I think the judge had to be objective and she didnt have much to work with. I think part of the problem was that her lawyer did not get third party evidence to say the child had been abused. Her lawyer should have suggested that the child see a psychologist or making a police report. At least get the child to speak to a police officer. This would at least have something for the judge to work with.

This Judge should have to answer to all the children whose lives she has destroyed. Just recently in another Judges court my 14 year old son cried and begged that Judge to let him come home with me after he had ran away several times from the abusive dad. My son was forced to go with the dad and is now drugged up on depression meds to deal with his life instead of living with me. Its so frustrating. And I have to keep working just to pay attorneys fees on both sides because of Elliott.

The Judge showed clear bias in my case, as well. Because of this my 2 young children haven't stepped foot in my home in 4 years. I work in the early education field and care for other peoples children daily, I raised my 2 older children through graduation of high school and have a 9 month old baby at home with me. While my abusive ex and his felon girlfriend (at the time) got custody of my 2 younger children.  I see my children 6 hours a month, now and my family doesn't get to see them.

There is no way to get to the truth, everyone tells their version of the truth. Family courts are by grossly incompete, they don't abide by due process, they don't make other abide by it or do they even know what it is . We need go back to basic law, due process, not just pretend, rules of evidence, if you make a claim, you have to prove it and pass and enforce joint physical/legal custody, that alone will stop alot of the fighting. my info comes from the US dept of health and human services (childwelfare dot gov). here a just a couple of quotes from their site: "More than one-quarter (26.6 percent) of these fatalities were perpetrated by the mother acting alone...mothers' boyfriends are most often the perpetrators in abuse deaths; mothers are more often at fault in neglect fatalities."

@knowthingman I studied domestic violence and found that most acts of violence are commited by MEN; and surprisingly, cases of women abusing other women are increasing. There are no TRUE statistics, however, as most DV goes unreported. I don't agree that mothers abuse more than men. In my experience, the men are the ones who exceed women in such matters. I worked with children for 18 years, and out of countless parents, only one woman neglected her children. The rest were men.

i would say your experience is the exception, and im not suprised. in the course of my employment in social services, i saw custodial parents that were women not even investigated for events which, when they occured regarding a father, generally resulted in loss of even visitation. one woman decided to take a trip to mexico for the weekend with her bf and leave her 3 yr old in the care of her 8 yr old. there were no consequences. there is a bias in favor of women in the system.

If you are smart you will at least check all this out for yourself before you make any comments or replies of any type. Try referencing words like "bench", "capitis diminutio", etc. in the law industry standard law dictionaries such as but not limited to Bouvier's Law Dictionary, Black's Law, Ballentine's Law, Stroud's Dictionary of Jurisprudence, etc. And then reference the meanings of the Latin words in Latin/English dictionaries.
