the truth is, the laws, the law enforcers, and the lawmakers are often as vile as the persons who are sent to prison. If we could have good fair judges, we could get rid of mandatory sentences- but you can't trust law enforcement (from cop- to judge) much more than the criminal can be trusted to do what's right. Thus we have legislature usurping authority of judge and police officer and jail officer. USA is a foul vile place, because it is full of americans.
Under O'nammy , Holder does not prosecute negroes. This is a good video , it should be distributed around where these thugs play bakketbaw. The sentence is justified , no matter how much these folks whine. It was his 4th felony! In many states , your 3rd felony could get you life. The solution? Don't break the law. DUH
Just another nigger having graduated to federal 'Nigger U' from his lesser career education at 'Juvi'. I suggest a length of rope to hang this nigger and make him good.
Don't make the mistake of thinking every crime someone is caught for are necessarily the only ones they've committed. It's not an acceptable risk if you get busted every time.
@SirrSnowman The song at the end is called Sentences by 4Peace the guys that comment throughout the video specifically by Twice Thou who comments during Terrells re-arrest and escort from county to federal lock-up.
if you;ve got priors and still not on the straight and narrow and continue to perpetrate crimes, then you should be sentensed to a bigger sentence commesurate to the cromes you've commited before and the crimes you stand accused of now.
In short your priors should weigh in on your sentence.
He was so gangsta, talking all that rah rah shit instead of taking care of home, and then he's standing in front of the judge crying like a bitch! He was in jail saying that a year was nothing which goes to show you that he had no problem doing crimes if he thought that he wasn't getting hard time. Guys like him are all over the streets, maybe after 15 years in jail he'll learn to bite his tounge and take care of home and stop commiting crimes!
I THINK YOU ALL NEED TO COME DOWN OFF YOUR HIGH HORSE THE MANDATORY SENTENCING IS A BUNCH OF SHIT. I HAVE A SON DOING 12 YEARS FOR POSESSION OF DRUGS AND THE BEST YEARS OF HIS LIFE ARE GONE THE FEDERAL SYSTEM SUCKS AND NOT WELL.
@ourtortsystem hmm...i dont know if its just "niggers" that say it. i've seen a video clip where a white woman said something simliar but even more dramatically.
This Video was a collaboration between the Department of Justice, and "4peace" recording artists, helping to raise awareness in communities where too many youth are given these mandatory sentences. I apologize for my ignorance about the law. Apparently, my advisers on the project, The federal lawyers, prosecutors and judges who play themselves in both court room scenes, either neglected to bring this up, or weren't aware of this precedent.
@miguelkingone1 Well, I liked your video anyway, and I think it's a good thing to raise awareness about these federal sentencing guidelines. I think it usually is the case that these guidelines are applied without considering aggravating or mitigating circumstances, considering how the prosecutors and judges don't seem to understand how they aren't always binding. I think the young man portrayed in the video would have a chance on appeal to get the sentence reduced; just a chance, however.
I can't help but respond to this too. Prosecutors and Judges, especially those at the federal level, are meticulous in their consideration of the application of law and the sentencing guidelines. To suggest anything else, in particular, to suggest that they don't consider aggravating or mitigating circumstances is not only blatantly false, it's irresponsible.
First of all, the statue in question in this video is the Armed Career Criminal Act, with can be found at 18 U.S.C. section 924(c). A statue is a law, and the law is always binding on the Court. The United States Sentencing Guidelines, which are not status, and are different than laws, were, at one point, binding on the Court, and now are considered advisory, in part because of case law, including the Blakely case. Edub664, you should investigate further before commenting.
@miguelkingone1 maybe if these youth, mainly negros wouldnt commit these crimes repeatedly, then stiffer sentences wouldnt be needed. If they are constantly given a free pass thanks to political correctness and the interference of the NAACP then they will never work honestly for a living. This is just another attempt by the bleeding hearts who care more about the criminal than about the victims
@miguelkingone1 The statue in question is the 1984 Sentencing Reform Act, and there has been no new legislation regarding mandatory sentencing since then.
How can you direct a video about something you haven't even researched? Did you even know about Blakely v. Washington before I posted my comment?
Mandatory sentencing guidelines don't always have the binding force of law, contrary to what the video suggests
Blakely v. Washington (2004)
The Guidelines permit departures from the prescribed sentencing range in cases in which the judge “finds that there exists an aggravating or mitigating circumstance of a kind, or to a degree, not adequately taken into consideration by the Sentencing Commission in formulating the guidelines that should result in a sentence different from that described.”
