May I suggest you contact Gordon Hall (In Arizona or California, I think) He is a man to listen to in a serious matter like this. He served 9 years in prison, but came out VERY well informed in how not fight the system, but simply avoid it and then turn it back on itself.
He has an organization with a website called "creditors in commerce". Im sure you already know more than enough in your line of work, that a light bulb will click within 5 minutes of conversation with him.
I just have to say I love the video ( watch?v=EyPvQ12SkAQ ) where he was held in contempt of court. that clearly shows his disrespect for anybody who disagrees with him. and then this video ( watch?v=tfWfHkKteks ) where he hardly holds himself accountable for his actions. when the judge asks if he regrets his actions he comes out with basically a childish "yeah, but..." story. poor Adam, hes reverting back to childhood.
@maximumfullpower He could play the sympathy for the jury angle, but if he gets a juror or two that doesn't like the idea of someone recording them, he'll lose or get a hung jury. If he goes with a bench trial, and get a judge as finder of fact, I think it will open and shut. He best shave his beard, wear a sharp suit and work on coming off as an actual journalist then a doper with a cell camera and a grudge.....
@DavidLister6000 - I agree with you all the way. I don't think he will shave his beard, wear a sharp suit and work on coming off as an actual journalist act like doper with a Cop Block supporter with either a cell camera or something and have a grudge. From the looks of these charges against him, he should get a very good lawyer then. It still does not look good for him.
@maximumfullpower No...it actually doesn't. He won't get jail time, I wouldn't think so. But I admit the notion of him having to do community service by cleaning graffiti makes me laugh.
@DavidLister6000 - Well, he has made a lot enemies with a lot of public workers all this time doing as he is so called saying holding them accountable. Now that I would like to have a front row seat of him doing community service by cleaning graffiti.
@DavidLister6000 - Would you agree if they know Ademo Freeman really messed up this time by his own fault. He was all big and bad before, but now the tables have turned. He let's his mouth and actions speak first before he thinks at all.
or possibly expose personal information, which completely violates one's right to privacy, to the world wide web. what I believe happened is that you recorded information during an ongoing investigation, something you should have realized but was to stuck-up to figure out.
hey Ademo I'm going to take a quote from your video "criminalize those who are trying to hold them accountable" your forgetting the point that your holding people accountable in a criminal fashion. notice people how Ademo has not posted the conversation of which he was accused of wiretapping. He is obviously hiding something. Remember Ademo, wiretapping is a victim-potential crimeas there is a possibility to defame someone of their character.
Remember kids, Ademo Freeman is a bullshit artist. Did he grow up to be a doctor and help sick people? Nope. Did he grow up to be a fireman and rescue people out of burning buildings? Nuhah. He grew up to be a dancer, of sorts. His profession is to dance around the law. Remember those "I'm not touching you" games you used to play with your sister? Thats how he plays with the law; always pushing its buttons. Anyway, help your country kids, unlike him. This has been a public service announcement.
@eajjoutlaw Shinning the light of transparency on police/government corruption.Having the courage to get right in the face of the police state/prison industrial complex and try to change it.Ademo takes great risk to his treasure, life, and liberty on a daily basis fighting to liberate America from this police state.Ademo is genuine and an inspiration.
So kids...don't be normal learn about individual liberty and have the courage to fight for it.
@HONORYOUROATH exactly!!! he wastes his life holding everyone else accountable other than himself (proof in the videos I put in previous comment). He is an inspiration to petty criminals. Yah keep fighting Ademo your making everyone else other than yourself look more intelligent.
@eajjoutlaw A "bullshit artist?" I wish I had 10% of the courage that Ademo has on how he puts his life, money, and liberty all on the line for each and everyone one of us. You say he is "dancing around the law." Sadly, it is somewhat true. That is what is wrong with this country. The fact that men in blue costumes enforce immoral laws. So since you are implying that disobeying any law is a bad thing, do you think cops should have enforced Fugitive Slave Laws in 1850?
