This is straight up bullshit. no body deserves to be shot in the back. espicially not by some pussy fucking cop who had to have his partner restrain oscar just to shoot him. if there were no laws in this country id be standing at each of those officers front door with a chopper, sprayin them like the pieces of scumbag shit they are. i didnt know you until the shooting but my heart goes out to your friends and family. R.I.P. Oscar. Much respect
NONE of what I have said is meant to defend Mehserle, or justify his actions. I will not defend the shooting of Oscar Grant, I only wish to defend the truth in the face of lies and misinformation. Everything about this case can be researched, please, look beyond a youtube video or two before you make a conclusion.
None of my posts are intended to justify the shooting of Oscar Grant. Mehserle committed a criminal act and should be in prison. There are just too many lies, "Grant was handcuffed"..."Grant was not resisting, he was complying"..."Grant was not a criminal"..."This was an intentional killing"... that I just can not remain silent and let the lies propogate and turn into actions based on these lies without at least trying to get the facts out. This was a terrible, criminally negligent accident.
@alteph Convicted of involuntary manslaughter. It was effectively proven that he intended to tase Grant and not shoot him, he panicked and grabbed the wrong weapon.
You guys can't tell me this cop meant to discharge his .40 cal in this guys back. It is completely wrong without a doubt. With all the commotion, yelling from the train, multiple subjects being detained, over bearing loudness causing mental clutter and nervousness in a young inexperienced officer... he clearly was/is not capable of his duties as an officer under these conditions. 2nd degree Murder means you intended to kill someone and did what was necessary to achieve that. This is not murder.
@BG2500hd There was no clear danger to the officers, especially from the man that was shot, who was totally restrained. The motive his lawyers will use, using a gun & shooting a man to embolden his position to try to gain control of a situation. Problem is, it wasn't out of control. This is nothing routine police detention and arrest without weapons drawn could handle.
Using the gun to embolden his position is Assault 1, and shows clear intent on the officers part to harm, or kill.
@tftmc Except that they tried for 30 seconds to arrest him without the use of a taser, which is what Mehserle intended to use. He did not intend to fire his gun, that was effectively proven in court.
@ssn708 You cannot prove a person's intent, especially if grabbing something quickly. That's asinine. Show me the court document or report that "proves" he was going for his tazer and not his gun. And who tazers anyone in the back of the head? That is a lethal shot if either pin hit the ill protected brain stem.
A 9mm Baretta, or any Officer gun is much heavier than a plastic tazer, with a much different feel. I'd argue that. It's not something any situational stress is going to change.
@tftmc Actually, you can and they did. All of his actions were 100% consistant with one firing a taser, and inconsistant with one firing a gun, as testified to by numerous firearms and use of force experts. Plus the fact that he yelled out "fuck this, I'm tasing him" would be a pretty big clue. And he did not aim for the back of his head, Grant was shot in a completely non-vital area of the lower back, exactly where one would fire a taser. It was a .40 cal sig sauer, not a 9mm.
@ssn708 I am guessing here, that this young cop didn't know what he was doing, and wanted to impress the guys on the force.
My family is full of cops, and I have 30 first cousins paternally. So that's a lot of cops, I know how that world operates.
So it's an unexperienced officer, who clearly stepped over his bounds by shooting a person who was subdued and restrained. The taser would be bad enough, no one needs to be tazed when they're not moving.
@tftmc As far as the last statement in your post, how does any experienced driver mistake a gas and brake pedal? They are spaced apart, shaped differently, require entirely different amounts of pressure to actuate. Yet hundreds of times a year, someone does mistake the two. It's called panic, it robs you of rational thought. Are you aware that this exact same thing, confusing gun and taser and shooting a suspect intending to tase, happened at least 8 times before this?
@ssn708 There's the big difference between experienced car drivers hitting the gas instead of a brake & a cop going for a taser but grabbing a gun.
That difference is simple, one is an imminent potentially deadly situation (car wreck), the other is a controlled*** situation where a man shot another man in the head without cause to do so. No one was in danger by the time the officer grabs his weapon. Except the man on the groud who ended up dead.
@tftmc No difference. Panic causes you to lose rational thought. That's my point. It is just as serious, just as easy, just as deadly for someone to hit the gas instead of brake as to pull a gun instead of a taser. Do you realize that this has happened no less than 8 times prior to Grant?
@ssn708 That gas-brake analogy isn't at all good for this situation. Since I didn't see anyone in a position to shoot the officer or even harm him in 'fisticuffs.' He was on the ground. And who uses a taser while on someone's back? It doesn't sound very smart. The tazer excuse is BS, an officer knows their own equipment, and that should be reactionary & correct, making emotion irrelevant.
The video says it all, you & all the others can try to justify the shooting, but the video(s) say it all.
