after cursing at the officer he can be charged with verbal assault, being this drunk, sleeping in your car is the best choice if you're not taking a cab
@aluckyshot guess it depends where, cause in my town, the cops will leave you alone, as long as your keys are in the glove box, and you're sitting in the back. You've separated the keys from your person, and by law, a car can be considered a place of residence.
I don't understand why anyone would defend this guy, freeman or not. He was clearly intoxicated. Would you still defend him had the officer let him go and he ended up killing someone while speeding? He's obviously just a young punk trying to get one over the officer. Had he been polite about it, things probably would have gone better for him. But he deserves every fine and charge he gets for being a douche.
As one man once said, "If the job comes with a uniform, then it just isn't worth it."
Remember, you came here free, your life is yours and you are free to do as you wish. It's others that try to make you enslaved to them. Don't let them. This is your life, not theirs. They have cowered under the blanket of illusion. That doesn't mean you have to too! This is your life. Don't sell yourself down the river for convenience.
For 'Christians', "Live every day as if it were YOUR last.", said Jesus.

Common law is one thing but this drunkard has got a mouth like a sewer and I hope he got locked up and jailed before he kills somebody. Nice work officer. PS, psychodrilla what a hypocrite talking about "god-given" rights when you're nothing but a foul-mouthed sinner.
i dont know the laws of canada, but in the USA if u get out of your car and lock the doors. then the police take your keys and unlock your car for a search. that is a search without a warrant all evidance is inadmisable in any court. then the law suit is sure to come. in my case i've become a little over $200000.00 ritcher, and our town is less one peace officer.
This man admitted he ingested alcohol. He is speaking like a drunk. His voice is slurred. He is refusing a breathalyzer test. He is not aware of the law. The officer doesn't need consent to search him because he is under arrest.
I know people hate cops, but this officer was very polite and patient, and this man was rude and breaking various laws.
What the guy in the car failed to realize is that all states obtain the right to govern the people regardless of right or wrong via the simple fact that the state will back up its actions with force, personally I think the guy was a dick and the constable acted with a measured restraint, 800 years ago under the protection of Magna Carta 1215 he would have been hung from a jib
This RCMP COP obviously has no regard for COMMON LAW.
Unlawful arrest - Corpus delicti - "body of crime" - jurisprudence - a crime must be proven, before a person can be convicted, of committing the crime.
Unlawful entry into personal property (the traveler's conveyance) and, seizure of said personal property - no proof provided of a legally obtained "search warrant".
COP is ACTING as a moving COURT - JUDGE and JURY - passing SENTENCE for a CRIME - yet to be UNPROVEN.
he is under arrest and claims he knows the law, but under common law anyone under arrest is subject to search by police, yet he constantly refuses to be touched by the officer
@SLomer239 yes, that PERSON is subject to a search (meaning his body and clothing), NOT his personal property and means of transportation. What you just said would mean that the police have lawful consent to search the arrestee's home without a warrant.
what....the....what....wuhh....I wouldnt consider myself a sheep, pretty anti-authority, anti-religion etc. etc. But that cop performed his job admirably thats all I have to say- Honestly that cop makes me super proud to live in this country, so many places where buddy wouldve just got the beat down, got the pepper spray. buddies cruising more than 20 over, booze on his breathe. He has rights- wheres my right to not get run over by a drunk speeding loser?
@GoldenIllusions the guy is sitting in the cop car with cuffs on and the cop still never read him his rights...that why i would realy like to know the out come of this
Why the hell would he allow him to handcuff him and get in that criminals car. He just put himself in his jurisdiction & under his control, that's what that asshole tax revenue collecting agent wanted. NEVER COMPLY with these animals they know no respect for the common law & know no bounds. They are wreckless & behave above the law which they are bound to. "I smell pot in his car" which the cop will conveniently plant as false evidence for conviction. Goes through his car without consent. WTF
The officer handled this professionally and by the book. The accused just rambled some bullshit thinking he knew the law. He was placed under arrest for a failure to provide, which he was notified of immediately and repetitively. This is a textbook and LAWFUL arrest. Driving is a privilege in Canada; you can't just drive impaired and speed, and then not provide a sample when an officer suspects you to be impaired. The accused needs to study his law books a bit more in depth.
so what was the outcome for this gentleman? was he able to make similar arguements further on the process successfully? cause you know this wasn't the end...
