I ask myself the same question! There are the videos and the pictures of celebrities used in his show..and he gets away with it somehow. No idea why..And then there's another girl, who sings the famous copyrighted songs. And she's a YouTube partner...Weird. Cuz when I read the rules, it said, that using any music, or even singing a famous song without music in your video is forbidden. I have no idea why they're partners and how it's possible. Let me know if you find out.
Those videos aren't copy rightered to begin with. If you post something on youtube and don't go through the legal ways to get it protected than its free game
I watched my first one of his vids just to comment here. Yes, the other commenters are correct that "fair use" includes short bits for reviews, and it also includes parodies. Also true: people with a paid staff have an easier time securing permission than high school kids.
I know that YT won't be helpful in answering your questions about how they deal with fair use, and I doubt you'll get a response from Ray, either. Youtubers don't tend to respond to requests for help from the little guys.
Jackal!!! I'm not sure about what type of permission you have to get. If you make something public and it isn't copyrighted then who knows. Elvis was famous for taking music old black blues musicians would sing on the street corner re-working it a little and then making millions off of it. So, is that the same thing? Oh yeah, and Led Zeppelin did the same thing.
Look at how many subscribers he has and how many views he gets. That's why he's allowed to use other people's videos. He should stop stealing other people's videos and making money off of them. It's not fair. Its disgusting that youtube allows him to do that just because of the amount of views he gets.
dude just go shirtless everytime look at your view counts you'll be so much more better I orignally subbed cause of your shirtless videos I dont really care to listen just hope for a shirtless vid because your so hot
I honestly don't know how they get away with it, because fair use does not apply if any money is gained from borrowed works in any manner. The only way that I can see them being able to do it legally is if they have expressed permission from the copyright holders allowing them to use the work however they want, and since they'd need it from all of those video owners, I really don't think that is very likely. I just really don't see how they get away with it.
However, if a user uses another users videos, for example RWJ uses your video, and you think he used too much, you the owner of the content can file a complaint against him, because the owner of the content determines if their content use used in accordance with fair use... be it too much content used, how the content is used, etc.
i dont know some people actually benefit from being on his channel and if he uses their videos i dont think they have a problem with that. anyway i dont like him, i dont find him funny at all and i dont think he can find a way to entertain people without using other videos on youtube.
This is the 2nd time you've asked for feedback and I just don't have a clue as how to answer :( But maybe you should address that question to youtube, just ask them what the hell. Oh, remember me telling you about the wrestler that looks so much like you that he could be your twin? Well, I finally got to meet him yesterday and he is really awesome. He is so friendly and easy to talk to. I'm really surprised but most of those guys that I have worked up the courage to talk to are like that.
If they use a video from say Paramount... a trailer perhaps, they can't profit from it... as they don't own that trailer or that title... from a copyright perspective... in order to make money from content it must fit in fair use... if not, their video is rejected from revenue sharing.
If it's for comments and criticism, etc. it's covered under US Copyright Law... specifically that of fair use, however, he can't upload a video in its entirety without permission from the owners...
I think he's the guy that has (Summer Day Sweet) banned from Utube. She has a message to him on Twitter.

The fair use exemptions to DMCA are pretty complicated. Look up "fair use" on Wikipedia.
