i don't get it. so the bank called and is making you an offer to keep you in your house, and you are whining? I seriously don't get it. If you want to stay in the house, tell them to send you something in writing, take it to court. what is so difficult? It seems as if you're being insolent and giddy for no apparent reason. I get that they have foreclosed and you are in court. I get it's frustrating. What I don't get is your bizarrely flippant attitude. What am I missing?
@jwerner79 Lol. What word game are you playing in "1."? Upon what, then, was "foreclosure" based, if not a house? You gave no fact to support "2". 3. Each side has rights in court. The IDEA, at least, of court is "fairness", although I doubt it has ever been so. One can frighten public officials easily enough....SHOW UP AT HEARINGS and be knowledgeable of your rights. If you need time to prepare a case or get info or whatever, simply ask for it. If they refuse, ask "what's the hurry?".
@kenfo0 Time is in the homeowner's best interest. people will whine "your debt is mounting". so? maybe you hit the lottery, maybe a rich uncle dies...anything can happen. 1 should argue with the court that the bank is not the only party with interests, and the interests are ONLY supposed to matter in THIS 1 CASE. In this 1 case, the bank is trying to take a home and equity (life savings?) which will have terrible effects. On the other side, that 1 mortgage is spit in the ocean to the bank.....
@kenfo0 Ripping apart your ego, THE BANK did NOT file foreclosure, but rather the Condominium Association for a Condo I owned in the building; they filed foreclosure on a fraudulent lien the Board placed on the title for less than $1,000: No joke. Am I going to hire an attorney at $200 an hour to sue the Association, which is a non-profit to obtain a judgment on which I will never be able to collect??? Anyway, the bank got involved during the Condo Assn's initiated litigation. Read the docket.
@jwerner79 A condo association cannot foreclose on your property. They do not own the note. LOL. You are stupid and arrogant. You can't even explain your situation clearly or accurately, then act as if I am stupid for not reading your tiny mind. read what docket, you moron? I have no idea who you are, where you live, filing dates, etc. Go away now. I don't want to get infected with whatever you've done to yourself...

this dude just worked the shit out of this girl. If the property is in f/c she can't even ask for a payment. If this girl used her brain she would have just gone on to the next call her computer made for her. Instead she continues to follow a prompt she is given by a microchip, how sad. And that is why big banks just continue to roll over people.
they should not even be talking to this person, since they are in litigation. Only their attorney should be speaking to him only or his lawyer. this shows how inept the bank is because the reps have no idea and she obviously does not understand. When she heard litigation the call should have ended. The worse part it is insulting to talk to a credit who probably has a worse credit rating this gentleman

she is doing a job what part of that doing you get??? she has asked you if you wanted to make a payment. there is no way to see if your in court. if you can put all that money down then why cant you pay your bills. there is a reason she called you and you have not told her anything. i can understand why you were mad but if you were just going to like that then why did you not end the call when she asked if you wanted to. when you have 2 it is your 2nd.
@ctproductions11 I did not end the call because I was obtaining evidence. As for her "doing a job," shall we say the same thing about prostitutes, pimps, human traffickers, porn salesmen, and other wicked people whom are just doing a job. As for the payments, what proof do you have that she was calling to actually collect a royal payment, a payment that is allegedly due?
@ctproductions11 I may not understand this correctly but I think she was trying to get him to make a payment at the same time as they were foreclosing on him? She was just trying to extract as many payments as she could before foreclosing? She knew what she was doing because it's her job and she has done it to others before. I noticed she would not answer the most important question which was 'how much do I have to pay in order for you to stop foreclosure proceedings?'
Actually, when a property is in foreclosure, in order to make a payment on the property- you can only pay the full reinstatement figures, in which have to be ordered and take up to three days to be received. There are many calculations involved, that associate had no way of seeing how much he needed to pay.
@ColemanMeghan Thanks for the explaination. I see now why the OP was wording it that they were SEEKING a summary judgement of forclosure. Is the rest of my post correct, that even is he made the payment she was seeking to obtain from him the bank was going to keep moving forward with forclosure? It really appears as if he was getting two different stories depending upon who he talked to at the time.
@ctproductions11 I suppose Bank of America borrowing $45 billion does not matter. So this almighty job, are we going to use this excuse every time one of your friends commits a crime.
It amazes me they ask the same questions everytime..."How did you fall behind in payments?...." Isn't this logged in somewhere? Do their computers all have a 24 hour memory?? This is why I get so aggravated.I understand I owe you $ and I'm trying to work with you....but why start from step one every single day????
@JBBoy895 They're working and trying hard to hide the fact that they default on nearly all their contracts. They think they are able to appease their ABS investors and the government by acting like the ONE party, the borrower, is the one that defaulted.
Then you should not have borrowed a penny. Since you owe money then you evidently did. I'm not defending BofA, just the girl you were on the line with... In this economy she took the job she could get, she's paid to do what she does. You're giving her trouble for your downfall because you chose to do business with BofA, she didn't make their rules.

