  • I’ve researched this case and seen every video. I’ve read testimony. I’ve researched both the M26 (and X26) taser and Sig Sauer .40 cal Mehserle had that night, and the differences and similarities between the two. I have investigated Mehserle’s history as well as Grant’s. I know more than I should not being directly affiliated with the case, but I began researching this as a midterm project, I am studying law and I thought I had found the perfect example of an abuse of power. I was wrong.

  • You have to look at all the videos, because none give a clear picture on their own. After being forcefully placed on the ground (for grabbing officer Dominici by the arm and kneeing Pirone in the groin) and ordered to remain seated, Grant tried to stand up. Obviously police take this as hostile, especially in light of the hostility already shown by Grant. Bryson and Grant were under arrest because they were the only two that physically assaulted officers.

  • The fact that Grant was on the leg of Carlos would not have prevented the control and restraint of Grant’s hands, especially the left hand, which was nowhere near Carlos and which he placed under his body. It also would not have caused Grant to try to roll to his right to avoid being cuffed. He was clearly resisting, starting with standing up when told to remain seated. Again, this was after already assaulting 2 officers, which is what found him under arrest. 

  • Video shows Oscar only took his left hand out from under his body AS Mehserle drew, and was moving it towards his back AS the shot was fired. Furthermore Mehserle clearly shouted “I’m tasing him” as he was standing and drawing, to which Grant responded “Don’t tase me”. This is why he finally decided to move his hands to his back, and why Pirone stepped back. This was testified to by some of Grant’s own friends, and heard clearly on the tape played in court.

  • Grant had been tased before during one of his 12 arrests in 4 years, so the threat got his attention. In fact, you can still see his left hand moving toward his back as the muzzle blast appears. Some say after the shot Mehserle is trying to cuff him. Anyone with observational skills would recognize that Mehserle is in fact applying pressure to the wound, administering the only first aid he can. They likely cuffed him at some point after he was shot, that is actually standard.

  • Mehserle had almost no training with a taser. BART police had just received tasers shortly prior, had absolutely no policy on taser placement, and officers often shared belts. In fact, Mehserle received his mid-shift as I understand. He did, however, have considerable experience firing his sidearm, as any officer does. The real proof, as much as his SAYING “I’m tasing him”, are his actions with his sidearm.

  • No one who has fired a .40 cal would fire straight down, against a target with a hard surface behind it. Anyone who has fired a gun of that caliber has to know that, regardless how you feel on this case. Police take EXTENSIVE courses on ballistics. Ricochet could kill you or the other officers nearby, or the people on the train. In fact, it was the ricochet that killed Grant, the bullet went through the LOWER back, hit the floor, came back through the lung. No way he took that shot on purpose.

  • @ssn708 dude, i think if he was hasty enough to mistake a light tazer for a heavy gun, then he was definetly hasty enough to forget his ballistics training. so that point is forfeit.

  • Also, when the video is slowed you can see that Mehserle only had one hand on the gun at the time it was fired. The gun actually hit his left hand and sent it flying towards his face! No one who has fired a .40 cal would intentionally fire with that grip. In fact, the grip safety should have prevented the gun from even being able to fire! This can all clearly be seen by looking up “Video proof that Mehserle thought he was firing his taser”. The site is flopping aces dot net.

  • People who know Mehserle say he was just a big dumb oaf. They said if there was a way to screw things up, Mehserle would find it. No one who actually knew him was surprised he shot someone that he intended to tase. I know of 8 suspects who police intended to tase but accidentally shot, it doesn’t take a lot to find the cases online. Nearly all of them were either Latino or White. It does happen; especially when you mix scared with dumb.

  • There is anger in this case. There is outrage. And there damn well should be. A man (NOT an innocent man, a man guilty of numerous crimes that night alone) was shot and he should not have been. He’s dead and he should not be. There is a girl without a daddy, and that never should have been. But this was criminally negligent homicide, as the jury found. Mehserle is no murderer and Grant certainly is no martyr. He was no peace maker. He was a violent, career criminal.

  • As contemptible as it is, there are abuses by the police. There are murders by police. We cannot turn a blind eye to these things. They happen and they cannot be tolerated. Fong Lee is a great example few have heard about. However, by calling something a murder that was not, we lessen the atrocities that actually occur daily. Don’t do that in the name of furthering an agenda, you do your agenda more harm than good.

