It's real simple. The officer definately had circumstantial evidence enough to believe that a forced entry did occur. That allowed him to have probable cause to enter the dwelling WITHOUT a warrent. Till the suspect, (yes a suspect), identifies themself the officer did have reason initiate further investigation and had to demand, legally, that he comply with the officer's request (to step out of a building where the officer would have had to have passed blind spots). As a soon to be police officer its standard procedure to ask for ID in ANY SITUATION! Just so you can ID the person and know who they are and if they do indeed live where they say they do. Instead of getting pissy all Gates had to do was step outside give the officer his ID and then explain the situation and everything would have been fine.

Now since Im a justice major and a soon to be officer lets ask YOU a question. What do you do in that situation sir? Ill tell you what youre supposed to do, and what the officers did exactly right. You show up to a scene, try and find the people matching the description youve recieved. Attempt to identify them, attempt to ascertain why they are there and make sure everything is ok. Possibly ask neighbors if and what they saw and ascertain if the person you just talked to indeed lives there.
Now when you arrive on scene of a fucking possible break in you dont know whos there, how many people might be breaking in and most important of them all YOU DONT FUCKING KNOW IF THEY ARE ARMED OR NOT! I assume youve been pulled over before. What do you do when you get pulled over? Give the officer your ID explain the situation and stay calm. And guess what, most of the time they come back, give you your ID back and possibly a ticket and your on your way with no confrontation and no problems. You dont wig out on the cop and start yelling and shit. What happens when you get out of your car and start walking toward the cop car? You might get arrested cause its something you just dont do
First of all, being pulled over in your car while in public and being interrogated by an officer in your own home are two completely different scenarios. Demanding the officers badge number and name is not being disorderly especially when you are in your own home! And he did give the officer his ID providing evidence that he did live at the address in question. At that point the officer had no business being there and he should have left. He arrested the guy b/c he was mad he was being "pissy"
How you justify arresting a man after he has shown you evidence he is not breaking into the home is beyond me. He and you are grasping at straws. I'm not saying the guy is a racist. I think he was angry that Gates demanded his badge number and name and may have acted arrogantly toward him. But the arrest is absurd.

1) He said that the witness told him that she saw two black men with backpacks enter the house. She said NO such thing. In fact, this is supported by audio evidence where she says that she doesn't know the race of the men and states that they MIGHT be the residents because she saw suitcases. Lie number ONE.
2) Crowley sid that gates was yelling incredibly loud. This is NOT supported by the audio from his communications and the fact that he had previously contracted BRONCHITIS!
Yes, you "CAN" ask for a name and badge number at anytime. But you really dont want to do it whey you are a primary suspect of a break in. And you really dont want to do it right when the officer first gets there. Generally if you are indeed innocent you generally want to prove that fact and not start ranting and raving about shit, and demanding a badge number. Now why is it that when this shit happens to white people nothing happens but blacks play the race card?
Now, I can tell you exactly what happend here. Gates got back from his "lengthy" trip from China, as he put it. He probably had some delays, or other hiccups in his return trip. He got home, probably tired as hell, and when he tried opening his door and found that it was jammed. That probably got him pissed off on top of already being tired. Now if that wasnt enough, now a cop shows up on a suspected break in and, already pissed and tired, Gates looses it and flips out on the cop.
Continuing on.... After Gates flips out on the cop and he gets cuffed he decides to turn the blame off himself and turns the whole thing into a race issue. I guarantee after he got cuffed Gates realized he overreacted and realized that, whoa, this whole thing has become real now. Now you cant blame him for being tired and pissy from a trip, but flipping out on a cop because of it, then realizing that you fucked up so you turn the whole problem into a race issue to cover your fuck up is wrong.
Crowley got upset at Gates. Falsely arrested him. Lied in his report. Then, right before the beer summit, the shit hits the fan as evidence emerges that reveals Crowley lied his ass off. Crowley comes back from the Beer summit talking about moving forward.
My guess is that he ILLEGALLY ARRESTED GATES because he was upset, wanted to show he had the bigger dick and thought he could just steamroll Gates and NONE of this mess would get into the news or be investigated. I bet he apologized in DC

It's real simple. The officer definately had circumstantial evidence enough to believe that a forced entry did occur. That allowed him to have probable cause to enter the dwelling WITHOUT a warrent. Till the suspect, (yes a suspect), identifies themself the officer did have reason initiate further investigation and had to demand, legally, that he comply with the officer's request (to step out of a building where the officer would have had to have passed blind spots). Gates wanted trouble.

