The Military Commisions Act applies to US citizens and HAS been applied to US citizens. US citizens CAN be declared enemy combatants. That's what they don't tell you. The only authority declaring them enemy combatants (e.g. as members of an enemy force) is the president and secretary of defense. From there on in no appeal to a court (only lawless military commissions), no Geneva convention, no protection from torture (since torture isn't defined) and possible death sentences.
McBush flat out lies about Geneva conventions. The MCA explicitly excludes applicability of the Geneva conventions. It doesn't forbid torture but confessions made under torture may not be used. But torture isn't even defined anywhere. That's why they had all these discussions about waterboarding and how it's not torture (it is according to Geneva conventions). The Supreme Court did the right thing. The Bush/Cheney MCA RAPED the Constitution and human rights.
