@skeemloesouthside a producer may think he can sample anything, and that the artist is responsible for clearing up the sample but contrary to that thought, unless there is a clear contract that can be created and used in a court of law, the producer, NOT the artist, is responsible.

If you sell without permission, you are in violation of copyright and the artist could sue you.

I'm not saying they WILL sue you, but let's face it, I was right and it's something that could happen.