@tftmc Grant placed his hand underneath him and refused to give his hands to police. As he hadn't been searched, he easily could've had a gun. That is the first assumption a cop is gong to make. He was in a position to shoot one or more officers if he had a gun on him. BTW, Grant had already assaulted two officers during this incident , Pirone and Dominici. You say "And who uses a taser while on someone's back? It doesn't sound very smart". As if firing a .40 cal is somehow more intelligent?
@tftmc The gas / brake analogy is quite accurate. The argument is that Mehserle had to have known it was a gun he had because of the weight and shape difference (Even though the M26 has a black rubberized handle just like his sig sauer). A gas pedal and brake are shaped differently, they are spaced apart, and require entirely different amounts of pressure to actuate. When people panic (as Mehserle did) these things are entirely moot, because panic robs one entirely of a rational thought process.
@tftmc (Continued) The scene was FAR from controlled. Cops were outnumbered on the platform more than 2-1 between the 4 suspects and the 8 or so people encroaching on officers and who began assaulting officers. Grant was not restrained. Restrained means cuffed, he was not. In fact, he kept putting his hand under him, where he could have had a weapon. This causes panic. Add to that dozens of drunks on the train getting hostile, define controlled.
@ssn708 Far from controlled? Ok, you and I have different ideas of control.
Ever seen the show cops? What happens there is mostly out of control, you're running, driving, going around god knows where.
A bunch of drunks yelling it's unfair, cops deal with that in big cities everyday and it should have not affected the officer at all. I've seen much bigger crowds here in NY for a lot less serious stuff.
It was a controlled situation, with an officer who couldn't control himself.
@tftmc So much more than what you say was actually going on, let's be fair. There were 4 suspects, two not restrained. 7-8 people directly encroaching on officers, getting in their faces, and refusing their orders. Two who attacked officers. Some on the train throwing things at officers. Officers outnumbered by a hostile crowd at least 10-1, minimum. If you call that controlled, then with all due respect, you need to look up the definition.
@tftmc You do realize he had no intention of firing a shot, right? He confused his gun for his taser, which has happened at least 8 tmes before this incident. I agree, from all accounts BART is a poor example of a police department, but it remains the same. The situation was not controlled, and Mehserle would have been justified in tasing Grant to force his compliance and end his resistance. However, since he was criminally negligent, I am glad to see he will get prison time.
@tftmc You do realize it is not an excuse, but bona fide proven fact, right? You do realize it was on the video played at the trial that he shouted "Fuck this, I'M TASING HIM" to which Grant responded "DON'T TASE ME"? That ALL of his friends testified Mehserle said this? That his actions were 100% consistant with firing a taser and not a gun? You can choose to believe the Earth is flat and the moon is made of cheese for all I care. Mehserle intended to tase him and that is a fact.
@ssn708 San Fran officials would get so much shit if Mehserle was convinced of murder. It makes them look bad & you cannot prove one's intent according to Common Law. That's a fallacy & a excuse to get cops off, been done 1000x before. Cops spend a lot of time in court, are friends w/ judges & DA's, etc. That helps their situations
I know as a fact that many cops often prepare themselves by saying/doing 1 thing but actually do something else. Because as you said, they act like they're on camera
@tftmc What you are saying sounds paranoid. You do realize that no less than 8 cops mistook their guns for tasers, and shot their suspects, right? All before this. More suspects have been White than Black. I hope you understand I am not attacking you, just defending what has been proven to be true.
@ssn708 You have to say that over and over, but repetition doesn't make it true.
Officer's unfairly get the benefit of the doubt & this so called proof is based on the least credible of sources, human memory. As for saying "I'm tazing him," I can say that too, but pull out a gun instead too, anyone can lie! I don't believe him. He clearly held the gun tight, waiting for the recoil.
I'm glad you have some sense of justice, but you obviously don't understand the politics of the justice system.
@tftmc The facts, evidence, and common sense make it true. Again, he said "I'm tasing him". Fact. He said it to mask his intention to execute a complete stranger who he had no reason to kill?Really? He held the gun tight? You are wrong, he held the gun like a taser, not like a gun. Obvious to me, a former small arms petty officer. More obvious to the numerous deadly force experts and use of force experts who testified. As a law student, I do understand the justice system very well.
@tftmc 1) Not intentionally executing someone, like people make this out to be. And no, plenty of proof of his intent, such as yelling "Fuck this, I'm tasing him", his actions being consistent with tasing and not with firing a gun, and his look of complete shock and horror, and crying as they wheeled him out on the stretcher.
@BG2500hd So with that in mind, that he used the gun as a tool of "crowd control" it's no less than Manslaughter 1, with charges of Assault 1, Obstruction of Justice, about 5 Misdemeanors, the boy (shooter) deserves no less than 50 years behind cold steel and concrete. Maybe in 30 years the COs will forget he was a cop & send him to General Population where he can get his fill of being raped the last 20 years of his miserable life.