So, when Gates insisted on insulting the Cop, the Cop says, "Cool, Ill be on the porch if you want to talk to me". On campus, Gates is a known as an arrogant asshole with a racial chip on his shoulder. Did the situation warrant his arrest? Unlikely. Did Prof. Gates' ego and attitude clash with the cops, escalating the situation? Likely.
Gates went head-to-head with a cop. Cops can be pretty big assholes, so Gates goes to jail. I had a very similar situation happen to me- but it was white guy vs white cop, with the same treatment. Don't give cops shit. It's just reality.

Well, I wasnt there however I think if I was that cop and called to a house responding to a report of a break in by someone and when I got there someone matching the description given was there I wouldnt let him go back inside the house until I KNEW, he wasnt up to something. I certainly wouldnt let him walk away from me and go into a kitchen as there all sorts of sharp pointy objects in kitchens. Still, once he knew there was nothing amiss leaving after a polite explanation should have done.

I just took a sociology class and we were talking about the difference between black people's lives and white's lives and black man said when/if he gets pulled over it's common knowledge for a black man to put his hands up on the steering wheel so the police man doesn't think they have a gun. Two other black guys in the class nodded.
There is no doubt that black people have a more difficult life than whites in the US.

The proper way to have handled this situation would have been, "Sir, will you please have a seat while we look through your house, we have had a report of an breaking and entering violation at this address". They should have then verified the owner and employment history of Dr. Gates and proceeded from there.

Gates forgot a few things here. He forgot to mention the fact that he yelled "I'll talk to your momma outside." He also acts like he never yelled during the whole ordeal. But during the 911 recording you can clearly hear Gates yelling. He's picking and choosing what makes him look good and not where he made mistakes. Both individuals made mistakes but I would have expected a Harvard proffessor to act a little more civil.

See now this is bullshit. Especially since they released the 911 tapes and there was no mention of skin color for the identification of the "suspects". As a soon to be police officer its standard procedure to ask for ID in ANY SITUATION! Just so you can ID the person and know who they are and if they do indeed live where they say they do. Instead of getting pissy all Gates had to do was step outside give the officer his ID and then explain the situation and everything would have been fine.

Now since Im a justice major and a soon to be officer lets ask YOU a question. What do you do in that situation sir? Ill tell you what youre supposed to do, and what the officers did exactly right. You show up to a scene, try and find the people matching the description youve recieved. Attempt to identify them, attempt to ascertain why they are there and make sure everything is ok. Possibly ask neighbors if and what they saw and ascertain if the person you just talked to indeed lives there.

I assume youve been pulled over before. What do you do when you get pulled over? Give the officer your ID explain the situation and stay calm. And guess what, most of the time they come back, give you your ID back and possibly a ticket and your on your way with no confrontation and no problems. You dont wig out on the cop and start yelling and shit. What happens when you get out of your car and start walking toward the cop car? You might get arrested cause its something you just dont do

First of all, being pulled over in your car while in public and being interrogated by an officer in your own home are two completely different scenarios. Demanding the officers badge number and name is not being disorderly especially when you are in your own home! And he did give the officer his ID providing evidence that he did live at the address in question. At that point the officer had no business being there and he should have left. He arrested the guy b/c he was mad he was being "pissy"

1) He said that the witness told him that she saw two black men with backpacks enter the house. She said NO such thing. In fact, this is supported by audio evidence where she says that she doesn't know the race of the men and states that they MIGHT be the residents because she saw suitcases. Lie number ONE.
2) Crowley sid that gates was yelling incredibly loud. This is NOT supported by the audio from his communications and the fact that he had previously contracted BRONCHITIS!

Now, I can tell you exactly what happend here. Gates got back from his "lengthy" trip from China, as he put it. He probably had some delays, or other hiccups in his return trip. He got home, probably tired as hell, and when he tried opening his door and found that it was jammed. That probably got him pissed off on top of already being tired. Now if that wasnt enough, now a cop shows up on a suspected break in and, already pissed and tired, Gates looses it and flips out on the cop.