  • What I think happened here- he got ticked off with the guy for giving them trouble to restrain him,& without giving it full thought & consumed with anger/annoyance/disgust,decide­d to stop his resistance with a shot in the back.

    Things like this happen because there's not much intuitive restraint in the use of deadly force by police officers, because of the understood and evidenced truth that they're above the law, and they know it.

    I don't think it was muder, but certainly is manslaughter.

    He shouted "I'm tasing him" to throw suspicion, stood to give everyone a good view, held the gun in a way NO ONE with training would (& grip safety should have prevented), shot in a completely NON-VITAL area of the back, calculating ricochet to pierce Grant's lung while not being a danger to him or the other cops feet away, let the recoil hit his hand and send it flying towards his face, faked a look of shock and horror, all to execute a stranger for no reason.

  • An 8 oz weight difference between the taser and gun makes no difference, especially in a panic situation. Mehserle intended to tase. Look up "Video proof mehserle thought he was firing a taser". Not only would Mehsrele not have fired without both hands on his gun, the grip safety should have prevented him from even being able to fire the gun. Being as he had extensive firearm practice (and next to zero taser training), he would know he had to grip firmly with both hands to even be able to shoot.

They were instructed that if it was found that a gun was used in commission of a felony, that the gun enhancement qualified. They were not instructed that the crime had to be "intentional" by the statute. If they did as you claim, that would be grounds for a very successful appeal. They would have just acquitted him instead. Precedent was already set by convicting him.

  • Another injustice by the system. I believe that the officer purposly drew his weapon and fired. How could a jury say manslauter. Manslaughter is accidental. He accidentily drew his weapon, then accidently pulled the trigger. The government is corrupt. People wake up. They violate their own laws. Like Bush said "You are either with us or against us."   • @bugsz1 A jury could say manslaughter because it was proven beyond any logical contradiction that this was an accident. There is a litany of evidence proving it an accident, and literally nothing indicating the opposite.

  • @joelcrouch Yes, NON-VITAL, you dipshit. The area where Grant was shot was a NON-VITAL area of the back, exactly where one would aim a taser. It was RICOCHET that caused the bullet to pierce Grant's lung. It was ricochet that would have also prevented him from intentionally drawing a gun in the first place, further proof he intended to tase. He didn't refuse to cooperate with Internal Affairs, HE QUIT HIS JOB, genius. Try again.

A "Kill shot" is center mass. This was in the lower back. If a cop intended to fire a gun, we would aim for center mass. He also would not fire directly downward against a hard surface. He would not fire with other officers in near proximity. He intended to tase him. It's been proven, you just are too dim to get that.

  • @bugsz1 Not all manslaughter is accidental, involuntary manslaughter is, and that is exactly what this was. He shouted "I'm tasing him" prior to drawing. No officer would fire in that close proximity to other officers. No officer would intentionally fire downward against a hard surface standing above the point of impact, the risk of ricochet (which is actually what killed Grant, as the bullet went in a NON-VITAL area of the back) shooting himself or other officers would be way too high.

    he was given INVOLUNTARY manslaughter on top of that. The fucking pig was given the least amount of punishment other than being completely acquitted. Sentenced to 2 yrs. Thats how much our lives our worth? 2 years? If it were a black cop killing a white kid, jury would've said murder with 15 to life in prison

He was convicted of involuntary manslaughter because that is exactly what it was, a negligent homicide, NOT murder! This was very clearly proven. It was Mehserle's intention to tase, not shoot.     Bullshit. The modern tasers that Mehserle had is half the weight of the standard firearm issued to the cops in Oakland. Also, there is a picture taken by Oscar Grant moments before he died showing Mehserle holding his taser and proving that Mehserle was familiar with the taser and the firearm. Mehserle got away with murder. period.

  • @PHILLYHEAT215 The weight difference between the M26 taser and the sig sauer .40 cal is about 8 ounces. Hardly a substantial difference, and it doesn't matter in the least since he panicked. Panic robs you of reason. It is 100% proven FACT he intended to tase. You are completely wrong if you think he murdered someone in front of dozens of witnesses for no reason. Period. He was convicted of exactly what this was, involuntary, accidental, criminally negligent homicide, NOT murder.

And I've held a taser & a .40 cal glock before and there is a substantial difference. And even if his intentions were to tase, he had no reason to tase Oscar Grant considering he was already subdued by at least 2 officers.