@DJAnthonyillWill granted there are stupid laws like the fugitive slave law but we arn't talking about that law are we? Wiretapping is a real law and it has victims. I bleieve Ademo is guilty because he has shown no evidence otherwise.
@DJAnthonyillWill granted there are stupid laws like the fugitive slave law but we arn't talking about that law are we? Wiretapping is a real law and it has victims. I believe Ademo is guilty because he has shown no evidence otherwise.
@DJAnthonyillWill ok buddy we arn't talking about all the laws are we? we arn't talking about 50 years ago are we? obviously the fugitive slave laws were bullshit laws, but we really arnt talking about that are we? wiretapping has the potential of a victim. that victim canface defamation of character and/or release of his/her private information. Ademo is obviously guilty since has not released any evidence to prove otherwise.
@DJAnthonyillWill and how does my ad hominims make my arguement "timorous?" yes you got the ad hominims right and I am directing them at him since thats the only way to get information into his thick skull. however ad hominims do not make my arguement "timorous"
deifinition of timorous: Showing or suffering from nervousness, fear, or a lack of confidence.
is it me or are you just pulling words and facts (that are irrelevent to our current discussion) out of your ass?
@BTumelty it would be one less propaganda spreader. OORAH. I mean he wouldn't be charged if he wasn't instigating something. I mean jesus chirst look at him, look at his face. is that the face you would want to follow to change this country? NO I would be like "hey wanna help reform this country from its socialist state?" and he would be like "NO I wanna go piss off some cops." thats all hes good at. He has no morals either. For fuck sakes, he laughs at people in court.
@DavidLister6000 - If I am not mistaken, I think it is December 16TH. I would not be suprized at all if the Prosecution seeks the maximum sentence or close to it. Still, I don't feel sorry at all though for him.
@DavidListe6000 I doubt he will answer you, besides hes not going to admit the fact that he was wiretapping because he likes to dance around the law, spit on it and laugh. Thats what hes famous for anyway.makes him a coward actually.
@DavidLister6000 - what rights of the public officials do you think were violated? Public officials have no expectation of privacy while performing their official duties in case you were about to say privacy rights.
@2011blueman what makes you think that any public sector employee loses some civil rights simply because of their position? You think that the DPW worker has some reduction in their liberties then you? I would hazard the first issue would be, civilly, would be to privacy, defamation, libal, and slander. Crimally Ademo is facing an uphill battle. This has little to do with Gilk so I hope they have a good attorney.
And dealing with torts against the police, there are 25-30,000 civil suits against the police yearly. That's about .3% of the police facing suit. Many are settled out of court or dismissed and take 2-4 years to adjudicate. Typically, the incident must "shock the conscious" of the court for the larger awards/settlements. Depending on where the suit takes place, the courts are either in favor law enforcement (5th Circuit) or the public (9th Circuit)...
...and just to clarify, the police only need "reasonable suspicion" not the higher burden of "probable cause" to detain someone...its a common mistake by the ignorant.
Wow, too bad you never took the bar exam, or you could actually help Copblock, rather then giving them the typical "freeman" "common law" "sovereign citizen" monologue.
Your like Matt Damon in Good Will Hunting defending himself...funny, he still wound up on the county lockup..
Funny, you can claim sovereign this and natural law that, but Copblock is frankly is some deep shit, and unless you have a bar card, your comments are self-serving, since your not the one that will face trial. But by all means, quote your ramblings before the court, stand with them. I'd love to see your closing...
I think your forgetting he's charged with wiretapping. I have read the statute and on its face, he's guilty (he was indicted x3). There is a huge difference between recording some cop on the sidewalk, and a school official. Again, they need to understand, they are journalists. Just because you have a cellphone and host a website, may no make you a member of the "press."
