Yes. Even the BBC has to pay for the Daleks. Terry Nation I believe owns the rights to his Dalek creations, who I believe pre-date Doctor Who and have even had their own movies without The Doctor.

The Daleks don't predate Doctor Who, although there have been spinoffs (comics, novels, etc.) which featured the Daleks outside Doctor Who stories. I'm not aware of any movies -- the two "Dalek" movies I know of both have Peter Cushing playing the Doctor (sort of).

But yes, Terry Nation owns the rights to them, which is refreshing to see when you consider how many other famous characters were created by writers who don't receive any money or even credit.

1) Same canon isn't equal to same series. To say, for example, Star wars: KoToR and the original trilogy are in the same series is about as equal to First series doctor who and revival doctor who. It's also equal to, say, breathing out of your mouth underwater.
