It IS legato, but there is also another harmony legato part that is going along with it.... which makes it sound much cooler than if it were just the single part he is playing at the time.
Yeah, Michael is great but I definitely like Chris's style better. Anyone who likes his work in Arch Enemy should check out his band Armageddon, way better IMO.

1.)to the people who think this i legato you are retarded, you can hear the picking
2.) you can tell by the lick it is not legato
and 3.) it is harmonic minor in the key of B (which since the guitar is tuned down 2 steps its actually G harmonic minor)
