IWC Article V.3.(c) thereafter, the amendment shall become effective with respect to all Contracting Governments which have not presented objection but shall not become effective with respect to any Government which has so objected. So any IWC member who objected to the moratorium is not bound by the moratorium and can continue whaling.

Japan doesn't meet either of the cases I mentioned, they do research whaling under IWC Article VIII. Which allows any IWC member to issue permits for legal scientific whaling no matter what other IWC egulations may exist.
