I think Stine needs to think a bit more about what the differences between humans and other animals are. If rights can only be recognized in living things that know they're alive and know they will die, as he said, then babies have no rights - we're not sure to what degree infants are aware of their own existence, but it almost certainly isn't as complete as an adult's self awareness. Further, babies almost certainly aren't aware of their own mortality.

@thurstonite I don't think Stine wants to deny babies the right to, well, have rights, so he needs to refine his definition. Further, the issue with dolphins isn't just their intelligence - it's the fact that we have strong evidence to suggest that they are self-aware to some extent. The same goes for elephants, chimpanzees and other great apes. Chimps also seem to show signs of mourning, as do elephants. Even if their understanding of death isn't like ours, it seems to be there to some degree.

@thurstonite I'm not trying to say that these animals are thus equal to humans, only that the issue of animal rights is more complicated than many people recognize, Stine included in this case. It's good that he realizes that animals shouldn't be tortured - but if he denies that they have rights, how can he say they have the right to not be tortured? Ultimately, he's a comedian, so this routine is very much about the laughs rather than the details of his theory - and he certainly is funny.

It's an interesting subject but I think it's impossible to prove whether or not animals are self aware. A robot and a sleepwalking human can respond to stimuli but neither are self aware as far as I know. Animals are an interesting case because they have very realistic responses to pain and the smell of food etc i.e. if you stand on a dog's tail or foot it will yelp urgently as if it actually felt the pain, yet a robot could be designed to move away from areas where it is subject to damage.