If he takes it to a jury, maybe he'll get found not guilty....then again, maybe he won't.
a few weeks ago a judge in goffstown, NH, in a case againts someone for recording a cop said that a cop or any city official, while on duty and in public land can be recorded at any time. I'll try to get the article and I will post here again.
@stefminus - What does that have to do with this video? I would not expect someone that is in the 30's as listed in your youtube profile to make an idiotic comment. You just made yourelf look like a donkey.
@DavidLister6000 - Well, Ademo has made a lot of enemies for all the things that he did from my observation in the wrong way. There is a good chance since the jails and prisons are overcrowded. That I would like to see him do if sentence is to clean graffiti.
@DavidLister6000 that WOULD be ironic if he cleaned graffiti. I have a question.... did Ademo ever give a statement why it was ok to deface someones property?
It would be interesting to know what would happen if this video had been provided to and aired by a traditional media source instead of Cop Block. Would they have been charged with wiretapping? Would they face felony charges? I'm guessing not. It's time we start to work for a SCOTUS ruling on the legitimacy of citizen journalism. This has got to stop!
Wow...sorry buddy, I have no problem with the filming of police as long as you don't interfere but when you post stuff about school, comments and statement from juveniles and staff, you open yourself up to liability.
All kidding aside, you should have spoken to an attorney and made sure you were lawful for this. I guess I would have read up on those wiretapping statutes, read some case law before you started down this path.
Sorry but I think you might be fucked on this one.
@DavidLister6000 since when did a comment become an issue of liability. The school is funded by property taxes and those who work there are servants, We are their boss. It's not a top down but a bottom up government, created Of By and For the People. The officer in the video exceeded the use of force matrix at the policy level and violated his oath of office and along with the school officials are liable for those actions.A badge doesn't entitle one to extra rights.
@justaman6972 .ah yes, the 'servant' angle. If in fact you pay taxes, walk into your local elementary school, put your feet on the principles desk and demand to see the budgets or school rolls. See how far you get.
And your 'opinion' is the cop overstepped his bounds, apparently the dept disagrees as does the school administration.
@DavidLister6000 Yeah I don't care what you believe how's that? I can see the budget/books and all public records on demand. It doesn't matter if the school admin agrees or not. The cop shop and school admin are shaking in their shoes right now, and it's why they tried to get the video from the other student, suppression of evidence.Govt. can offer no good or servic without it being at the point of a gun. They acted unlawfully and will pay for it.
@DavidLister6000 if you look at the comments in copblocks anonymous video, justaman said that anonymous should steal from the one percent he also mentioned hanging someone from a tree and gutting them like a pig. He is a disgrace to the American people, a disgrace to cops that he so claimed to be affiliated with as a sheriffs, and a disgrace to professors of law everywhere. Smell the bullshit? Its extremely feculant.
I am not going to call nobody for this Ademo for making a bad choice of his own actions. Life is like a game of chess, knowing to make the right move and you make the wrong move to learn from it to avoid making the wrong move again. This Ademo can complain all he wants to, but still I don't feel sorry at all.
there goes ademo again with his tyrant like biased comments. Those with true brain capacity would question what is ademo trying to hide. Thing is though he doesn't have the balls to admit it, he will just go ahead and accuse every cop of anything. He only tells part of the story and not the whole story.
It's obvious that "Der Stadt" wants people to be very confused about their right to film agents of the state. All that needs to be done is for each state legislature to clarify this issue for the public - i.e. spell out what the constitution already grants us. Now why do you think there is no move in this direction? It's called obfuscate, intimidate and confuse. Fuck the State and all its agents!
These charges are not designed to intimidate Ademo, they know Ademo will beat the rap. They are designed to scare others from trying to hold "authority" accountable. They are designed to keep others afraid of filming government intimidation agents (cops).
The main purpose of public schools is to make sure society obeys authority (government) and never questions it. Sounds like a conspiracy theory, but do the research - public schools are modeled from the Prussian system.
BTW, don't call the police station, call the district attorney's office. They are the ones who will eventually drop these trumped up charges.