@Kristiization This is not rude; this is loving. I was very gentle with her, although freaks like you consider honest, loving behavior to be rude. Sorry.
@Kristiization Actually, Bank of America proved it cannot manage anything it does. FYI, I did not beg the federal government to let me borrower a penny.
@KarlIvIarx They were unable, even with fraud in court, to "kick" anybody out of the property because the wrong bank was suing in court.
As for the payments, my credit reports show flawless payment history on the mortgage since the purchase in 2004. Servicer was Countrywide, mortgage was in the name of MERS and some other unknown company.
@jwerner79 So you originally bought the home from Countrywide, who then sold your loan to MERS and some other unknown company. Where's the disconnect? There's only ONE title holder at any given time. If you're a victim of fraud, you should have mentioned that in your video. You led the poor girl on the phone to believe that you were just another delinquent homeowner who didn't want to work with the bank. You should have handled that phone call a little differently...
@KarlIvIarx I bought the property (Condo) from a woman (the previous owner) through a Realtor. Countrywide financed the purchase, then MERS and some other company filed the mortgage. Payments were made to Countrywide. Bank of Ameria v. Jason Werner was a mere cross-claim; they wer enot the original plaintiff.
As for the fraud, there are other calls I've posted on my channel explaining their fraud specifically to their representatives. I also filed complaints to government; they don't care.

He's pissed because they're trying to foreclose on his house (kick him out), even when he was making payments, so what's the point of continuing to pay them? This is happening to a lot of people if you pay attention, but not everyone does uploads like this to show it....what a shame.
Fucking loser. You don't DESERVE a modification! You were stupid to sign a fuckin note that you could never afford. Wah wah fuckin wah. Now you want the bank to bail your ass out. I know the girl on the phone and everyone at bank of America west hills, ca has heard this and is laughing at your stupid ass. She became a manager and you probably lost your home you stupid cunt. Tell your wife and kids that daddy is a fucking loser that can't man up and pay his bills and then go jump off of a fuckin
@bebop4onne If he gives the house back then he has paid his debt. The bank can sell the house to someone else 4 less. These banks are not innocent either, they were just too good at convincing people they could take on more debt than they could afford. I know because I looked into buying a house in the mid to late 90's and the real estate agent said I should just make up income and the bank would probably not check. I declined. I don't feel sorry at all for these banks and real estate companies.
same situation....get an attorney..to much corruption in the paper system and mers...fight these jags. F@#k Chase and all the other banks.. They make way more on foreclosing then modification. thanks to the bailout to AIG and big banks. The Gov allowed this because all there buds (big banks ) were making huge money...and now with the biggest financial heist in American history they have hedged there bets and made money on the bailouts. For the people by the people.nope. For the Gov. by big bus.
oh wow.. i hate people like you. pay your fuckin bill and if you cant... maybe you shouldnt have said u can afford the damn house in the first place. besides... she's so calm and you're BELITTLing her with all your pathetic laughs.
im very proud of how she handled your immature ass.
hahahuuhuuhaha.. ken lewis haha huhuu whats your name...
please dont try to sound smart... because u HONESTLY sound retarded when u do it.
@swtnsoursauce1o9 It's not a house; it's a condo. The payment was less than $200 a month. The lawsuit was not filed by Countrywide or Bank of America, but rather the Condominium Association in their attempt to complete the theft of the Condo unit (the officers were stealing units in the building). The caller's employer is notorious for negligence as you heard in the recording.
@swtnsoursauce1o9 Your a fucking clown. Your an America right? LOL you have your flat screen, your sports cars and your house. Once all this Dollar bullshit is done with and the economy collapses lets see how much of that shit you can afford.
oh wow.. i hate people like you. pay your fuckin bill and if you cant... maybe you shouldnt have said u can afford the damn house in the first place. besides... she's so calm and you're BELITTLing her with all your pathetic laughs.

