Prison is a bit ott. Sure he stole alot of money but prision should be for voilent and harmful people. If a court found he has the ability to get a sustanable job he should have to give 99% of the money he has back and pay tax on 90% of everything he earns for the rest of his life.

The point is if he is likely to do it again. I don't know the case but the guy can't do this again, everyone knows he's a con man. I never said anything about people that rob liquor stores.
prison is for violent people. IF he is found able to respect the court he should keep his freedom. I think the same for a drug addicted thief.

nah, there is the aspect of deterrence and precedent, is bush and cheney likely to do again what they did? they wont have the opportunity, does that mean he should go unpunished? if you ask if madoff would do it again given the opportunity -(and bush and cheney) - most definitly! they dont show any remorse
and its especially true for the finance sector where its all about calculating risk, if all you have to expect is giving back the money there is no reason to not try the gamble

Negative "what if'" shouldn't enter judgement. Judges shouldn't have doubt against the defendant when convicting people.
You do have a point about deterrance. I'll think about this. Precedent does change over time. All laws and rules change at some point.

I get the feeling Madoff-with-your-money is FALLING on a sword here. My understanding is that he's already 75 - it's not like he's expecting to live that much longer anyway. Further, it is my understanding only about a billion of the 50 billion (possibly more) he swindled has been tracked down.
I agree with others here - watch the wife and kids very closely. This reeks of a truly huge rip off. Staying tuned.