This guy giving the whole movment a bad name. He seems intoxicated and makes an ass of him self. Most of the cops are educated by the same schools that educated all of us. So we need to reeducate them as well as the rest of the sheeple to the truth. And this video is a very good example of the way NOT to do it.
That's the problem with a non lawful governing corporation, no matter how good the Police Officer was or how bad the Sovereign was, there was no claim against the sovereign and sadley, the governing corporation has no lawful standing. The poor officer is in danger of a serious crime of treason against the sovereign, That's the reality of a government owned by a bank and not by the sovereign trust. The fault is with the Governing Corporation because it has no standing with the sovereign trust.
hmmm. I with the freeman society. however. it seems that if you go looking for trouble you will find it. 40 mph over the speed is asking for trouble. best to not drink and do the speed limit.
this guy was pulled over for speeding (breach of peace by behaving dangerously) and suspected of driving impaired (also a breach of the peace for being dangerous) he also admitted he was drinking in the previous vid...if this guy had simply taken the breathalyzer he would have saved himself a world of hurting...he appears to be quite intoxicated though so he probably would have been arrested for dui anyways. Still would have saved himself having to go through all that he just did though.
@psychodrilla so a person can get himself completely wasted and drive home, but as long as he doesnt kill anybody he has done no wrong? Then there would be no need at all to stop and pull over drunk drivers, or speeders at all, they would only get punished after they killed or hurt somebody. This guy never killed anybody but the potential was there, and this officer did his job to get him off the roads so that he never had the chance to.
Well yeah, just like you can own a gun until you shoot someone, own a pencil until you use them to stab someone in the eye. own bleach untill you poison someone. Why pull someone over for traveling at a speed they feel fine? its up to you if you want to be reckless and its on you if you cause damage or loss. so be responcible or pay costs. otherwise if no dmg no claimont no fee to pay, its all about money
@ewar9 I can see what you are getting at, but I believe this to be different...driving impaired (as the man admitted to have been drinking) would be more like taking your gun and firing it randomly at a crowd of people...as long as you dont hit anybody then no harm done right? Its a simple fact (or at the very least common knowledge) that a person should not drink and drive. Why risk it?
ok i believe the law should stop to warn, and maybe detain, but to arrest when no crime is commited is just wrong. facts dont cover should and shouldnt thats opinion ^^ its your opinion you shouldnt drink and drive cos its a fact alcohol slows responce, however its also fact its middle of night and only about 2 cars pass him, so whats three to react to? I agree dont put ppl at risks you dont want to be put in. but legal vs lawful has become huge aruement :0 anywayss cya x
@psychodrilla Section. 255 (5) of the Canadian Criminal Code: Everyone commits an offence who, without reasonable excuse, fails or refuses to comply with the demand of a breathalizer sample. he was in breach of the criminal code simply for refusing....FACT.
@Superballa17 Codes apply to public servants, not sovereigns. If this is criminal, there must be an aggrieved party. You're spreading mendacious propaganda. FACT.
@psychodrilla Unfortunately you automatically accepted joinder to Admirality law by surrender a government drivers license, and hence Identifying yourself as THAT legal fiction. Hence, claiming Common Law jurisdiction is then an invalid defense. You are immediately guilty of all charge under Admirality Law. If you had have used ONLY your given name as your true ID (which it is) withOUT surrendering any form of government ID .. you would have had a GOOD shot. Sorry.
@thefiatfreezone A proper and valid NOUI/COR and fee schedule also help .. BIG TIME! There are unfortunately very few humans that comprehend the actual nature of jurisdiction and law (which are simple), that's why there are so many here bitching at you. Besides, if you did it correctly and it worked .. they'd all scream louder in jealously.
@psychodrilla He was pulled over for speeding and the officer smelt alcohol. That is reasonoabe probable grounds to request a breath test. The man refused so he was going to be charged with it an that is in the officers right to do so. This man was insane and was obiously on something else. Guarantee you he lost in court.
@psychodrilla Hahahah at 8:40 you can here him start to wigg out about the cop about to find the stash HAHAHAHAH. Good job officer keep up the good work.
@ORIANA250 would you, in all good conscious let your best friend drive himself home if he was as clearly intoxicated as this man is? This officer did the public a service by removing a potential threat from the road.
@bossman519 I find it unbelievable just how many people are actually defending a drunk driver! there doesnt need to be a citizen complaint to bust a guy for DUI.