If you'd pay your mortgage on time.. they wouldn't call you! and as far as i know it is COMPLETELY illegal to record a collections call, let alone uploading it here!! come on dude!! don't get in trouble for doing this....
@bloodsugarcrazy3 As for paying the mortgage on-time, the Bank did not file against me for not paying on-time, but rather the Condo Assn.; anyway, all parties dismissed their lawsuits: It's done. As for recording calls, it is legal in Ohio to record this way, and there is federal case law to back that up to cover most other states as well, but I am not an attorney, regardless anybody can get accused of anything - recording phone calls as a crime would be interesting.
@bloodsugarcrazy3 you are an idiot. it is not "illegal" to record a collections call. in fact, in some states you don't even have to notify the creditor that you're recording the call. lastly collection agencies record their calls and then consumers can't?! oh please. lol, such a joke.
@TheGoalSetter They want to harass because they are working with their attorneys in court to sneak certain things through. It's happening all throughout America, even after Ken Lewis.
All "jwerner79" has done with this video is make himself look like more of an idiot. Never in my life have I witnessed such stupidness and immaturity from a supposed adult who is trying to get his affairs in order. Count your blessing buddy, that rep has your name, your social, your DOB, your address, and just about any other piece of public record necessary to make your life a living hell. Instead of being angry, be grateful that rep wasn't me...
From the looks of BAC's performance year-over-year and for the past few years and the fact that America literally owns much of the company because it is too big to fail, I think BAC is the one that needs its affairs to be in order better.
@jwerner79 which explains why Bank of America paid the 45 billion dollar loan in full with interest that they were forced to take in the first place in one year, whereass you can't even make a minimum payment on a mortgage that YOU signed up for. Makes perfect sense.. I stick to my first statement, count your blessings buddy for if the rep was me you would have much bigger problems trust me..
There has been jtalk BAC paid their part of the TARP. Even if they did, guess how? They walked up to the trusty 'ole discount window and borrowed against that almighty dollar in the system, in which they claim is a reserve. As for BAC, Ken Lewis has already proven he is a liar; BAC is still hurting with their stock price, as they are unable to raise capital.
As for my litigation, it's disputed in court; this is not a payment issue, as you heard the recording; listen to others.
@jwerner79 I'm not arguing with you about Bank of America, that would be a waste of your time. The point of my comment was you acted like a dumbass in both these vids and you look more idiotic than the clearly inexperienced rep does. As a Senior Account Manager myself, who works in collections, be glad it wasn't me.
to be honest im not interested in getting personal with you, and its kinda creepy that you are. I left my two cents, take it for what its worth and move on...
But I do want to thank you for making my Sunday go by faster. I just came across all of your other videos regarding BAC/Country Wide. Unfortunately many of the vids didn't do what you had hoped, it was more comedy at your expense, but nonetheless I enjoyed it thanks.
Oh and yes Bank of America did pay the tarp back in full with interest, and no not from additional loans, from dividends received from investments. You would know that if you did research. As far as your litigation, I know nothing about it. But I highly doubt BAC would take you to court if there wasnt a payment issue..
Glad you mention that because BAC absolutely did not take me to court. They got caught in the middle of a dispute regarding my Condo, then they tried to capitalize on it. Truly, they did not take me to court: I promise.
No Bank of America did not pay back their loan. All us "customers" who taken hostage by them paid the loans with all the extortion money collected dressed as "fees".
Payments were obviously not made on time to the bank. The customer service representative stated clearly that payments have not been made for a year. That wasn't disputed in the call but rather a "justification" was offered that there were court proceedings.
I think Bank Of America goes by the theory that of course they can't please everyone, and they think it's unfare to please half the people nd not the other half, so they figure they might as well act stupid to every single person they deal with and please no one at all......shitty bank....although that girl seemed a little confused and tried to give a lot of PC answers, but that probably made her HATE her job while she was on that call.......
@derberg19486 I hope you are right and I am an American. Unfortunately for the world Bank of America wants to get you too. Make sure you leaders don't go along with it. Good luck.
This guy is not kidding. This is exactly what it is like trying to talk to them. You give them answers and they call back like you never even spoke with them. I swear, they are going to give me a heart attack before this is all over.
I worked at Ohio Savings (now AmTrust) in 2003, US Bank in 2004 (please see my other videos), Centex Home Equity (now Northstar - subprime) in 2005, and then did the "federal-chartered bank all 50 states thing," so I have some knowledge of the industry.
This guy is a pathological liar! But at least he stands up against these crooked lenders! Praise the lord!

