I'm sorry, but this instance was not brutality. he repeatedly warned her of the consequence of resisting arrest, and she even baited the officer. Yes, he could have forcibly handcuffed her, but that woulda been more likely to cause her injury than deploying the taser. it seems bad, but I think the taser was a safer option than forcing her bodily to the ground.

They are a "less lethal weapon" - which says it all... LESS lethal, not NON lethal.
Tasers kill and everyone issued with one knows that.
To use them against someone merely non-compliant (as opposed to an outright threat), especially against an elderly person (who should be assumed to have health problems which could make a tasing potentially lethal) is outright assault.

the problem here is that a taser should only be used in a situation where a gun used to be needed or to protect the safety of an officer while attempting to subdue a combative subject. A miserable old cunt fits none of those criteria. What he should have done after she refused to sign the ticket is hand it over anyway - the ticket is still valid regardless. He got her out of the car. He shoved her. He was trying to arrest her. Being an asshole is not illegal - yet. Fuck this cop. I hope he dies.

The old lady stepped up and she was warned. She got what she deserved. Unfortunately, procedures vary in different states. In my state its verbal, then chemical (pepper spray) then mechanical (physical force). The cop can't grab her because she can sue him and lose. It looks like they have to taze first. She should know better at her age. Old folks shouldn't drive anyway. Stay home!

I think both parties are at fault here, no matter what police policy may be. Old lady should've just signed her ticket from the getgo and dealt with it in court rather than making a scene.Cop definitely could have handled an old lady without tasing her - what if she had heart problems and died? There is no arrest report. It is not listed in police reports as an arrest. It is not legally an arrest. You are not read your Miranda rights because you don't have them because you aren't arrested. You are not "either under arrest or not". The law is more complicated than your simplistic explanation.