Driving impaired INARGUABLY makes you dangerous and a threat to everybody on the road with you, including yourself. If anything that guy should be thanking that cop. He just might have saved his life.
If your friend just pounded back a pitcher of beer and a few tequila shots, would you get in a car with him at the wheel?
@theruley your missing the POINT he wasnt pulled over for being drunk and how do we know he wouldnt pass a breath test???That cop was enforcing bylaws and statutes not LAW!! That private citizen may of been drunk but what he was saying was the LAW and that public servant was breaking the LAW.The Highway traffic act is for trustees not private citizens and thats also the LAW
@bossman519 Cops are trained to know a drunk driver when they see one...lets put that aside though. He openly admitted that he had been drinking, so the cop wanted to see if he was in fact too drunk to drive. Given that he refused to take a breathalyzer, along with his demeanor, I doubt that he would have blown anything below .08.
And speeding nearly goes hand in hand with impaired driving. Its amazing the difference 10 kph can make to the behavior of a car. We need speeding laws.
@bossman519 No matter how much you inform these herds of sheep about ACTS, BYLAWS or STATUTES, they'll never get it through their ignorant facade that Cops breach the LAW everyday by enforcing STATUTES, ACTS etc. 98% of society have conformed to these "rules" because they have been EASILY deceived. I'm a post-med surgery intern, so my colleagues are fairly intelligent and NONE of them have a clue what the diff is between the forementioned bylaws or acts. LET HE WHO BE DECEIVED, BE DECEIVED.
This is the coolest cop I have ever seen... very calm, understanding, and respectful! With that being said, the "freeman" is fucking awesome too.... hilarious!! Great video, all the way around!! I wish it was like that here in America..
at 0:13 once again constable smith has violated David Michell's right again as it states in the Charter of Rights and Freedoms "10. Everyone has the right on arrest or detention to a)to be informed promptly of the reasons therefor b)to retain and instruct counsel without delay and to be informed of that right; and to have the validity of the detention determined by way of habeas corpus and to be
What constable smith did right there at 8:17 is against the Charter of Rights, Sec. 8. "Everyone has the right to be secure against unreasonable search or seizure".The conveyance was locked constable smith unlocked it and unreasonably searched it.FAIL
what a hero !! hats off to this young man shame we didn't all demand out rights with these fascist feckers your time is ticking you revenue collectors mafia shit heads
"No Freeman shall be taken or imprisoned, or be disseised of his Freehold, or Liberties, or free Customs, or be outlawed, or exiled, or any other wise destroyed; nor will We not pass upon him, nor condemn him, but by lawful judgment of his Peers, or by the Law of the Land."
Law of the Land says you must supply a breath test if requested. This case is stupid and takes away from people who have genuinely suffered police abuse of power.
"The Criminal Law Amendment Act, 1968-69 made it a per se offence to drive with a blood alcohol content (BAC) in excess of 80 mg/100 ml of blood. Refusal of a police officer's demand to provide a breath sample was made an offence at the same time and both began as summary conviction offences, with a mandatory minimum $50 fine."
@psychodrilla maritime law, "deals with matters including marine commerce, marine navigation, shipping, sailors, and the transportation of passengers and goods by sea. Admiralty law also covers many commercial activities, although land based or occurring wholly on land, that are maritime in character."
@psychodrilla I fail to see what the definition of "driver" has to do with it, as the law makes no reference to a driver, instead makes reverence to the act of driving. The law is very clear:
"A police officer who has reasonable grounds to believe that an individual is or has been driving or *attempting to drive a motor vehicle* while under the influence of alcohol..."
Your right of travel is not the same as the right to operate a motor vehicle.
@brainflakes ok so you are saying you do not have to be a DRIVER to be in the ACT of DRIVING ...........
ok
then go on to use legalese "A police OFFICER who has reasonable grounds to believe that an INDIVIDUAL is or has been DRIVING or *attempting to DRIVE A MOTOR VEHICLE* while under the influence of alcohol..."
without actually know the definitions of the capitalised words in legalese
that is exactly why you fail to see why the definitions of the words are so important
@psychodrilla The legal definition of driving is "exercising control over a motor vehicle", which clearly covers what he was doing whether he meets the Blacks definition of "Driver" or not. Also I haven't been able to find the full text of the Canadian law but in the UK the equivalent it states it is an offence to be "in charge of a motor vehicle", not just "driving" one.
Also the Blacks definition of individual is "a single person" -> person: "a human being", which would seem to apply to him.

