People who never worked hard and are usually shit at their own job tend to complain more and are more damanding than others. As far as I 'm concerned, those customers can f... themseves!

  • Continued from below: At the end of the day I just made 30 or 40 dollars an hour, have 100 to 300 dollars in my pocket and averaged 20 percent even with cheap ass tippers. Why? Because I'm damn good at what I do and I don't work in a shitty restaurant. (I don't work in fine dining either.) My job puts 18 percent on parties of 8 or more, but if I had a choice I would rather take my chances.

  • I've been a waiter for many years. I have to say if a waiter gets really upset because of lousy tippers there are three possible reasons. First, they are a bad server. Second, they work in a bad restaurant or part of town. Third, they are new to serving and are parroting more experienced servers who fall into category one or two. Do I bitch about shitty tips? Of course I do, to another waiter in the heat of the moment and then I'm over it.

They have gratuity added to larger parties because they consume more of the servers time and their ability to make more tips by having more tables.     You can not compare tax and tips. Tips are voluntary based on your satisfaction. They are expected by the servers and other staff, but they are NEVER mandatory. Tax is mandatory as indicated by federal law.

There is no law that states we have to tip in fact it is quite the opposite. State laws are different, where I'm from it is illegal to solicit tips or charge gratuity fee unless it is a large party.

    So no, it is not like paying tax as tax is required by law in most states; demanding tips is quite illegal.

  • I'm a server for the Hilton Hotel and I don't think people comprehend that we make less then half of minimum wage. Big parties are difficult to take care of especially when you have other tables. Honestly, I will always tip 15 percent no matter WHAT. If you can't afford to tip, than you can't afford to eat out.

  • I was a waiter for 4 years in college. From all of their complaints, only the refill of drinks reflects on the server. People need to distinguish the difference between a server and that of a busser, and a chef. You waited 1 hr for your food... That's more times than not the kitchens fault, not the server's. You didn't have silverware on your table... That's probably the busser's fault, not the server's. If I was their server, I'd want her and her over-weight, balding boyfriend out as ASAP.

They also have to pay the bartender and busser, even if no tip is left. By not tipping the server pays to serve you. If the company policy states that a tip is mandatory, they should be held responsible to pay it. If you cant afford a 20% tip please do the world a favor and stay at home.

    Nowhere in that accepted English definition does it say that it is required or legally binding. The restaurant have no legal leg to stand on if people don't pay. I think the cops were also in the wrong. An invoice for services is a civil matter, not criminal.

  • To everyone who doesn't tip you sir are actually stealing from the server. The server is already in the hole when you sit down to eat. There is a thing called tipshare. That is usually at least 3%. Sometimes more. So on a $100 dollar bill it costs the server $3.00 to serve you. The reason gratuity is added to six or more is because the bills are usually over $200. That would cost $6.00 to serve a group of six. Knowing that 70% of the population does not tip well at all.

  • In Malaysia, tipping is almost unheard of. Restaurant's here make good money and workers are fairly paid.

  • As a waiter myself, I don't believe people understand the TIP is our wage. I do agree bad service deserves a bad tip, I've dealt with a lot of people who don't tip just because of nothing. From literally running around for them, using my phone, etc. and not leaving me a tip is wrong. Being a waiter is much more to the eye, we're only human.

  • @milkjamjuice - That's true, but I think gratuity policies are absolute BS. I know that sometimes a staff busts ass to service a big group of people, only to be stiffed in the end. It's not right, but NO one should HAVE to pay a tip. If the service is great, then yes tip, if not, don't. I've been yelled at for this when I took my friends out, but you know what, the service was LOUSY. Over 90 minutes for 15 minute prep finger food & drinks? Don't think so. Be mad, I'm not tipping for that.

  • @BitCrasher99 a tip isn't "a little something extra" that is thrown in as a treat. you pay servers tips because you are paying for a service. you wouldn't hire a private chef to come to your house and cook for you and expect that you only have to pay for the food, you would have to pay the chef for performing a service for you as well... that is EXACTLY like a server in a restaurant. a server doesn't get paid by the restaurant (this helps keep the food prices lower). YOU pay for their service.

  • @BitCrasher99 and with your exact situation... when the food is taking a long time to get to the table, it's not necessarily the fault of the server. the kitchen could be having problems or could be backed up with orders... especially if it's busy, you should expect your food will take longer, because orders are cooked as they are recieved... not in order of what takes the shortest amount of times. if there is a bartender, the server has to wait for the bartender to prepare the drinks etc... 

