Yeah, because that's not made by the BBC. It's made by Hat Trick for the BBC, so Hat Trick state in the contracts that celebs have to sign before they appear that Hat Trick may use that episode of HIGNFY for any commercial ventures they want (including releasing on DVD).

This new series of Shooting Stars is going to be released on DVD, because that is a Pett production for the BBC.

The BBC had different artists contracts at the time which *didn't* include details about commercial ventures.