I agree, a lot of the world is backwoods and it is run by corporate villains who want to rob us of all our rights. This police man is a servant of that system and is paid to enforce it. If you don't respect that system or your indifferent then a policeman represents an oppressor who wants you to conform. The guy is obviously passionate about his rights and freedoms and that is commendable but you cant just drive around at any speed you want after a couple of drinks. Serve and "Protect"
@radicalgeetee He is not the law he is meant to be there to uphold the Law and not act as if he is above the law, because no one is above the Law. That includes Politicians, Judges and the Police and the Bankers. These policy officers are themselves hoodwinked by the nefarious powers that be, and wrongly believe that statutes are Laws, when they are in fact rules. The point being without the consent of the people there can be no good governance, which is why we have so much corruption.
@radicalgeetee he is NOT the law, he is acting as an agent of revenue under the authority of corporate legislation, not law. He has failed in his required procedures every step of the way. The man becomes irate only after the officer conducts his duties in fraud.
Ultimately we see the ONE power they have which is violence. The man clearly does not abandon the property, does not consent to waiving his rights, does not consent to stand under corporate authority or corporate rights.
and btw... what the fuck was in the end ??? a second officer comes to the situation to tell the obviously NON police officer and make clear that this guy in the back goes nowhere ? see how stupid thease fucking scumbags are ? they through them unto us to bash up us first and THEN asking questions.. like i said... the fashism is everywhere in the world now!
if a police officer cant read your rights... that MUST tell you, that the goverment is telling YOU that you have NO RIGHT and that even the police officer can do want he want ! Welcome to Nazi America or should i better say.. welcome to the 3rd reich !
@TheFlashlance The 'Gulliver Syndrome', a massive body of many millions held down by a few weak threads which people imagine are far too strong to break.
Sure the guy was an ass (not even like that matters, nor does the drinking) hole but 119 KMH ain't that fast and that self righteous pig never once kept his sworn oath. That is how corruption starts, with a lie that one is doing right. And yes, the guy was a jerk but never hurt anyone. Live free or die.
@TheFlashlance The cops get you one of two ways. 1. by giving you a ticket that you will eventually pay. 2. by creating a conflict and arresting you for resisting arrest or disturbing the peace. This guy created the conflict. He walked right into it.
@TheFlashlance If you are in the u.s., then yes, they can put you all in prison. In the camps they've erected all over the u.s. In Canada they will soon be able to put us all in prison once harper has erected the 9 billion dollars worth of prisons he says he's going to build. When asked why they needs 9 billion for prisons they said "to prosecute unreported crimes" You can bet they have plans to put us all in prison, and soon.
I know about the FEMA camps, but once again, you shouldn't have let them be built as a nation. Once again, the inaction of people has caused the problem. My point.
@TheFlashlance They don't know they are an illusion. If you know their language you can play them at their own game. You can call names all you want. I won't play your game which is what you want. You had better understand statutory law because as long as they are around they will try to use it against you. Protest all you want, when they start their tribunals, which are in the works, that's all she wrote.
@TheFlashlance That guy was going to court to either protest a ticket or for resisting arrest. Are you telling me he handled that correctly? The cop's got a gun and a tazer. If you beat them in court they are less likely to come after you a second time. They have all this stuff in their computers in the vehicles. They'll stop people whom they know will readily accept a ticket. This guy is more likely to get stopped again and arrested again. Know the law so you don't need "their" lawyers.
@TheFlashlance If you want to defend yourself then your first defense is to "know the common law". I know the law and have studied for a few years now. I've been to court and did well. If you don't play ball in their court and don't know the rules, you lose. Would you want to get arrested with him? He wouldn't let you get a word in either. I doubt you know how to defend yourself. Responsibility is key! If you don't know that, you don't deserve freedom. Nobody likes being called an ahole.
this is what's wrong with the whole freeman movement. There are always idiots like this that provoke hateful behavior. They don't understand that you have to have respect, not for the uniform but treat the cop like a human being and maybe he'll act like one. I don't see where the cop treated him badly but he couldn't say two words without swearing or calling the cop an ahole. What do you expect? OPPOSITION! Ask questions and site the law. This kid is not free, and will never be free. Idiot
@phospheneca Rob menard was not far off when he said that being a freeman comes with responsibility. He meant that you could not use it as a license to do whatever you want. He meant that if you act irradically and without respect for others you would destroy the whole concept. Freedom means accountability to yourself and others. It does not mean lawlessness. Herein lies the whole of the law, Love the Lord thy God with all your heart and your neighbor as yourself. How can you err?