2. The Bank and their attorney committed crimes in court.

Tell your wife and kids that daddy is a fucking loser that can't man up and pay his bills and then go jump off of a fuckin
bebop4one 1 year ago
@bebop4onne If he gives the house back then he has paid his debt. The bank can sell the house to someone else 4 less. These banks are not innocent either, they were just too good at convincing people they could take on more debt than they could afford. I know because I looked into buying a house in the mid to late 90's and the real estate agent said I should just make up income and the bank would probably not check. I declined. I don't feel sorry at all for these banks and real estate companies.

They make way more on foreclosing then modification. thanks to the bailout to AIG and big banks. The Gov allowed this because all there buds (big banks ) were making huge money...and now with the biggest financial heist in American history they have hedged there bets and made money on the bailouts. For the people by the people.nope. For the Gov. by big bus.

swtnsoursauce1o9 1 year ago
@swtnsoursauce1o9 It's not a house; it's a condo. The payment was less than $200 a month. The lawsuit was not filed by Countrywide or Bank of America, but rather the Condominium Association in their attempt to complete the theft of the Condo unit (the officers were stealing units in the building). The caller's employer is notorious for negligence as you heard in the recording.
Signed,
so annoying u had to comment

If you'd pay your mortgage on time.. they wouldn't call you! and as far as i know it is COMPLETELY illegal to record a collections call, let alone uploading it here!! come on dude!! don't get in trouble for doing this....
bloodsugarcrazy3 1 year ago
@bloodsugarcrazy3 As for paying the mortgage on-time, the Bank did not file against me for not paying on-time, but rather the Condo Assn.; anyway, all parties dismissed their lawsuits: It's done. As for recording calls, it is legal in Ohio to record this way, and there is federal case law to back that up to cover most other states as well, but I am not an attorney, regardless anybody can get accused of anything - recording phone calls as a crime would be interesting.
jwerner79 1 year ago
@bloodsugarcrazy3 you are an idiot. it is not "illegal" to record a collections call. in fact, in some states you don't even have to notify the creditor that you're recording the call. lastly collection agencies record their calls and then consumers can't?! oh please. lol, such a joke.

I was on BoA's side of this call until she started asking about how he would pay (asking family, liquidating 401K, etc.). That is over the line.
Also, I can't quite figure out what exactly she wants.

