It's also about having a choice as to whether or not to listen and when you pay for a public transport such as a tram do really think anyone should have the right to berate and demean you until your at your destination or until they get off? There is a line between free speech and harassment and she crossed it when she did it in a public transport because in any other case you can just walk away and not listen.

If she had said 'Kill all blacks' or whatever then she should be done for inciting murder but she didn't.

    As for the majority - most people couldn't care less either way, as with most things. Providing their own little lives are taken care of they don't care about what is happening in the wider world. However polls done in the run-up to the last General Election showed that immigration was high on peoples mind, at one point becoming the most major issue.

  • If I behaved this way on a bus in New Mexico, I would have my throat slit, and then I would be hauled to jail for what the state calls "fighting words." I am not allowed to harass and insult people to the point where a reasonable person would expect violent retaliation. If I has said what this drunk woman said, and someone punched me in the face, I would be the person arrested, and rightfully so. A person does not have the right to induce someone else to assault and/or batter oneself.

If it was there you'd think someone would have pointed it out by now. I mean, it's not like nobody ever gets prosecuted for public order offences. Further, Article 10 states "The exercise of these freedoms... may be subject to such formalities, conditions, restrictions or penalties as are prescribed by law and are necessary in a democratic society... for the prevention of disorder or crime" etc. Which is exactly what I'm talking about - there is no carte blanche for hate speech in this country.

  • This is why having a US constitution lying around is handy. Under its 1st amendment, according to current supreme court precedent, this woman's speech may be called "unprotected speech." That is, strictly speaking, she's allowed to say it, but her words are inciting ("fighting words") and as such are considered to be provoking unlawful behavior (like the assault to young guy behind her was understandably about to commit) and is itself unlawful.

    Is there some consideration like this in UK law?

This is why in France and I assume with confidence in the UK also, for example the Westboro Baptist Chuch would NEVER be allowed to do theiir funeral protests This is not a problem of "freedom of speech", it's because such a protest would be very likely to cause violent trouble - so, a threat to public order. Also, just basic human decency.

They were spewing hateful inflammatory speech. One cannot condone her being arrested and oppose MAC being dismantled IMO. This is the problem with hate laws. Personnally I don't have a clear stance on this, I really don't know what to think.

    If the only problem was that she was harassing other passengers then why wasn’t she just thrown off the tram? I have seen several people thrown off trams for aggressive and intimidating behaviour and no one involved thought it was necessary to call the police. This woman despite being offensive was not a threat to anyone, the only reason the police were involved was because she was a racist.

  • @MrGoodNamesAllTaken Rights only extend as far as they don't impede on the rights of others. Her personal beliefs/views are not the crime here, the crime is her behaviour. "Abuse" is the key word here. Rights do not exist to be abused, or else they simply become a problem. In order to protect people, rights have limits.

Rights must impede on the rights of others because we don't live in a world where we can all exist in isolation. Rights don't simply exist, we as a society grant them. For example, most people believe they have a right to have children, but in countries with over population issues that right has been limited or revoked. Rights by their nature are impeding.

  • I think freedom of speech has very few limits. I do think, however, that shouting racial slurs at people just trying to get home for the night is one of those limits. I can see myself tearing into someone for being a prick or a moron, but verbally attacking people you may never have met before is completely redundant, if not absurdly ignorant. There is a time and place. Have a little class, woman! This also goes for people picketing ANY funeral.