This Video was a collaboration between the Department of Justice, and "4peace" recording artists, helping to raise awareness in communities where too many youth are given these mandatory sentences.
Regardless of the tears ...here 1 felony can get you locked up for 20 plus depends on what it is tho..Nice vid tho teach the young ones you fuck up thats the life you get
damn jest for haveing a gun on him and his past when he was young he gets 15years thats fucked up it wasent like he tryed to kill someone they could have jest gave him a year in county
15 years in prison is a slap on the wrist when all he did was commit THREE FELONIES prior to this crime. It should be killed so it won't be loose on the streets again.
you must live in england like me... people get fuck all for crimes lol... some guy murdered a little girl my sister was friends with.. he only got 14 years cos he has a disorder... 14 years is shit disorder or not
no im dead serious... he has ADHD so he got 14 years for murder.. it's fucked up... in america he would've probably got north of 50 years for that... but englands so weak they just hand out shit little sentences... 2 guys in my city a few years ago killed a little girl in a driveby and only got 40 years
cos if your talking to me search for "Nottingham, England - goose fair murder.. that'll come up with the drive by" and search for "rosie-may murder" that'll come up... trust me i dont chat shit about this serious shit :|
First mistake here is to not fire the attorney. She is a public defender. She will do nothing to help him. She will try to NOT cost the government too much money. He needs to fire her right off. But wait till he is in court to fire her. I warned them in advance and they dropped the charged each time. It's better to NOT warn them and then fire them in front of the judge. That way they can't maneuver and play games off the record. Then you get a REAL attorney who is private.
The reason to fire the public defender is because they are under the supervision of the DA. They follow the orders of the DA. It's just the same as having the DA as your attorney. Conflict of interest. Huge Conflict. I once got a public defender on my side and demanded she promise to perform certain defenses and do research on my case and she agreed. She began the work I asked for and the next week they promoted her to DA office in another county. They completely cut my contact with her.
So they returned my case to the original shmuck who had tried to sell me down the river and I told him he was fired before I got to court. The next day in court they dismissed the case before I could open my mouth. I really wanted to go to trial because I could prove not only my innocense but I could prove there was no cause for arrest and the charges for my arrest had originated hundreds of miles away in another county. So I didn't get to expose a conspiracy.
So when I had originally made my intentions clear they had gone all pale and nervous and gotten real quiet and played nice. After the case was tossed out they tried to make me pay for the trial. I countered that there was no financial agreement between me and the public defenders office. It was my understanding that since I was unemployed I owned nothing. I tried to fight it but they managed to keep that out of court also. Then they made new rules.
They forced new defendants to sign an agreement to pay for "services" and if they would not sign then they would not have thier case heard and they would be charged with FTA even though they were clearly in the courtroom. Then they would lose thier OR status and end up back in jail. It was enough to intimidate ALL the defendents. After three times of the DA trying to charge me for non crimes that I didn't even commit they finally left me alone. I guess I was a tough sell for the Prison Planet.
so summery: Tyrell screwed up on a bunch of levels. First he shouldn't of been so careless. He was listening to his buddies and risked his freedom. But the mistakes after that just played into the system. And you notice his federal public defender did not file an appeal? She could of by why not? Because she is not his defender. She is a tool of the federal government. He should of waited until he was in court and fired her right then and there and asked for a private attorney. Be careful guys.
LOL. The right to bear arms? Here lies the problem: Folks are never taught that there are consequences to their actions. Life is about choices. The brother just made the wrong choice. HOWEVER, GOOD MOVIE!
This was very well done!!! You should be proud of yourselves, not only for doing such a great job, but for showing the reality that a criminal life brings, as well as the suprises that come with it, even when you think you have it all figured out.
It is not true that you can get someone arrested simply by telling the cops that you saw them selling or buying drugs. Making the case for a drug arrest requires more than the word of a SNITCH, especially for a federal case. That's because SNITCHES try to save their own asses and is offered a deal for someone higher up on the drug chain. Again don't blame the cops and the system for the choices that others make. They doing their jobs just like the drug users and the drug sellers. LIVE WITH IT
