@tconst17 Doesn't work that way. If you suddenly create an obstruction where you are supposed to leave right of way, you are at fault. The one that hits you may *also* be found at fault. But if it' sat a place where they have right of way... the chances of that are very very slim.

Most common is the turning driver not checking for both oncoming traffic and pedestrians. So he thinks he can cut accross... and only *then* notices the pedestrians and slams the brakes. *CRUNCH*

@lets69more no, you are wrong. it is HIS obligation to stop BEFORE he is in the lane of through traffic. he should have kept his eyes on his path. the pedestrians have the right of way, he should have stopped before entering the through lane. if he did not see the pedestrians and stopped in the through lane because of his negligence it is HIS fault. he WAS in the process of turning, dude. he was sitting across the lane, that is in the middle of turning. he was obstructing traffic. his fault.

The judge should of put more attention on that, asking the litigants if there were tire marks on pavement, how long were they, and if the defendant did slammed brakes. It looked like a straight road, if she wasnt riding that fast maybe the accident could be avoided.

@otirudam When making a left hand turn, you must yield to oncoming traffic. It doesn't matter if they were doing 100 in a 25 mph zone! He is at fault. In NJ, There are many places where it is illegal to make left turns because of the traffic.

@wolfwing1 Well if they were crossing from where he said they were...it sounds like they had the walk signal. I agree, pedestrians make it hard but you have to stop at crosswalks (In NJ you must stop at a crosswalk if pedestrians are there).