Instead of being angry, be grateful that rep wasn't me...
niceguy0608 2 years ago
From the looks of BAC's performance year-over-year and for the past few years and the fact that America literally owns much of the company because it is too big to fail, I think BAC is the one that needs its affairs to be in order better.
jwerner79 2 years ago
@jwerner79 which explains why Bank of America paid the 45 billion dollar loan in full with interest that they were forced to take in the first place in one year, whereass you can't even make a minimum payment on a mortgage that YOU signed up for. Makes perfect sense.. I stick to my first statement, count your blessings buddy for if the rep was me you would have much bigger problems trust me..
niceguy0608 2 years ago
Correction:
There has been jtalk BAC paid their part of the TARP. Even if they did, guess how? They walked up to the trusty 'ole discount window and borrowed against that almighty dollar in the system, in which they claim is a reserve. As for BAC, Ken Lewis has already proven he is a liar; BAC is still hurting with their stock price, as they are unable to raise capital.
As for my litigation, it's disputed in court; this is not a payment issue, as you heard the recording; listen to others.
jwerner79 2 years ago
@jwerner79 I'm not arguing with you about Bank of America, that would be a waste of your time. The point of my comment was you acted like a dumbass in both these vids and you look more idiotic than the clearly inexperienced rep does. As a Senior Account Manager myself, who works in collections, be glad it wasn't me.

for what company do you work?

to be honest im not interested in getting personal with you, and its kinda creepy that you are. I left my two cents, take it for what its worth and move on...
But I do want to thank you for making my Sunday go by faster. I just came across all of your other videos regarding BAC/Country Wide. Unfortunately many of the vids didn't do what you had hoped, it was more comedy at your expense, but nonetheless I enjoyed it thanks.
niceguy0608 2 years ago
@niceguy0608 shut the fuck up asshole. what the hell are you going to do to someone while you're on the phone with them? Douchebag!
tailboard 2 years ago
Oh and yes Bank of America did pay the tarp back in full with interest, and no not from additional loans, from dividends received from investments. You would know that if you did research. As far as your litigation, I know nothing about it. But I highly doubt BAC would take you to court if there wasnt a payment issue..
niceguy0608 2 years ago
Glad you mention that because BAC absolutely did not take me to court. They got caught in the middle of a dispute regarding my Condo, then they tried to capitalize on it. Truly, they did not take me to court: I promise.
jwerner79 2 years ago
@niceguy0608
No Bank of America did not pay back their loan. All us "customers" who taken hostage by them paid the loans with all the extortion money collected dressed as "fees".

The Bank is desperate, so they'll try to pull money from anywhere, even if it's fraud.
How long was Bernie Madoff convinced he was not breaking the law.
Jason
jwerner79 2 years ago
The subject property is actually a Condo.
Payments were made on-time to the bank. The bank is not the one who filed the suit against me.
Very recently, Bank of America has conceded to dimiss upon certain conditions, which is not in their power (other parties involved).
It's fraud.
jwerner79 2 years ago
Payments were obviously not made on time to the bank. The customer service representative stated clearly that payments have not been made for a year. That wasn't disputed in the call but rather a "justification" was offered that there were court proceedings.
jmichaelm0 2 years ago
Blame their BAC shareholders. They know exactly how stupid they want their employees (criminals) to act.
Thanks,
Jason
jwerner79 2 years ago
I think Bank Of America goes by the theory that of course they can't please everyone, and they think it's unfare to please half the people nd not the other half, so they figure they might as well act stupid to every single person they deal with and please no one at all......shitty bank....although that girl seemed a little confused and tried to give a lot of PC answers, but that probably made her HATE her job while she was on that call.......

I worked at Ohio Savings (now AmTrust) in 2003, US Bank in 2004 (please see my other videos), Centex Home Equity (now Northstar - subprime) in 2005, and then did the "federal-chartered bank all 50 states thing," so I have some knowledge of the industry.
Thank you. Do you have a follow up?
