A leeward boat is a leeward boat. If the overlap is eastblished from astern, luffing rights are limited to proper course, but the leeward boat decides what that proper course is. The windward boat must respond to the leeward boat and can protest after responding. How the overlap was established is unclear in this video. Although the leeward boat was originally behind, there is a time when the boats appear far apart latterally. If they seperated more than 2 boatlenghts, then it was a new overlap.
I agree that the over lap was had w/in 28 ft (2 boat lgths) It does not mean the W boat has rights like you said. W must keep clear of L(rule 11). rule 17.1 reads L (not W) does not sail above proper course. L was sailing proper course because L would have sailed it to get around the fastest in absence of other boats. 666 and david was on a broad reach going slower, L was going faster& all three were heading to the mark (very far away.this is L's proper course. L determines proper course not W.
You were overtaking boat, clearly established by your video. You had no right to take little Dave up. He was on his proper course. How you established your overlap prevented you from asserting any leeward boat rights. You owe Dave a 720.
to me it is apparent that the windward boats did not give room to #2 and both committed fouls... they were given plenty of opportunity to avoid #2 and did not do so.... Bad bad #666, took out his son....
