This Officer was trying to make a lawful arrest on the black lady who was resisting arrest and had already punched the Officer. While he's already dealing with her, this ape lady comes into the picture holding a camera in the Officer's face. The Officer ignores this. Then the ape lady decides to push the Officer away from the person he's trying to arrest. So he has been forced to be hands on with two combative people simultaneously. That's way he slapped her away.

Officer Vidal has been cleared of wrong doing by: The Office of Profession Standards, Internal Affairs, the Police Academy Staff, District Attorney's Office, Police Union, Citizens Review Board, Neighborhood Comities, IHOP management and witnesses ON THE SCENE WHO SAW WHAT HAPPENED BEFORE THE CAMERA WAS TURNED ON. All these people, hundreds of them, support the Officer because they're looking at the whole picture, the totality of the circumstances and according to established law by the PEOPLE.
For those who have a little patience and would like to know more about what happened in this video, read along. I’ll explain; 1- what happened before the cameras were turned on. 2- what was happening while the camera was rolling and the cops perspective of this. 3- I’ll explain some rules the cops have to follow and clear up some misconceptions of what cops can and cannot do. 4- Georgia Law. 5- The 4th Amendment to the Constitution and how it applies to Officers. --- Please read posts #1-24.
1- Let’s start off in the beginning so we’re all on the same page. The Officer has to have a permit, granted from the city to work extra jobs. The reason being, when an Officer is working an extra job, he has all the same authority as if he/she were at work on a regular shift. This Officer at IHOP was working an extra job for IHOP.
2- IHOP needs Officers at the location due to the high number of drunks that go there to eat after the clubs close down for the night. So the night of this incident, IHOP was FILLED to capacity with mostly drunk people. The management at IHOP gave specific instructions to the Officer that any behavior over the top would warrant him to act in behalf of IHOP and warn the person(s) to behave and/or ask them to leave. Such behavior as yelling, foul/vulgar language, fighting, etc…
3- If a person is asked to leave and they refuse, they can be charged with Criminal Trespass and arrested. Yes, it’s Criminal Trespass. This is NOT a debatable issue. IHOP is private property and they can refuse service to anyone they please. GA Code 16-7-21, subsection B3. If an Officer is speaking in behalf of the restaurant, then he can ask you to leave, or physically remove you.
4- The night of this incident, you have a restaurant full of people who are drunk or have been drinking (the overwhelming majority), you have the cop who was hired to work security in his full police powers in case something happens or in case someone needs to be removed from the restaurant. Now that we know that, we can continue.
5- Some guys come into the restaurant dressed in Star Wars costumes. The women in the booth next to them were making fun of them and making fun of their costumes. This apparently progresses to the point the girls were screaming, well over the volume of an already noisy crowd. While they were screaming, they were swearing and being vulgar. The Officer, who was already there cause he’s working there, can obviously can see and hear this.
6- The Officer approached the women and asked them to please quiet down and not to use foul or vulgar language in the restaurant. The women refused and immediately challenged the Officer telling him he “has no right to tell them what to do”. The Officer tells them again to quiet down, again the women refuse.
7- The Officer then tells the women they need to leave the restaurant. Again this is met with a challenge. They tell the Officer that he’s “not the real police” and that they’re “going to call the real police”. Note; the Officer was in full uniform. The Officer told them he is “the real police”. One woman stated that she was a criminal justice major and she “knew her rights” and that the cop couldn’t “do anything” to them. The Officer tells them to leave at least 2 or 3 times.
8- After multiple warnings, after the cop identified himself as the “real police” (which he didn’t have to do in this situation), the Officer finally tells them they’re under arrest for Criminal Trespass and proceeds in attempting to hand cuff the fist girl. The girl immediately starts resisting the arrest, sliding back as far as she can and moving her arms around so the cop can’t get hand cuffs on her. The cop grabs her shoulder in an attempt to pull her forward.
9- While this is happening, another lady in a black dress, (who by the way does NOT know the women in the booth), comes over and is holding a camera phone in the cop’s face. The cop simply ignores this and continues with what he’s doing. This lady then decides she’s going to PHYSICALLY PUSH the Officer away from the girl! Ok stop, this right now is a misdemeanor obstruction charge which is an arrestable offence. I’ll give more info on this later.
10- The cop gives this lady a quick hand check, causing her absolutely no harm, but letting her know he’s more than serious and that she needs to BACK OFF!! This lady goes into ape mode and starts swinging and punching wildly, connecting punches to the Officer. The Officer struck back with a single punch. Now that the Officer’s attention has been forced to this lady instead of his original suspect, he takes her down and places her in cuffs.
11- The original girl the Officer was trying to arrest thinks she’s slick and goes for a quick get-away running out of the restaurant. She was shortly thereafter caught hiding in the back seat of a car while the car was trying to leave the parking lot. She got additional charges for Fleeing and Eluding.