@ewar9 I can see what you are getting at, but I believe this to be different...driving impaired (as the man admitted to have been drinking) would be more like taking your gun and firing it randomly at a crowd of people...as long as you dont hit anybody then no harm done right? Its a simple fact (or at the very least common knowledge) that a person should not drink and drive. Why risk it?
theruley 6 months ago
@theruley
ok i believe the law should stop to warn, and maybe detain, but to arrest when no crime is commited is just wrong. facts dont cover should and shouldnt thats opinion ^^ its your opinion you shouldnt drink and drive cos its a fact alcohol slows responce, however its also fact its middle of night and only about 2 cars pass him, so whats three to react to? I agree dont put ppl at risks you dont want to be put in. but legal vs lawful has become huge aruement :0 anywayss cya x

Sorry.

bossman519 2 months ago
@bossman519 I find it unbelievable just how many people are actually defending a drunk driver! there doesnt need to be a citizen complaint to bust a guy for DUI.
Driving impaired INARGUABLY makes you dangerous and a threat to everybody on the road with you, including yourself. If anything that guy should be thanking that cop. He just might have saved his life.
If your friend just pounded back a pitcher of beer and a few tequila shots, would you get in a car with him at the wheel?
theruley 2 months ago
@theruley your missing the POINT he wasnt pulled over for being drunk and how do we know he wouldnt pass a breath test???That cop was enforcing bylaws and statutes not LAW!! That private citizen may of been drunk but what he was saying was the LAW and that public servant was breaking the LAW.The Highway traffic act is for trustees not private citizens and thats also the LAW
bossman519 2 months ago 3
@bossman519 Cops are trained to know a drunk driver when they see one...lets put that aside though. He openly admitted that he had been drinking, so the cop wanted to see if he was in fact too drunk to drive. Given that he refused to take a breathalyzer, along with his demeanor, I doubt that he would have blown anything below .08.
And speeding nearly goes hand in hand with impaired driving. Its amazing the difference 10 kph can make to the behavior of a car. We need speeding laws.
theruley 2 months ago
@bossman519 No matter how much you inform these herds of sheep about ACTS, BYLAWS or STATUTES, they'll never get it through their ignorant facade that Cops breach the LAW everyday by enforcing STATUTES, ACTS etc. 98% of society have conformed to these "rules" because they have been EASILY deceived. I'm a post-med surgery intern, so my colleagues are fairly intelligent and NONE of them have a clue what the diff is between the forementioned bylaws or acts. LET HE WHO BE DECEIVED, BE DECEIVED.