  • a good server should notice when the food is taking longer than expected, and then apologize to the guest and explain why the food or drinks are taking a long time... its hard to understand how these things work if youve never worked in a restaurant, especially a very busy restaurant...

  • @milkjamjuice good point... if you don't like the gratuity policey, don't dine in that restaurant! there's no law about tipping, so if a restaurant chooses to include it on the bill, that is their perogitive. they are charging for a service, if there was a problem with the service throughout the meal, then they should have asked to speak with a manager long BEFORE the check was even brought to the the table. notice how THAT was never mentioned

All I'm saying is that the server should be notifying you if the order will take longer, keep drinks full, check in to ensure everything is good after food is delivered, and be as fast and accommodating as they can. They do that for me, I tip generously. Service is a crappy industry, and I give kudos to those who do it well. I think their wages should reflect this, tipping or no.

Servers are busy people and they can't see everything all the time. If something was wrong with their meal, they should have said something. If the problem was the server themselves, they should have spoken to management.

If you tip a server in a restuarant why not the guy that puts your order together at the car supply store, the guy that teaches your first aid course. Its a screwed up system. If you don't feel paying for service is your responsibility, just inform your server PRIOR to ordering so we can ignore you, lose your order, and rush you out so we can earn a living wage.

  • @wcresponder people who work at fast food restaurants get paid at least minimum wage. waiters get paid between 2.25 and 3.50 an hour because the restaurant assumes they will get tips. The tips are estimated, and the waiter gets taxed on them, whether you tipped or not.

  • I've always been a great tipper and not sure I have ever held back from tipping the minimum. I've always tipped over 30% and a lot of times much more than that, depends. I have never even thought of not leaving a tip but this mandatory bullshit sure makes me think that way.

  • I believe all legal work in California and some other states requires paying all workers minimum wage. I don't think tipping should happen in these states since workers already get minimum wage like workers at a fastfood place

A waitress can be paid much below the min. wage in the state, b/c it is a tip job, and that is supposed t2o make up the difference. But it doesn't unless it's a strip club. She's wrong about tipping next time, and should either get a further punitive settlement out of court from the owner, or take the owner t2o civil court big time. FIGHT THE POWER!

  • I would love to see the people who don't want to tip actually wait on some tables. Let me guess you have never served before, right? Try serving 20-100 people at a time for a period of 5 to 12 hrs. Most places have the 6 people or more Grad. because it is difficult and people are cheap. Just a reminder: I the server apologizes for there mistakes maybe you should show some understanding. BE KIND MAKES ALL THE DIFFERENCE!

  • Maybe bars should stop calling it a TIP and start calling it a service fee for legal reasons. The other option is actually have employers pay bartenders and waiters the Federal minimum wage ($7.25 per hour) instead of $2.13 per hour + tips. This will increase prices 25 to 30% and scare away people who don't tip.

  • @td84 the waiter does have to pay taxes on their tips. after every shift you are required to enter the amount in tips that you earned and it is taxed. it's not free money, you typically get a salary of 2.30 an hour and what ever you get in tips is your "real" pay. it's not sleezy for a person to demand payment for services rendered.

  • It seems that the most important thing is whether the gratuity is stated upfront on the menu. If so, it seems that given that there is a implied (or explicit) contract, the couple is required to pay up no matter what. Otherwise, I believe that it would be fair to dispute it and refuse to pay.

  • This is outrageous you Americans get stung with ridiculous tips even for poor service I was "MUGGED" at a Chinese restaurant on international drive in Florida a few years ago service was very poor tip was 25%, but why should the staff give good service if they know they are getting 25% regardless of what service they give

  • I don't agree at all with mandatory tipping. However, the idea of "good service" is entirely subjective. The bar has a policy of adding a gratuity in the form of a service charge. By not paying the service charge these kids technically commited theft of services. If they didn't like the idea of paying a mandatory gratuity, they should have chose not to dine there. What pisses me off even more is the lazy judge who dismissed this case without adequately checking legal precedents which support it.

  • @clmabry I agree. I should have chosen my words better. What I'm saying is that there is a difference between a gratuity and a service charge. It all comes down to the language. If an establishment posts that there is a service charge for any specific reason, then you as a patron are obligated to pay it for services rendered. Or you can choose to go someplace else. If they post "gratuity" instead of "service charge", you aren't obligated to pay since the definition of gratuity is voluntary gift.