12- Put yourself in the Officer’s shoes at this point. He’s trying to arrest someone in the midst of hundreds of drunk people with several people all around him screaming and shouting. The lady he’s trying to arrest is resisting in every manner. You have a camera being held IN YOUR FACE. Now you have someone PHYSICALLY PUSHING YOU away from the person you’re trying to arrest……
12.5... You know from training that anybody in this crowd poses a growing lethal threat to your life, men and women. Every table has been given forks and knives and no matter how skilled you are, you CANNOT watch everybody’s hands at once, and STILL focus on the person you’re arresting. This scenario has to end NOW or you may not live through it. Yes, people hate the police. Don’t believe me? Read half the posts from this video and you’ll see just how much people respect and honor the police.
13- Now for what a cop can and cannot do. Police are given the authority to use a level of force greater than what’s being shown to them. The police are not here for a macho show or to see who can win a cussing match, a pushing match or boxing match. That’s not their job. Their job is to end the situation quickly and effectively. If they need to go hands on, they will. If you push a cop, he’s NOT going to push you back. He’ll go a level higher. Again, not a macho show, just ending the scenario.
14- Contrary to popular belief, women DO NOT have special rights or privileges because they’re women. The sex, sexual orientation, race or nationality will not factor into how a cop does his job. The person will be treated the same as any other person. If a woman gets physical with a cop, that cop WILL get physical back!! Why is this so hard for people to understand???? It is NOT the Officer’s job to fight fairly. Trying to fight fairly is how cops get killed.
15- Technically, if someone refuses to obey a lawful order from an Officer, they can be subjected to hands-on techniques, mace (O.C. Spray) or a taser. If they get physical with the Officer the Officer will answer back with a greater level of force. If the individual so much as doubles up his/her fist in a threatening manner, the cop is fully justified to use an A.S.P. Baton until there is no longer a threat. It is NOT the job of an Officer to fight fairly.
16- A.S.P. Batons, by definition, are meant to leave severe bruising and break bones. Again, don’t expect a nice fist fight with a cop, it’s not happening. You’ll more than likely end up in the hospital.
17- Being a woman is NOT AN EXCUSE!! The exact same rules apply for ANY person. Once a woman has broken the law and there is a need for that Officer to go hands on, it DOES NOT MATTER WHO YOU ARE OR WHO YOU THINK YOU ARE!! If a woman starts pushing or hitting an Officer she’ll be dealt with the same way a man would be dealt with. Here’s the catch though, once the threat has stopped, the Officer MUST stop!! Now this is where cops screw up, by not stopping when they should.
18- I’ll give an example. Everyone is familiar with the Rodney King beating. What people are not familiar with is WHY the cops got into trouble. It wasn’t because they beat the guy up with ASP Batons. They were actually justified in everything they did right up to ALMOST the end. While Mr. King was resisting and fighting they were justified to continue in their level of force. When Mr. King STOPPED resisting and one Officer then kicked him in the head, THAT’S WHERE IT BECAME EXCESSIVE.
19- Obstruction Of Officers - GA code 16-10-24 - (a) Except as otherwise provided in subsection (b) of this Code section, a person who knowingly and willfully obstructs or hinders any law enforcement Officer in the lawful discharge of his official duties is guilty of a misdemeanor.
20- Obstruction Of Officers - GA code 16-10-24......(b) Whoever knowingly and willfully resists, obstructs, or opposes any law enforcement Officer, prison guard, correctional Officer, probation supervisor, parole supervisor, or conservation ranger in the lawful discharge of his official duties by offering or doing violence to the person of such Officer or legally authorized person is guilty of a felony and shall, upon conviction thereof, be punished by ……
22- Have I lost all you yet? Now for the Constitution and the rights affiliated with it. I’ve heard dozens of times now that it’s “against the Constitution”, yet nobody actually knows how it’s in violation. This is actually sad. Apparently the school systems are not teaching our Constitution as well as they should be.
23- U.S. Constitution, 4th Amendment: The right of the people to be secure in their persons, houses, papers, and effects, against UNREASONABLE searches and seizures, shall not be violated, and no warrants shall issue, but upon PROBABLE CAUSE, supported by oath or affirmation, and particularly describing the place to be searched, and the persons or things to be seized. --- Note: the key here for Officers is Probably Cause. This is where the arrest powers come into play.
24- Probable Cause: "That set of facts or circumstances that would lead a reasonable and prudent person to believe that a crime has been or is about to be committed and that the person in question is involved in a significant manor. It is more than mere suspicion but less than actual certainty."
Bonus ---- Criminal Trespass, GA Code 16-7-21, subsection B3 - "Remains upon the land or premises of another person or within the vehicle, railroad car, aircraft, or watercraft of another person after receiving notice from the owner, rightful occupant, or, upon proper identification, an authorized representative of the owner or rightful occupant to depart.

