Wow. I had to go watch the real ending just to get that out of my head. Spock would indeed have been punished since Spock was bound by both Starfleet and Federation law, but it probably would have been life imprisonment.
I take that back about the death penalty being a possibility. Spock told T'Pau that he would "do neither" when she told him to "Live long and prosper", seemingly because he fully expected to be executed. It was established that General Order IV was the only death penalty in Starfleet, but in "The Ultimate Computer", the M5 believed that the penalty for murder was death. Perhaps Spock expected this to go to civilian court.
It's possible that by saying that he "would do neither" he implies his option of suicide. Even though Vulcan's moral code honours live in all it's diversity, we know that Spock might wager this option. Mind Wrath of Khan and Spock giving up his live to save the ship. Maybe one can't compare those situations but it is my personal belief that Spock is the kind of person to kill himself out of guilt and grief over the loss of a very deep companionship like the one he shares with Kirk.
I'd put suicide over grief in a different catagory than sacrificing oneself to save one's comrades, but I do see your point. I was just pointing out that the precedent for the death penalty for murder had been alluded to. In the '60's the question over execution wasn't nearly as clouded as it is today. I wouldn't call what Spock would have been guilty of "1st Degree Murder" though, more like manslaughter.

It was a very well-done video. I thought it was good; my only suggestion would be to shorten the crying scene a little (Spock saying his multiplication tables almost gives away that he's sick [btw very clever to use that scene from "Naked Time"]) Overall- good job!

But they can't all be happy endings! I wouldn't think they'd have execution by then but still, it worked for purposes of the video.
Very powerful. We were told that the death penalty is only used in the violation relating to Talos IV, but Spock got off then so he's owed a death sentence. Besides, I think Spock would prefer to be dead than to live through life without Jim. Hopefully they'll catch up in the afterlife now that they're both gone!