Ademo, I'm sure you know this, but you're doing it right. They (all the state actors) are scrambling to shut copblock down. They'll censor information, blame the vitcim, protect the abuser, ban the shwag and website, attack journalists. I know a lot of people are concerned about you (as am I), but I am more optimistic. I think it is highly probably that they will lose in this instance and some significant changes will occur as a result. Our task now is to spread this info far and wide.
@cincinatus90 Here's hoping that when you make those calls, your comments won't be like the ones you post to "bother" these guys. Have you ever tried to get criminal charges filed on a judge? Think now would be a good time? You can see what happens when people take a stand and expose corruption. They get charged with felonies to shut them up. If you're not part of the solution, you're part of the problem.
Yes, I 100% agree with you and I am proud of you and them! These people need to be exposed. I am so proud that there are Americans that actually know and will stand up for their freedmoms, and I am also proud that there are people like you and I that will back them!
WTF? Tell these cops and judges to read and study The Constitution of the United Stated of America! Especially, the first ten amedments (THE BILL OF RIGHTS!) before they pass judgment! The Constitution supercedes all other laws! It is the law of the this land-period!
@shay33ish Telling "law enforcement" that they are violationg your constitutional rights gets you labled as a terrorist these days. The game they like to play these days is to file false charges, issue a warrent, lock you up, destroy your life and finances for a couple of years, throw ridiculous charges until they can get some to stick, or just dismiss them at the last minute, after the damage is done. This is not about enforcing any law, the public good or justice.
@shay33ish I agree they are heros. I'm in court right now proving the cops, Co. Attny and judges have violated their oath to uphold the constitution [sate and federal] and have violated my constitutional rights.Just wanted to tell people to be prepared for the world of s**t they will encounter when you stand up against thugs and criminals with unlimited resources, a grudge against people that tell the truth, and an agenda to oppress those that expose them.
More info please - would you read or post the newspaper story? [couldn't read it from the links]. Keep in mind the "set-up" angle -[by the cops and newspaper - see Title 18 sec. 241 Conspiracy Against Rights]. Was this a grand jury indictment or the P.A. complaint? I'll wager the phone call was recorded by the cops as s.o.p.. Have they ever notified you they're recording? Be sure to contact "the authorities". False charges+illegally obtained warrent=silenced "troublemaker"
@possums1010 you make a valid point concerning the cops recording the call,it is SOP and the Constitution requires equal protection, under the equal protection clause. All are equal BEFORE the law and there is no immunity for anyone who trespasses upon the rights protected by the Constitution. PAx aut bellum.
@benjaminbartholomew No kidding. So they expect the kids to say the pledge of allegiance to our flag, which is to represent our Constitution - yet they suppress they same rights that they teach?
@scrm1 the school is not some al powerful authority able to do whatever it pleases. It is managed by elected school board members which are servants and must have an oath of office to operate as such. Political speech is is protected. The school's employees are liable for injury to the kid by officer fathead , as is officer fathead for a tort of trespass.
@justaman6972 you're almost right. The school has as much authority as the public gives it. Recording a conversation has nothing to do with freedom of expression. The cop was invited onto the property so he can't be guilty of tresspass.
@scrm1 I never said recording was an expression in the 1st amt. The trespass I am speaking of is not the one you mention. This ignorance is evidence of a generation unwilling to learn their duty as a self ruling, self governing sovereign lawful elector. I am not attacking you, ignorance is a lack of knowledge. The trespass is a common law tortfeasor and crime, the violation of a lawful right protected under Constitutional provisions. Please educate yourself in law. Pax aut bellum.
@scrm1 Are you familiar with the Common law trust document called the Constitution? Well in there lists the limitatins We the People placed upon our servants allowing them to only act within these limitations. There are changes to this contract called amendments which list some, not all of the GOD given rights that these servants are sworn to protect by their oath/offer to contract with We the People.(You will need to read this post in reverse order to comprehend what I will share.)
