Thank you for the well made video mecakoto. I too have come to the same conclusion as you have after reading about fair use, and your video has helped confirmed my interpretations.

Fair Use (and other laws) are intentionally vague so that the court or state can interpret them as they see fit. This can be a problem because there are those who deform the law through their power and money, use it to steal away rights, and deface the morality that countless people fought and died for.

Don't worry, you can tell by the recent rise of Disturbed vids that they were pompous bastards and overstepped their boundries in claiming your videos copyright. SO, those previous copyrights that you have attained were unfounded and cannot be held against you if you challenge them.

Well, Canada has a site that explains it. To play it safe, Google the Copyright laws for Canada and go from there.

The safest thing to do is make an alternate Youtube account and test it with only the Audio. If it gets blocked then it won't work. If it doesn't then it is most likely safe.

See like on Wednesday i uploaded a video with the song "miss me kiss me by cold flames" and i have the song on itunes i bought that song and they say i did a copyright so i had to take it out just to upload the song again. I don't see how i can upload a video and have a song that is not copyright i don't know how to get permission to use the song.

I think what he meant is that a video is fair use if it's intended to promote discussion on that video, meaning that very few videos on YouTube are completely separate from that particular flavor of fair use defense.

Well, just look up Australia Copyright laws and go from there. I'm not sure if they are diffrent (and how different they are, if the former case is proven true) from US Copyright laws. Sorry, but that is all the advice I can offer. =(

Tell them that they are ruining youtube by disabling all videos with their content in it. The point of putting music on youtube is so that you can listen to it and then BUY it. The only people WMG is hurting here is YouTube, because people are deleting their accounts (after all, what's the point of posting videos if you can't show them to anybody?) They may not realize it now, but eventually they will have to stop.

I'm sorry that I have to break it to you but your first point of the non-profit view is wrong.

Fair use must FIRST be determined if the material for criticism, comment, news reporting, teaching, scholarship, or research purposes THEN those 4 points come into play.

And it says Non-profit EDUCATIONAL purposes. this means that you are allowed to use copyrighted material for say submitting a school assignment, this doesn't cover online distribution.

Like I said in the video, I am not a lawyer and it is just my interpretation of "Fair use."

Also, "educational purposes" is a broad statement left open to interpretation and manipulation. The possibilities are endless if you are creative.

If the US Copyright law was more direct and exact, then the aforementioned wouldn't happen, but alas, that is not the case.

One last thing: the main reason I even made this video is to help people fight WMG and there recent abuse of power.
