Neither should be fined. Stern is ruining the league and this is a perfect example. I'm not sure what Jackson's comments entailed, but JVG's criticism is spot on. Players get Td up for having a simple reaction to a play. Doesn't matter if they swear or are abrasive towards refs, any disagreement at all = technical. I suppose he knew that by tossing him the ball, if the fan tossed it back, he could get him kicked out for "throwing something" on the court. But the fan didn't fire it back at him hard - so I commend the fan for showing some restraint. That said, he should be punished, and probably will be. You know how concerned David Stern is with the NBA's image.