@scrm1 When a servant is elected/appointed to office they make an offer to contract called the oath of office. The considerations/details of the contract is the Constitution itself. They must file the oath with the Sect. of their state to be a valid lawful elector/office holder. If this is not on file they are impersonating an officer/judge/commissioner etc.Which is fraud, trespass #1.Once lawfully occupying said office the elect must stay w/in the limits of their office and w/in the limits
@scrm1 of the Constitution itself,so if they occupy the executive branch/police they must act w/in the limits of that branch and that office, or a seperation of powers violation which is a breach of the contract. This happens all the time but people are ignorant of their Constitution and don't realize that a cop cannot make you sign a ticket promise to appear under threat/duress/cohersion by being arrested if you refuse to sign for one and it is a seperation of powers violation...
@scrm1 because the police are executive branch and the only way you can be ordered to appear in court is by a judicial branch function of an Article lll judge signing, or affixing the court seal to the order. So if you are a cop you do not have any extra rights afforded to you over anyone else. You actually have fewer while acting in your official capacity because you are in an inferior position as a servant to the sovereign. Now on to the trespasses. All depts. in LE have a state mandated..
@scrm1 mandated use of force matrix, which is stricter than Constitutional limits to aviod litigation liability for the dept. The only way a cop can arrest you is under probable cause which for most people is a difficult concept to grasp. It works like this, but is not the totality of circumstances and does not address corruption of the courts and cops: Probable cause must show that it did/ is likely that a crime took place and the person who is accused was involved in the criminal activity.
@scrm1 It must be a sworn affidavit by the cop with articulable facts communicated to the judge based on facts not a hunch, or suspicion. There is no such thing as detained either, you are either free to go or you're under arrest ruling by SCOTUS. Additionally the cops have no duty to protect you ,or anyone else unless under private contract with them also SCOTUS ruling. So a cop cannot lawfully touch you execpt for a Terry stop pat down for weapons, unless you are comitting a crime refusing
@scrm1 a lawful command, such as an order to comply with an investigation action like fleeing/eluding,then cops can only use reasonable force to stop/discontinue the action. That is just the amount of force necessary to,let's say to keep you from hitting someone w/a fist.It would be unlawful for you as cop to run suspect over with your car to stop the action,or shoot suspect,or hit him in the head w/ baton. Cops can use just the amount above the resistance being offered by suspect no more.
@scrm1 If unreasonable force is used and results in an injury it is a trespass and may fall into different catagories like battery, aggravated battery,Agg batt w/ a weapon/agg batt w.o weapon/agg batt with intent to kill or cause great bodilly harm etc. and they can be held liable for it criminally and civilly. Are you tracking? All the laws that apply to you apply to them as well. Immunity for cops, or any official applies only within the limits of the duties of that office and the
@scrm1 limitations under Constitutional provisions. There is 4 branches in American governance as well biut you weren't taught this. It is the power duty and rights of the jury. The office of the juror is the most powerful office in legislation. More than the President,Congress and the Supreme court. The ruling of an Article lll Grand Jury is non reviewable ,unable to be overruled or overturned by anyone, and it only takes one juror's vote of not guilty in a criminal case, jurors can
@scrm1 and should ignore the instructions of the judge, for they are the deciders of both the fact in a case and the law itself, so if the law is just plain bad a juror is required to vote their conscious. Example Black's had to sit on the back of the bus, many jurors refused to convict in certain cases having bad law, like posession of drugs. It's just bad law.I hope I was able to explain some of these issues to you and hope you will continue to study and learn your rights.Pax aut bellum
@DavidLister6000 Geezuz on a stick you people are thick as a whale sandwich.I'm not refering to entering the curtilage or private property unlawfully.I'm speaking of the violation of an unaleinable right protected by the the Constitution. It is a trespass upon the student's rights to do what he did period. He violated use of force in his Dept. and the National and state Constitution and is liable under civil/criminal law.Go to a law library and know what you speak of for cred K?