The only reason he didn't go already is because the STATE don't count his JUVENILE drug charge and the FEDS do. If you are one of the people who are going to break the law, TRY learning the law first. Going to jail is all about OPTIONS and CHOICES some people make good ones some people makes bad ones. The big difference is some people blame everyone for their CHOICES except themselves. To say that the Penal system is the NEW slavery, is a lie because one has a CHOICE not to go. LIVE WITH IT
If you get caught with any amount of drugs for your 3rd offense, it's a MANDATORY 15 years. This guy got caught with a joint and a weapon for his 4th drug related offense. DRUG + WEAPON = 15 years MANDATORY FEDERAL TIME. When he got his 1st offense, he was told what would happen if he got a 2nd or 3rd. Stop blaming his conviction on everyone but him. It's not the cops, judge, prosecutor or his lawyer's fault. IT'S HIS FAULT. It's NOT the system It's the choice that the SUSPECT made.
Penal system is the new and improved slavery, where everybody can take part. Unfortunately the rap music industry end entertainment has made doing time a great thing, okay.... maybe they should tell these kids running around these days that the only love you get in jail it bathroom back shots from Bubba love and they're not always voluntary.
do you know i can get anyone arrested simply by telling a fucking cop i saw them buy or sell a joint? prisons are filled with people who were never caught with anything, but some S.O.B. snitched to save their own ass. and the damn cops force us to tell on each other. prisoners should form a union and get even with every goddamned snitch that talked to a damn cop. ten fucking years for smoking a joint is stupid. the people who wrote this law are the very people who stsrted the drug revalution.
and this is only the beginning. half of us will be prisoners, the other half will be prison guards. to many years because len bias died after taking cocaine. i hope tip o'neal is burning in hell for this.
dont fuck with that fed shit the federal system is a lot stricter and harsher than the state. This guy might have gotten just a couple of years in state, but now its off to the BOP.
In this case, the state court would likely dismiss their charges once he was arrested by U.S. Marshals and arraigned on federal charges. Both Courts have jurisdiction, but in this case the federal charge carries a much greater penalty.
I'm not familiar with U.S. law but from what I have gathered when a Federal Judge passes a sentence it must be carried out (i.e. no parole). So if this were real the guy WOULD serve 15 years as opposed to getting paroled in 7.5 to 10 years.
Shit. I don't think having two legal systems (State and Federal) is the way forward. Just have State ones, that way every state can have its own rules and I guess, to an extent, if you dislike the rules in your own state you could move to another one.
Then again the RICO statutes brought down the Mafia so they must have SOME benefit.
yo, i did my time in the feds and I had to take the crime to a bitch ass nigga from DC. but now. I live in Canada and fuck the feds. the police dont even fuck with me here. I am so free its not even funny. but of course, I am now in univeristy trying to get mine. I am aiming for a masters in psychology. one love and this is for all my brothers in the system. get educated.
damn looking at this I'm glad I have no friends that can get my ass in trouble like they did him and I'm glad I don't do nothing to get me in trouble in the first place but I still learned alot from this though butt hpe it got others
I'm confused. Could someone with U.S. legal knowledge please clarify.
So in this scenario would be tried and sentenced by a Federal and a State court and receive two consecutive sentences? Or does a Federal warrant for his arrest take precedence over a State one?
It is very sad that only after learning about the "MANDATORY Minimum Sentence of 15 YEARS" does the young man realize the severity of his situation and is apologetic. I pray and hope that any young or old person viewing this video would be deterred from committing a crime that would lead to a lengthy jail term by understanding that they will be losing time that could never be returned once lost .
I'm a black man from south london, i do voluntary work with black male prisoners in America, the ones who will NEVER EVER be realesed, I'm talking about 19, 20 years old serving 120 years at Colorados Super Max, the truth is, black guys need to start behaving themselves a bit better.
But did you know this is all about to change. The UK is currently building 3 "Titan" type prisons, similar to Pelican Bay. Once these prisons are built, penal and judicail reform WILL result in UK so called "bad guys" being locked up for the rest of they're lives...you'll see it man!
the truth is, the laws, the law enforcers, and the lawmakers are often as vile as the persons who are sent to prison. If we could have good fair judges, we could get rid of mandatory sentences- but you can't trust law enforcement (from cop- to judge) much more than the criminal can be trusted to do what's right. The big difference is some people blame everyone for their CHOICES except themselves. To say that the Penal system is the NEW slavery, is a lie because one has a CHOICE not to go. LIVE WITH IT
sputnic13 3 years ago