@BG2500hd Absolutely! Let's not forget that the same hostile crowd not only encroached on officers and refused their commands, but actually assaulted officers!! But on the other side, he SHOULD have still been able to fulfill his duties, which is why I feel he is guilty of involuntary manslaughter / criminally negligent homicide. He will end up with 3-14 years which is much more than the average drunk driver who runs down a whole family.
@BG2500hd You are 100% right. No one would do that, ricochet alone could have killed Mehserle and any other cop there. All cops are trained to act as though they are on video at all times (especially since Rodney King).
On July 8, 2010, the jury returned its verdict: Mehserle was found guilty of involuntary manslaughter and not guilty of second degree murder and voluntary manslaughter.
His death was bullshit. 90% of ppl shot in a lung survive depending on where is hits. It's the time lapse from shot to treatment that killed him. He slowly choked to death on his own blood. I've heard there are videos of fellow BART officers punching that dumb fuck cop after he shot Mr. Grant. I hope this evil creature gets the max and they enhance it since it done with a firearm!
Bart police do nothing but create violence and present false accusations. Thats one reason that they have been stripped of their tasers. AC transit needs policing more than BART does. Bart needs security guard and thats it. A million dollar budget to combat graffiti? What kinda shit is that? Who is there to police the BART police? Cameras dont stop them from murdering innocent people like this.
As a cop i say WTF..... I can in no way justify what happened. That cop screwed up. Hell that does not even begin to wow wow wow. No reason for shooting him that I could see makes us all look bad.
any1 that thinks this is just about him being killed is a fool. people dont realize what this combined with all the other events will become. people dont riot over nothing kids :-) spread the word prisonplanet.coom
THATS WHY YOU DONT FIGHT ON THAA STREETS.. U NEVA KNOW WHEN THERES A STUPID FUCKIN COP THATS GON PUT A HOLE IN YA BACK FA SOME FAKE ASZ REASON.. cops are here to maintain tha peace.. buh stupid crooked asz ones just cause more n more violence..
shut the fuck up about this shit already fuck that guy who died he would have died on the streets by another guy eventually anyway what does it fucking matter it wasnt a racist thing cause if he stayed on the streets than a black guy would have shot him anyway and than what it wouldnt be shit to anyone but if it was a police you think its excessive force you can tell that dumb ass was resisting arrest in the first place, and if he was a father why the fuck is he out fighting
nope havnt bought anything from any officials, and i use to live in d.c. and had no problem walkin around in gov buildings, no one shootin each other, or tryin to rob me. The GOV tries to make me do things but i dont, they arent tryin to sell me drugs either. your stupid and you need to wake up
Wish they were cause its been kinda dry here in FL, gotta put up with mexican dirt weed. How the fuck are they selling shit? they found a big stash the other day and it actualy made a impact on finding weed. You prolly just like to blame everyone else for your problems.
Be careful what you wish man, this is some bad stuff. But i hope the "revolution" never happens, cause if ti does, well have you ever been to Tijuana (not the tourist district)
Im sick of this! Why was that ONLY black people who got brutally beaten/ shot by cop ALWAYS make HEADLINE NEWS and people get organize doing protests? What about latinos? Koreans? whitemen? Chinese, Japanese, etc..and WHY was that Whenever a BLACKMAN who got beaten/brutalized or shot turns up THEY ALWAYS HAVE CRIMINAL RECORDS? Just making a RANT!.. response politely please!
This comment has received too many negative votesshow
Hey homies, you murder whites, you attack whites. Apparently they're getting tired of it. TIme to part company. Where's the video on the last 1000 times you killed each other?
@jordanrivers1 Wrong, he was found guilty of involuntary manslaughter, which is exactly what this was. A criminally negligent homicide without intent to kill.
Thats bad. Makes me ashamed to be white. He shoud have been arrested by now. I cant believe that shit. I would not statnd beside that cop if I was his fellow officer. He murdered that man. Horrible. I feel for his familly and freinds.
All of the cops should be held responsible for Mr. Grant's death. They shouldn't have moved him once he was shot. They took their time calling for medical for him, instead looking like the "deer caught in headlights" CAUGHT and STUCK.
Yea there are alot of racist cops. But we need cops. It was proving in new Orleans after Hurricane katrina. All them death and woman getting raped

At least with greedy capitalists, more people get to eat. That's less than we can say for the majority of communist countries.

@jordanrivers1 Wrong, he was found guilty of involuntary manslaughter, which is exactly what this was. A criminally negligent homicide without intent to kill.

Accidental discharge is just a handy excuse for murder.
Accidental discharges are not a common unless the gun is faulty and the person handling it isn't properly trained.
There was nothing wrong with that officers gun and if he wasn't properly trained to handle it then his police academy did him a disservice.
He is guilty and will eventually pay whether through the court system or otherwise. Karma is a bitch like that.