Wouldn't you think that people would want what goes on in school to be videotaped in the interest of protecting the kids? btw that psycho pig needs to get fired
@scrm1 Have you watched any of his other videos? Every one I have seen, he always informs the person on the other line that he is video and audio recording. So I'm not sure where these charges are coming from. Maybe they are claiming you need consent - not just be made aware of.
@1775novten I've seen him get consent in other vids too but not this time. To get an indictment, there would have to be some proof for a judge to let the charges go forward.
@scrm1 Yes, that's they way it's SUPPOSED to work - malicious prosecutions however, don't care about the "rule of law". We have ample proof that the so-called legal system is broken. Don't continue to assume that judges follow the law.
@scrm1 I don't recall him talking to anyone in this video - I'll rewatch it. I do recall the video he made of him calling the police station regarding this officer and I remember him notifying that he was recording. Either way, it will be interesting to see what comes of this and it's a shame.
@kramcas2 Instant grounds for motion to dismiss and if they proceed anyway, for declaration of mistrial.....and if it should turn out that the news article were false, you might just find yourself as the proud new owner of the Union Leader...stay tuned is right because I smell bacon fryin'
I hope this type of crap serves as a catalyst to get more activists to move to NH .... one of the frontlines of liberty activism.
Sadly, current events make me think that a time is coming when cops will lament about the good ol' days when dissenters used to be peaceful, and how they should have listened.
I bet if the cops tried something like that on a thug and got shot while someone was recording it they wouldn't be quite as upset about the footage. I mean, they video tape and record us "for their own safety" even during minor stops. Why shouldn't we be allowed to do the same?
Young man.........thank you for your courage.

DJAnthonyillWill 2 months ago
@DJAnthonyillWill granted there are stupid laws like the fugitive slave law but we arn't talking about that law are we? Wiretapping is a real law and it has victims. I bleieve Ademo is guilty because he has shown no evidence otherwise.

DavidLister6000 3 months ago
...and just to clarify, the police only need "reasonable suspicion" not the higher burden of "probable cause" to detain someone...its a common mistake by the ignorant.

Jury decisions are 50/50.

DavidLister6000 3 months ago
@DavidLister6000 since when did a comment become an issue of liability. The school is funded by property taxes and those who work there are servants, We are their boss. It's not a top down but a bottom up government, created Of By and For the People. The officer in the video exceeded the use of force matrix at the policy level and violated his oath of office and along with the school officials are liable for those actions.A badge doesn't entitle one to extra rights.

Fuck the State and all its agents!
robran53 3 months ago
These charges are not designed to intimidate Ademo, they know Ademo will beat the rap. They are designed to scare others from trying to hold "authority" accountable. They are designed to keep others afraid of filming government intimidation agents (cops).
furyofbongos 3 months ago 2
The main purpose of public schools is to make sure society obeys authority (government) and never questions it. Sounds like a conspiracy theory, but do the research - public schools are modeled from the Prussian system.
BTW, don't call the police station, call the district attorney's office. They are the ones who will eventually drop these trumped up charges.
furyofbongos 3 months ago
Ademo, I'm sure you know this, but you're doing it right. They (all the state actors) are scrambling to shut copblock down. They'll censor information, blame the vitcim, protect the abuser, ban the shwag and website, attack journalists. I know a lot of people are concerned about you (as am I), but I am more optimistic. I think it is highly probably that they will lose in this instance and some significant changes will occur as a result. Our task now is to spread this info far and wide.

