Good video, but at the beginning I found it a little bit confusing. When you said you "got a DMCA," you meant that you "got a DMCA takedown notice" or you "got a DMCA takedown." At the beginning, I couldn't figure out whose original material was involved (yours or someone else's) and whether you were on the receiving end of a takedown notice or a counternotification. In this case, think of DMCA as an adjective, not a noun.

@chizzlemang since the posting of this video Bear has stopped issuing DMCAs. As a result the few copies of the video have remained up and also has the spawn of more Streisand Effect mirrors. By the end of the month most of the videos should be back up and restored. He has also stopped leaving comments on videos about him and it looks like he may have finally gotten it.
The policy by which you are not allowed to open a new account puts people who made one mistake on the same level as a criminal. People can immediately lose their account without a chance to rectify their error, just for "illegally" using a single piece of music in one video. I'd prefer a system in which you get to open a new account (once), but everyone gets to see your former account name(s) and why they were terminated. Of course, this would apply only to accounts closed for policy violations.

That sadly is a violation of his copyright. In my opinion I would remove those videos. If you were to upload content making fair use analysis of his content I would support that.
I'm in the same situation with Jarrah White. He filed 21 DMCAs on me and it ONLY took YT five months to restore them. He immediately started filing again, and terminated my account. It has since been reinstated and he has now promised to flag my videos.
He keeps sounding off about going to court. I hope he does, because don't forget the fines, (or hard time), these people will get for perjury, AND the counter-suit for all OUR legal expenses.

@Astrobrant2 There is no excuse for youtube to take 5 months to restore the videos. By law it is 10-14 business days. Still YouTube/Google has better lawyers than any of us do so it would be hard to go after them.

It's one I've been wondering about for months, as YT repeatedly rejects counter-notices without forwarding them, and then once forwarded, takes several weeks to restore the material, or not restore it at all. And all the while, it is the same person filing false DMCAs over and over again and he's still going strong after over a year of this.
I'm beginning to believe YT doesn't give a crap about the victims because we can't hurt them financially.
Also, I have seen articles written several years ago which raise this same question. YT is well aware of the rampant abuse of DMCA and I really believe they don't give a damn. There is no pathway for filing a complaint about such abuse, despite the severity of these false infringement claims and the illegal vandalism of people's accounts.
I don't think they will ever do anything about it until someone manages to get them investigated for gross non-compliance with copyright law.

But I think in the interest of their customers' trust they should draw reasonable consequences from such cases. If someone can lose their account for infringing copyright, then someone should also count on losing their account if they file frivolous claims.

The law attempts to be consistent with the principle of innocent until proven guilty. That is why it is IMPERATIVE that YT handle CNs and reinstatements reliably.

IN some cases he has less than 4 days to travel to their court and file papers. My advice would be to start with them. @YoWhatUpMike well for me my expense will be to hop on the bus and light rail to go down town. His is much greater. Of course other people sent counter-notices to him last week. IN some cases he has less than 4 days to travel to their court and file papers. My advice would be to start with them. Pack that car tight because he has one hell of a road trip to go on, filing court papers all over the country.

Don't forget he also gets to pay for a process server to serve me with those papers. When you add that to the cost of doing this for each and every video, including some that had the counter notice done last week, he is running out of time

@AtheistIsland if he files enough DMCAs and they are all restored after counter-notices are completed then his channel can be put at risk. WaterWorks4U for example lost his account. Inmendham was briefly suspended for DMCA abuse but he was allowed to return.

@cohenandloynds As much as I enjoy Television Judges, they are quite different than real court rooms. A judge would need to be given an explaination from both sides. TV judges are famous for not being willing to listen to evidence and basically won't let the people testify.