Unfortunately the rap music industry end entertainment has made doing time a great thing, okay.... maybe they should tell these kids running around these days that the only love you get in jail it bathroom back shots from Bubba love and they're not always voluntary.
fireknight187 3 years ago
do you know i can get anyone arrested simply by telling a fucking cop i saw them buy or sell a joint? prisons are filled with people who were never caught with anything, but some S.O.B. snitched to save their own ass. and the damn cops force us to tell on each other. prisoners should form a union and get even with every goddamned snitch that talked to a damn cop. ten fucking years for smoking a joint is stupid. the people who wrote this law are the very people who stsrted the drug revalution.

and this is only the beginning. half of us will be prisoners, the other half will be prison guards. to many years because len bias died after taking cocaine. i hope tip o'neal is burning in hell for this.

dont fuck with that fed shit the federal system is a lot stricter and harsher than the state. This guy might have gotten just a couple of years in state, but now its off to the BOP.

LMAO @ Warrant for my arrest, Im already arrested hahaha
CALICOISKILLINTV 3 years ago
In this case, the state court would likely dismiss their charges once he was arrested by U.S. Marshals and arraigned on federal charges. Both Courts have jurisdiction, but in this case the federal charge carries a much greater penalty.
smithrock74 3 years ago
I'm not familiar with U.S. law but from what I have gathered when a Federal Judge passes a sentence it must be carried out (i.e. no parole). So if this were real the guy WOULD serve 15 years as opposed to getting paroled in 7.5 to 10 years.

Shit. I don't think having two legal systems (State and Federal) is the way forward. Just have State ones, that way every state can have its own rules and I guess, to an extent, if you dislike the rules in your own state you could move to another one.
Then again the RICO statutes brought down the Mafia so they must have SOME benefit.

that guy that comes out and talks to the camera looks like he belongs in prison...
lol, later he says "I've only been arrested 3 times"

A fair punishment that fits the crime is justice.Stealing a car stereo, three times,is not worthy of life in jail.
I was talking about justice.
You are clearly not concerned about justice at all.You are just a racist and you want to lock this person up because hes -not white-.
What if other white people wanted to lock you up on your same "values". Because we might expect you to commit a"hate"crime?
Sort of like: "I am white, but I dont like racist. Lets just lock em up just in case..."
Lobos222 3 years ago
of course ur right in ur opinion...
but when dealing with facts
if stealing 3 25cent gum packets 3 different times will land u in jail and u kno that, u deserve to get time
As far as the stereo.. hopefulyl they kno wat theyre doin.. cuz wen a person u robbed catches up to u their punishment is worse than the law....
and last but not least ,the cops wont solve ur problem and the system fucks up ur life
thats a fact

I'm confused. Could someone with U.S. legal knowledge please clarify.
So in this scenario would be tried and sentenced by a Federal and a State court and receive two consecutive sentences? Or does a Federal warrant for his arrest take precedence over a State one?
whiteworldreturns2 3 years ago
he is a bad actor , and the rap is really crappy, hahahaha and it looks like only arrested 3 times is not a good defense SUCKER.

I'm a black man from south london, i do voluntary work with black male prisoners in America, the ones who will NEVER EVER be realesed, I'm talking about 19, 20 years old serving 120 years at Colorados Super Max, the truth is, black guys need to start behaving themselves a bit better.

your'e right. i am a uk man living in the US. UK guys don't know how fortunate they are and still insist of doing foolishness
skamania1964 4 years ago
But did you know this is all about to change. The UK is currently building 3 "Titan" type prisons, similar to Pelican Bay. Once these prisons are built, penal and judicail reform WILL result in UK so called "bad guys" being locked up for the rest of they're lives...you'll see it man!