The police was off dutty, It was not his job to serve as security at the IHOP.....why didnt the manager ask the ladies. Those women (not "ladies") not only created the disturbance and refused to leave, but then resisted arrest. They got what they deserved and now one of them is charged with felony obstruction. YES!!

A property owner or his representative (employee) can ask you to leave, if you don't it's criminal trespass. The news reports the cop was working security there so he had all the authority he needed to tell them to leave and arrest them when they didn't. Now as for hitting her, probably not the best response but it was legal.

1- Let’s start off in the beginning so we’re all on the same page. The Officer has to have a permit, granted from the city to work extra jobs. The reason being, when an Officer is working an extra job, he has all the same authority as if he/she were at work on a regular shift. This Officer at IHOP was working an extra job for IHOP.

2- IHOP needs Officers at the location due to the high number of drunks that go there to eat after the clubs close down for the night. So the night of this incident, IHOP was FILLED to capacity with mostly drunk people. The management at IHOP gave specific instructions to the Officer that any behavior over the top would warrant him to act in behalf of IHOP and warn the person(s) to behave and/or ask them to leave. Such behavior as yelling, foul/vulgar language, fighting, etc…

3- If a person is asked to leave and they refuse, they can be charged with Criminal Trespass and arrested. Yes, it’s Criminal Trespass. This is NOT a debatable issue. IHOP is private property and they can refuse service to anyone they please. GA Code 16-7-21, subsection B3. If an Officer is speaking in behalf of the restaurant, then he can ask you to leave, or physically remove you.

4- The night of this incident, you have a restaurant full of people who are drunk or have been drinking (the overwhelming majority), you have the cop who was hired to work security in his full police powers in case something happens or in case someone needs to be removed from the restaurant. Now that we know that, we can continue.

5- Some guys come into the restaurant dressed in Star Wars costumes. The women in the booth next to them were making fun of them and making fun of their costumes. This apparently progresses to the point the girls were screaming, well over the volume of an already noisy crowd. While they were screaming, they were swearing and being vulgar. The Officer, who was already there cause he’s working there, can obviously can see and hear this.