  • @christianluna As a former bartender myself, I don't necessarily agree that happy hour is hell - I've had some of my best times behind the bar working happy hours with my regulars. However, I COMPLETELY agree that the sob story these two jailbirds are feeding everyone is likely laced with a hearty amount of bullshit - they're clearly the type who "received AWFUL service" simply because they had to wait for a refill. They're really quite sickening.

  • People that go to happy hour ESPECIALLY should all be required to pay an 18% gratuity because they are all cheap for showing up for happy hour in the first place. Think about it, if people show up to a restaurant only when prices are reduced how do you think their views on tipping are gonna be.

  • @christianluna Then don't work at a place that has a happy hour. You signed the work contract explaining your pay and minimum job duties, so you waived your right to complain except in the event of egregiously extenuating circumstances.

  • A tip is supposed to be just that, a gift to the waiter / waitress for doing a good job and making sure you had a pleasant stay. If they don't make you happy then they don't get a tip, end of story. If they want to be idiots and not give good service then they should change professions and get a job that doesn't pull most of its income from tips. Why tip if you aren't happy with the service?

  • @jimithejoker09 It's mandated to YOU that you'll be taxed 10% by the federal government, but it is not mandated to the customer. If tipping were mandatory, it would be law. Instead of letting the system keep you brainwashed into thinking that customers are responsible for paying your rent, why don't you blame the one responsible for paying you a livable wage....your boss? Then again, you signed the work contract acknowledging you'd be paid pittance and depend on non-required gratuities.

  • @MelkorHimself There is no law stating that a business such as a bar cannot add a fee for services rendered. Nobody forced these kids to pay a service charge because nobody forced them to choose to eat at this particular establishment. They did commit theft of services for not paying the full bill. places that charge a percentage of the bill for tips have it posted. In the same respect, if a person is unhappy working a thankless, pride swallowing job like waiting tables, they can choose to quit.

  • @jboyko3 However, if you research a case in NY where the customer refused to pay the 18% gratuity for a party of 6+ and only paid 10%, the court upheld the notion that gratuities are always voluntary. This precedent was used to drop the charges against this couple. Though a business can add these service charges, they can still be disputed since they are gratuities.

  • @MelkorHimself It depends entirely on the language used when incurring the expense. If a business loses a case like this, it's usually because of the language.

    Example: Gratuity = Voluntary. Thus cannot be forced onto the consumer.

    However the definition of a service charge is a fee in which a business imposes to cover the cost of wages, overhead, and markup. And is 100% legal for a restaurant or bar to transfer onto the consumer. A service charge doesn't go to the server. It goes to the owner

  • @DasGiggler The U.S. is broke as a nation. Restaurant owners are too cheap to pay their servers minimum wage, so the citizens are forced to make up the difference. In my opinion, it would be better if they just got minimum wage.

  • "Mandatory Gratuity" is a form of WELFARE! You don't have a choice on giving them a tip or not. Its not society's job to pay servers, its the employers job to pay them. This is so wrong on so many different levels. What motivation do servers have to make their customers happy if they are getting a "mandatory gratuity?" Second of all, society shouldn't have to make up the difference in a servers pay because the federal government is not doing their jobs.The LAW ALLOWS servers to only make $3/hour

  • @LutzfromPS2 This isn't like welfare. 1, these people work. 2, it's not like a percentage of your income is forcibly garnished by the state in order to cover the supplemental income of a person you've never met. How exactly are you being "forced" to pay a tip? Where is it written that you HAVE to dine out? I'm seeing people on here talking down to waiters, waitresses, bartenders, etc like they should be thankful for serving an ungrateful public. Sense of entitlement? Take a look in the mirror...

  • @jboyko3 Restaurants were present much longer before the federal government imposed the tip credit in the FLSA. They did it because tipped employees as a whole were dishonest on their taxes. Therefore, the government decided that, if these employees were going to withhold more tax revenue by not claiming all their tips, then there is no reason why they should earn more direct wages. Don't blame the customers for something they don't control. They come to eat the restaurant's food and that's it.

  • @MelkorHimself I apologize if I came off a little brash in my post. The point I was making was that dining out is a luxury expense. I'm not blaming customers for something they can't control. I'm pointing out the fact that they can choose to eat at home. Then they can set the table, prepare the food, and clean up the mess afterward themselves. And not worry about the added cost of having someone else do it for them. A service charge isn't a gratuity. It is the owners to do with what he pleases.
