  • That officer if full of it. In order to pull you over, you would have had to commit an infraction or a crime. I wouldn't even have stepped out of the car until he told me which law or infraction I broke. Hopefully you filed a formal complaint since he stepped all over your rights.

First, you need to understand the difference between rights and privileges. To exercise a right, one does not need permission. Do you have a right to travel? If so, why do you need a permission, granted through a license, to travel in a car? By asking for a license one seeks government approval to travel in a car.

Now, it is my understanding that the license is only necessary for those who are operating in a government capacity. The reason for this is because statutes, acts, codes, regulations, and bylaws do not apply to people. The term sovereign or freeman man come to mind.

  • there was no reason for the cop to think there was any paperwork problem with this driver or the car he was in. in addition, he's trying to use ambers law to justify the initial contact. this is obviously an illegal stop

  • @mfrank165 with the current reading of the law, a law enforcement officer can stop any vehicle and ask for the paperwork. there are hundreds of reason they can stop a vehicle including needing to check the paperwork.

    for them to DETAIN you, its another matter.

  • or if you are free to go. at that point, the officer needs, to cite you, arrest you (ask for what reason), or let you go. they cannot detain you once you reveal that you want to leave. if you continue to talk to the officer, you are consenting to the detainment.

  • the most successful way to deal with police during a traffic stop is to show your identification as required, but do not open your door. if you are asked to get out of the vehicle, exit the vehicle and close the door behind you and state that you do not consent to a search. (do not consent to a search if you own a used vehicle or have any high value items like laptops because they are not liable to any damages during a consented search). when you're out the vehicle, ask if you are being detained

  • the contractual consent is given at the time of passage into law. you can always schedule an appointment with a lawyer to discuss these matters, but your personal interpretation of legal terms may not always be the one that's understood by the law of the land at the present time.

  • @finditherefirst i'm sorry but that's current implementation of the law. you can challenge the constitutionality of the act but until then, you are required to show identification to the officer if you are the operator of a vehicle. no amount of logic can replace the established judicial process, least of all replace the practical need to enforce and regulate your use of a deadly weapon, the car, in the most real, literal, and common sense.

  • the cop is not wrong, there's an exception for any individual in a vehicle, that they are required to show identification when requested. cops are not required to read the act when requested. it is not a right to ask to be educated as a citizen of a law or any corollaries. it is the duty and responsibility or each citizen to know the law and responsibility they are under.

  • Any 'Act' invoked by the Police , in fact any legislation, requires contractual CONSENT. That is the issue....not any bullshit regarding what a person is. The fact should of been that he was not operating under The Highway ACT....as he was conducting his lawful business in a private conveyance, of which, may I assume he had total equity. The Officer confirmed this by not writing a ticket with regard to the alleged infraction. He may of stated he was not compelled to perform under duress.

I Beat the charges on my own as a Pro Se litigant and now I'm suing in federal court for the violation of my civil and human right. if you think I'm lying here is the case # Civ 7919. This is not Nazi Germany and I don't have to Identify my self just cause you say so, their must be probable cause for any officer to have any authority to demand anything.
