They should have simply talked to him and asked him to show ID and a permit. He could have said no to the ID, but showed his permit.
Obviously he's not a felon if he has a CC permit.
They should have told him to have a nice day and moved on.

@SOI23633 The pistol was ABSOLUTELY in the subjects hand. Listen to part 1 of this @ 1:02 the officer asks "why don't you just make it easy on everyone and wear it on your belt?" The subject replies something to the effect of "the law dosn't say how I can carry it so I will carry it however I want. This guy intended to cause a scene and try to smear the Marysville Police. Michigan AG Opinion 7101 Defines 'brandishing' and him having to "wave or flourish menacingly, as a weapon. to display ostentatiously." If he had it out of his holster than why did the cop try to take it out when he first walked up to the guy? it was in his holster no doubt in my mind someone is dumb enough to do that. and the stick was an example.
@40Spec If the officer ment conceal, he would have said conceal. Since the argument was about open carry, the officer knew the pistol must not be concealed and would not have encouraged it. There is no indication that the subject had a CPL. Who said anything about "brandishing" a weapon anyway? If the pistol was properly holstered, there would not have been an issue. This person carries for attention.
The officer took the pistol for his own safety while they investigated the situation.

It may be reasonable for them to temporarily relieve you of your weapon when they detain you but it was totally unreasonable for them to detain you in the first place. If carrying a gun is legal, then by no means should they be detaining and investigatin you when they don't have reasonable suspicion that you are committing a crime. With the reasoning given, they could stop, question and search everyone in public that they choose.
@whiteknightef I don't know how you came to that conclusion. In the end, this person was allowed to leave with his pistol. All the officers wanted to do was hold his pistol until he determined that nothing illegal was happening. This officer shows up to a call of a man with a gun, so obviously he is going to make sure this person is not a felon and protect his own safety while doing so. I have no problem with what happened here. I also have no problem with law abiding citizens carrying open.

There are laws about who can carry a pistol (no felons). The police did not just see this guy walking and hastle him, the store called the police on him, so they had to respond. There was no profiling here and no abuse of power, the simply responded to a call about a man with a gun, checked out the man with the gun to make sure it was a lawful carry and let him go. What you don't understand is that most officers encourage law abiding citizens to arm theirselves. Police are not against people owning or carrying firearms.
