Look it was an all white justice that allowed racial restrictions in the U.S. to go on as long as it did. Later African American Justice Thurgood Marshall was successful at getting some things for civil rights particularly in education passed.

Also the famous Dred Scott decision in which the supreme court ruled 7-2 that no person of african ancestry could claim citizenship in the U.S. and therefore Dred could not become free but remain a slave. Maybe EMPATHY is what the court needs.

The supreme court ruled in favor of Lochner which changed and created new standard health laws in the work place and decent work hours. So i agree the bench does not make legislation but does change laws. Just look at these cases outcomes and see for yourselves at the cases i mentioned and how they changed the laws drastically to how they were before.
