEMENT/s [+ Statements of WITNESS/es] + POLICE Report + MEDICAL Report + Specialist Report [if necessary - if your Clinical Depression is very bad].

If you were to go to your GP because you were TRAUMATISED due to the highly STRESSFUL situation that might have caused you CLINICAL DEPRESSION - LOSS of SLEEP - NIGHTMARES + unable to get up + very short tempered etc. [classic symptoms] you could get DAMAGES i.e. compensation for EVERYTHING that you have suffered... everything that you have lost... [such as LOSS OF EARNINGS or LOSS OF OPPORTUNITY...]
You performed an excellent PUBLIC SERVICE - as you brought to the attention of BRITISH people who now regularly check the Internet & have discovered the unbelievable IGNORANCE of PSCOs & Security Guards who DO NOT have a clue as to what the LAW might be...
Perhaps they have seen too many trashy US programmes where it might have appeared in their fantasy understanding of law that the POLICE could do whatever they wanted - fortunately, YOU KNOW that THE POLICE are governed by THE LAW!
we should get every one ready to stand up and counted and all head down there day after day with whatever cameras we can find in protest to this bullying
HAHAH caution you he is not a cop. His caution is not the worth the paper its written on.
I would fucking sue him and his company and have criminal procedings brought for assault and impersonating a police officer and damagng your equipemnt, maybe some human rights violations also. If you want the MD of the companies home address send me a tell I would write to him direct
The guy on the right should have his licence on display. There are penalties for working without displaying your licence. The guy on the left claims he works for the police. Is he a police officer/pcso or police staff? He works in conjunction with the police, not for them. There is no problem with taking still images or moving images (Filming) in a public place. It is not an offence, unless it's private land. He has no need to caution you as you have committed no offences.
I know I could sue the one who said I was being detained and then tried to smash my camera. He actually said "I will break it" you can hear it on the video. When I told them they had no right to hold me, one of them said if I tried to go I would be taken to the ground and restrained . If I was younger I would have tried.but I have enough aches and pains already. I think they now realise that what they did was wrong, I hope they see the video and can learn from their mistake.
Security Guard had NO LEGAL RIGHT to: ASSAULT you: DETAIN YOU; WRONGFULLY ARREST YOU; ILLEGALLY IMPRISON YOU [NOT allowing you to go where you wanted to go on the High Street!]; to HARASS YOU (Protection from Harassment Act 1997) , Perpetrate Threatening Behaviour + Public Order Act 1986 crim offence of HARASSMENT, ALARM, DISTRESS (sec 5 POA 1986) + they committed Breach of the Peace in a Public Place. [In theory you had every right to defend yourself under CLA 1967 section 3 to arrest them!].
In theory you could sue the employers of the Security Guards get DAMAGES (compo) in CIVIL LAW - in NEGLIGENCE (i.e. TORT LAW - i.e. CIVIL WRONGS) [Duty of Care to act as REASONABLE Security Guard would be expected to work - not go around High Street acting as Callous Cowboys - Reckless disregard of LAW - Breach of Duty of Care - Employee Security Guards NOT being trained peoperly or at all...] for the many breaches of LAW they perpetrated against you + you have evidence from your video cam.
Go to LEGAL ADVICE CENTRE or LAW CENTRE or Citizen's Advice Bureau (CAB) [but only if they have a Solicitor who is prepeared to see you!]
You could always go to a Solicitor in the High Street & ask if they do "NO WIN - NO FEE".
If they had damaged your camera or done damage or perpetrated Defamation or did something to affect your Reputation in front of someone else then it is worth thinking of doing something.
You can always just go in to see Solicitor with ALL evidence + Police REPORT OK
If this man detained you against your will you could sue him under common law. They are talking a load of old bollocks and are trying to intimidate you because they think they have powers that they do not have. Technically he is guilty of assualt and possibly criminal damage if the camera was damaged and you have recorded the evidence so you could sue him if you wished. You can film anywhere in a public place whenever you wish.
First and foremost these security guards are not policemen they are private employees of a company and have no authority over you whatsoever. so even if it was unlawful to film in a public place which it is not, they could do nothing about it anyway. You do not need permission and there is no terrorism law in existence, only a terrorism act which is not law unless you consent to it. Also how can a private worker caution or detain you? he is not a policeman! Tbc.....
@FunkeeDrewster You do not need to be a police officer to issue a caution to someone. Anybody can do it. You have to issue a caution when there is evidence that an offence has been committed and grounds for arrest/detention are apparent. This is to let the offending person know what their rights are. TV Licensing officer can caution, revenue protection officers can caution. It's just the way our legal system works in england.
@MustaffaCuppa I do not believe that I have written anywhere in my comments about any offences being committed by anybody. In one comment I was explaining about who can give a caution etc and in the other I was saying and I quote "It is not an offence, unless it's private land. He has no need to caution you as you have committed no offences". So I haven't said any offences have taken place.
I listened to a few seconds of these jokers and started laughing. These ignorant fools just make it up as they go along. This kind of behaviour is causing people to enter into Lawful Rebellion. I agree with kondor1001. These guys need to be subjected to mass filming. Get their faces on youtube from every angle. Are we asked before a security camera catches our image? Of course not, that's because it isn't illegal you silly little blueshirts.
Hahahahaha, don't fuck with my home slice.

United Kingdom
Legal restrictions on
photography:
In general under the law of the United Kingdom one cannot
prevent photography of private property from a public place.
Two public locations in the UK, Trafalgar Square and Parliament Square have a specific provision against photography for
commercial purposes without permission.
Print that out and shove it that twats face

@wanderingbillyboy what did these two frumps say after the police said it was your right to film?

@wanderingbillyboy my take is folks with an idiot mindset don't make very receptive learners.

It's just the way our legal system works in england.
thomasjmahoney 5 months ago
@thomasjmahoney Exactly what offence do you think was committed here? None that I can see.
As for TV licensing, that is just a corporation & nothing whatsoever to do with the laws of the land...

Personally I think we should all turn up outside there in a months time or so and peacefully film as much as we want.