@theruley case law in Canadian law has proven that speeding alone DOES NOT constitute dangerous driving. So you're wrong there.

at 0:13 once again constable smith has violated David Michell's right again as it states in the Charter of Rights and Freedoms "10. Everyone has the right on arrest or detention to a)to be informed promptly of the reasons therefor b)to retain and instruct counsel without delay and to be informed of that right; and to have the validity of the detention determined by way of habeas corpus and to be
released if the detention is not lawful.

Law of the Land says you must supply a breath test if requested. This case is stupid and takes away from people who have genuinely suffered police abuse of power.

@psychodrilla maritime law, "deals with matters including marine commerce, marine navigation, shipping, sailors, and the transportation of passengers and goods by sea. Admiralty law also covers many commercial activities, although land based or occurring wholly on land, that are maritime in character."
I don't see how this applies in this case.
brainflakes 9 months ago
@brainflakes look up the definition of DRIVER in BLACKS LAW DICTIONARY
it comes under commercial activities
but this man was not DRIVING
he was traveling in his PRIVATE CONVEYANCE on land totally different to DRIVING on PUBLIC roads which is commercial like haulage, taxis etc
ask yourself do i drive or do i travel
learn the language of LEGALESE
IGNORANCE OF LEGALESE is no excuse
peace
psychodrilla 9 months ago
@psychodrilla I fail to see what the definition of "driver" has to do with it, as the law makes no reference to a driver, instead makes reverence to the act of driving. The law is very clear:
"A police officer who has reasonable grounds to believe that an individual is or has been driving or *attempting to drive a motor vehicle* while under the influence of alcohol..."
Your right of travel is not the same as the right to operate a motor vehicle.
brainflakes 9 months ago
@brainflakes ok so you are saying you do not have to be a DRIVER to be in the ACT of DRIVING ...........
ok
then go on to use legalese "A police OFFICER who has reasonable grounds to believe that an INDIVIDUAL is or has been DRIVING or *attempting to DRIVE A MOTOR VEHICLE* while under the influence of alcohol..."
without actually know the definitions of the capitalised words in legalese
that is exactly why you fail to see why the definitions of the words are so important

'
psychodrilla 9 months ago

The point being without the consent of the people there can be no good governance, which is why we have so much corruption.
whitenightf3 1 year ago 2
@radicalgeetee he is NOT the law, he is acting as an agent of revenue under the authority of corporate legislation, not law. He has failed in his required procedures every step of the way. The man becomes irate only after the officer conducts his duties in fraud.
Ultimately we see the ONE power they have which is violence. The man clearly does not abandon the property, does not consent to waiving his rights, does not consent to stand under corporate authority or corporate rights.

My point.
TheFlashlance 1 year ago
@TheFlashlance They don't know they are an illusion. If you know their language you can play them at their own game. You can call names all you want. I won't play your game which is what you want. You had better understand statutory law because as long as they are around they will try to use it against you. Protest all you want, when they start their tribunals, which are in the works, that's all she wrote.
artsychic2000 1 year ago