@scrm1 the school is not some al powerful authority able to do whatever it pleases. It is managed by elected school board members which are servants and must have an oath of office to operate as such. Political speech is is protected. The school's employees are liable for injury to the kid by officer fathead , as is officer fathead for a tort of trespass.
justaman6972 3 months ago
@justaman6972 you're almost right. The school has as much authority as the public gives it. Recording a conversation has nothing to do with freedom of expression. The cop was invited onto the property so he can't be guilty of tresspass.
scrm1 3 months ago
@scrm1 I never said recording was an expression in the 1st amt. The trespass I am speaking of is not the one you mention. This ignorance is evidence of a generation unwilling to learn their duty as a self ruling, self governing sovereign lawful elector. I am not attacking you, ignorance is a lack of knowledge. The trespass is a common law tortfeasor and crime, the violation of a lawful right protected under Constitutional provisions. Please educate yourself in law. Pax aut bellum.
justaman6972 3 months ago
@justaman6972 OK, where is the tresspass then?
scrm1 3 months ago
@scrm1 Are you familiar with the Common law trust document called the Constitution? Well in there lists the limitatins We the People placed upon our servants allowing them to only act within these limitations. There are changes to this contract called amendments which list some, not all of the GOD given rights that these servants are sworn to protect by their oath/offer to contract with We the People.(You will need to read this post in reverse order to comprehend what I will share.)
justaman6972 3 months ago
@scrm1 When a servant is elected/appointed to office they make an offer to contract called the oath of office. The considerations/details of the contract is the Constitution itself. They must file the oath with the Sect. of their state to be a valid lawful elector/office holder. If this is not on file they are impersonating an officer/judge/commissioner etc.Which is fraud, trespass #1.Once lawfully occupying said office the elect must stay w/in the limits of their office and w/in the limits
justaman6972 3 months ago
@scrm1 of the Constitution itself,so if they occupy the executive branch/police they must act w/in the limits of that branch and that office, or a seperation of powers violation which is a breach of the contract. This happens all the time but people are ignorant of their Constitution and don't realize that a cop cannot make you sign a ticket promise to appear under threat/duress/cohersion by being arrested if you refuse to sign for one and it is a seperation of powers violation...
justaman6972 3 months ago
@scrm1 because the police are executive branch and the only way you can be ordered to appear in court is by a judicial branch function of an Article lll judge signing, or affixing the court seal to the order. So if you are a cop you do not have any extra rights afforded to you over anyone else. You actually have fewer while acting in your official capacity because you are in an inferior position as a servant to the sovereign. Now on to the trespasses. All depts. in LE have a state mandated..
justaman6972 3 months ago
@scrm1 mandated use of force matrix, which is stricter than Constitutional limits to aviod litigation liability for the dept. The only way a cop can arrest you is under probable cause which for most people is a difficult concept to grasp. It works like this, but is not the totality of circumstances and does not address corruption of the courts and cops: Probable cause must show that it did/ is likely that a crime took place and the person who is accused was involved in the criminal activity.
justaman6972 3 months ago
@scrm1 It must be a sworn affidavit by the cop with articulable facts communicated to the judge based on facts not a hunch, or suspicion. There is no such thing as detained either, you are either free to go or you're under arrest ruling by SCOTUS. Additionally the cops have no duty to protect you ,or anyone else unless under private contract with them also SCOTUS ruling. So a cop cannot lawfully touch you execpt for a Terry stop pat down for weapons, unless you are comitting a crime refusing
justaman6972 3 months ago
@scrm1 a lawful command, such as an order to comply with an investigation action like fleeing/eluding,then cops can only use reasonable force to stop/discontinue the action. That is just the amount of force necessary to,let's say to keep you from hitting someone w/a fist.It would be unlawful for you as cop to run suspect over with your car to stop the action,or shoot suspect,or hit him in the head w/ baton. Cops can use just the amount above the resistance being offered by suspect no more.
justaman6972 3 months ago
@scrm1 If unreasonable force is used and results in an injury it is a trespass and may fall into different catagories like battery, aggravated battery,Agg batt w/ a weapon/agg batt w.o weapon/agg batt with intent to kill or cause great bodilly harm etc. and they can be held liable for it criminally and civilly.
