Check the Australian governments gazette of the ATO's supposed lawful creation. You won't find anything about it. Check all referendums in Australia as per s128 of the Aust 1901 Constitution - Australian's were never given their right to vote on the ATO.
No one should be above the law, but section 29B Subsection 6 sounds a lot like something Nazis would come up with and enforce. Seems like you should be free to say you are being investigated or summoned, whatever the charges may be, even if they are murder or racketeering. It sounds like some agency doesn't want bad press.