6- The Officer approached the women and asked them to please quiet down and not to use foul or vulgar language in the restaurant. The women refused and immediately challenged the Officer telling him he “has no right to tell them what to do”. The Officer tells them again to quiet down, again the women refuse.

7- The Officer then tells the women they need to leave the restaurant. Again this is met with a challenge. They tell the Officer that he’s “not the real police” and that they’re “going to call the real police”. Note; the Officer was in full uniform. The Officer told them he is “the real police”. One woman stated that she was a criminal justice major and she “knew her rights” and that the cop couldn’t “do anything” to them. The Officer tells them to leave at least 2 or 3 times.

8- After multiple warnings, after the cop identified himself as the “real police” (which he didn’t have to do in this situation), the Officer finally tells them they’re under arrest for Criminal Trespass and proceeds in attempting to hand cuff the fist girl. The girl immediately starts resisting the arrest, sliding back as far as she can and moving her arms around so the cop can’t get hand cuffs on her. The cop grabs her shoulder in an attempt to pull her forward.

9- While this is happening, another lady in a black dress, (who by the way does NOT know the women in the booth), comes over and is holding a camera phone in the cop’s face. The cop simply ignores this and continues with what he’s doing. This lady then decides she’s going to PHYSICALLY PUSH the Officer away from the girl! Ok stop, this right now is a misdemeanor obstruction charge which is an arrestable offence. I’ll give more info on this later.

10- The cop gives this lady a quick hand check, causing her absolutely no harm, but letting her know he’s more than serious and that she needs to BACK OFF!! This lady goes into ape mode and starts swinging and punching wildly, connecting punches to the Officer. The Officer struck back with a single punch. Now that the Officer’s attention has been forced to this lady instead of his original suspect, he takes her down and places her in cuffs.

13- Now for what a cop can and cannot do. Police are given the authority to use a level of force greater than what’s being shown to them. The police are not here for a macho show or to see who can win a cussing match, a pushing match or boxing match. That’s not their job. Their job is to end the situation quickly and effectively. 15- Technically, if someone refuses to obey a lawful order from an Officer, they can be subjected to hands-on techniques, mace (O.C. Spray) or a taser. If they get physical with the Officer the Officer will answer back with a greater level of force. If the individual so much as doubles up his/her fist in a threatening manner, the cop is fully justified to use an A.S.P. Baton until there is no longer a threat. It is NOT the job of an Officer to fight fairly.

If he fails to act, even when off duty, he can lose his job for it. The women were asked to quiet down and stop cussing at other patrons and they told the Officer to f***k off. The Officer told them NICELY 2 or 3 times to leave, again they basically told him to f***k off. Then the Officer told them they were under arrest.

4 - The only reason mace was not used on the first lady that the officer was trying to arrest is because the place was PACKED and there's no way to spray just one person. Everyone would have caught a sniff. If you look at the video from both angels, you can see the cop smacking the girl first and then getting pissed because she responded. Granted she shouldn't have interfered and shouldn't have touched the cop, but there was no need for him to hit the her. The situation could have be dealt with a lot better and should have never gotten to that point. For any man to slap a woman is not a man at all and I could care less about a cop. For every cop that dies is one less I have to worry about.

Those women (not "ladies") not only created the disturbance and refused to leave, but then resisted arrest. They got what they deserved and now one of them is charged with felony obstruction. YES!!

A property owner or his representative (employee) can ask you to leave, if you don't it's criminal trespass. The news reports the cop was working security there so he had all the authority he needed to tell them to leave and arrest them when they didn't. Now as for hitting her, probably not the best response but it was legal.

You cannot put your hands on an officer in an aggressive manner, it's considered assault. Boba Fett means you are legally obligated to comply with an officer's lawful request. If an officer asks you to leave an establishment then you need to leave even if you don't think he has a good reason. You can protest after the fact to the PD or in court. Simple as that.
