  • Everyone saying the cop should have shot him in the foot or not shot him that many times you are wrong. They are not trained to deal with situations like these, in case you don't know cops are trained to shoot ONLY when they need to kill. That is only needed in situations like these.

  • I completely agree that Martinez was wrong for his actions. Obviously he should have complied with the officer. It's better to let your lawyer work a deal than be dead. However, why did the officer lunge into the car? Is that accepted practice for police in NJ? If so, that's dumb. Seems like the officer is unnecessarily put into a more dangerous situation. Why not block the car with his cruiser or ram the front end with his pushbars to immobilize the car? There'd be one less dead kid.

  • From what I heard anyway, but, whatever! Look at the Blue Ash Ohio video. This could have very well turned out to be just like that! I really do see it that way! Also, does anyone remember the Crew story on Rt.80? Just by backing up to an Officer in a aggresive manner, That is using your vehicle as a weapon. Deadly force is authorized! Happens ALL the time, ALL over the place! Just stop and do what your told, and nobody gets hurt!

  • Unarmed? Try again. The car itself was his weapon. He could have easily killed both officers by running them down. Bottom line:

    -Don't drink and drive.

    -Don't smoke weed, drink and drive.

    -Don't smoke weed, drink and drive with a suspended license.

    -Do what the cop tells you to do.

    That kid and his family have absolutely no one to blame but the kid himslef. Unfortunately the family will sue and get "go away money". An absolute travesty to the system.

  • @Kyydax that car was a stick shift and the cop shot hit at least 8 times, u think just putting it into a different gear would stall the car or 1 maybe 2 shots would incapacitate the driver, now i understand the car as a weapon and the deceased man was under the influence and in the wrong but shooting him so many times was excessive force and was unnecessary

  • @narri214 You watch too much TV. 1 or 2 shots? The cops don't shoot once, then stop to take a look to see if they hit the guy or not. They shoot until the threat is eliminated, if it's 1 shot, great, if it's 41 shots, so be it. If there are multiple cops shooting, they don't keep track of how many shots the other cops are firing. Hell, they don't even know how many shots they've fired until either the threat is eliminated or their magazine is out.

  • Alot of people sit and pick this apart. They don't realize, we can sit here and say, I would have done this or that! The Officer in question, had 10 seconds to make the decision he did. Yes, I have reached into a car to pull the keys out and stop the situation! I don't see a problem with any of this at all! The only thing I may have done different, was only to have shot twice... But, I was not there. I hope the Officer is mentaly ok and returns to work in the future!

  • Looks like that jerkoff Martinez played one too many games of Grand Theft Auto 4 and decided to try it out in real life. Not to mention he had a suspended DL, marijuana in his system, and his BAC was way over the legal limit, and was CLEARLY endangering the lives of 2 officers. Almost backing over Fernandez when they were trying to pull him from the vehicle and then speeding off with Byrnes in his car. Luckily neither officer sustained injury. The kid was fucking stupid and it caught up with him

  • Every bullet was justified IMO. Sorry, but I would have shot him as soon as the car started moving. Entering a vehicle to remove a combative drunk and having him take off like that is just insane. He could have pinned the cop between the cars or run over the one on the driver side. I see videos like this all over the web and for once I feel the police were 100% justified in their actions.

  • Its ashame that liberal media "coddle" this asshole into being some kind of a victim, when it was his own stupid decision to be an asshole that night and it ended up getting him killed. Bottom line OBEY THE LAW and you won't wake up dead like this jerkoff. if you want to get technical, that officer could have shot him the second that car was put in drive.   • @Sig19 It was a traffic stop and the pursuit was just around a block. The cop could have easily blocked the mustang off, making it impossible for him to go anywhere. However the cop jumps into the car and puts himself at risk. Yeah, I realize he was trying to get the keys but that is fucking retarded. It is virtually impossible to remove keys from a car that is lunging back and forth. Martinez did something stupid, don't get me wrong, but the cops DID NOT handle it in the correct manner.

  • Jlesternj, I live in Rockaway, I know the area very well, I travel it everyday to work. Anyway, the police report stats that a number of 911 calls came in reporting a black vehicle traveling west bound in the east bound lane. Then a vehicle traveling at a high rate of speed on Franklin road. Officer Byrne caught him as he made an illegal right on red on to 46 east. I am much more familiar with this incident then you are, if you want to learn more, read the report released by the Prosecutor

  • I agree with you (hontagi). The whole point is. When an officer tells you what to do, you comply. This whole thing could have been avoided if he just stopped. The fact that he took off with the officer in the car to me and I'm sure to many other ppl is attempt on the officer's life and could have also endangered others. Im sure the highly trained officer tried everything in his power to stop the individual before he had to use his weapon. Im sure no officer likes to use his weapon.

  • Jlesternj when Officer Byrne had his gun out it is consituted as Constructive force. As per AG guidelines Constructive force is only used to force a suspect to comply when normal reasoning is not working, and the failure to pull his vehicle over is obviously a failure to do that. If you look again, when Officer Byrne had his gun out Mr. Martinez was trying to shift the vehicle back into gear. Also, Byrne reholstered because constructive force was not working. He had to escalate to Physical force

  • Hontagi, don't bother arguing with Jlesternj, he obviously knows everything there is to know about law enforcement, the rules the officers must follow, proper tactics, etc.

  • In all honesty, the officer DID NOT have to shoot him 5 times especially to wind up killing him. Officers are trained to deal with these kind of situations, but obviously DID NOT handle it they way they are trained. It was just a traffic violation. Yes Martinez could have killed someone, but it all started with the chase. He was young, silly and scared. Not the way he should have handled things either.

  • You realize that when an officer is forced to use deadly force he doesn't shoot once, look to see if he hit him, and or if he is dead then if he didn't hit or kill him, repeat the same step over again. I feel that 5 shots was very concervative. He could have unloaded his whole clip very easily which is about 15 shots. That would have been a different story. If you read the force continum written by the AG, you will find that he did everything by the book.

  • Cool, Repoman. Get stuck in a car going ~90 miles per hour with a driver that is intoxicated at two times the legal limit, and high from marijuana. Also, said driver wants to get away from you at all possible costs.

    Would you taser him? Great, the driver would lose control until you let off the taser trigger. Struggle with the steering wheel? Another good idea. The other officer was violently striking his head, what makes you think "breaking his teeth" will have any effect?

    Officer Byrnes was in a car with a driver that was out of control. In the moment, what you have done?

    I don't like the police either, but they did there job. They kept the peace and saved many more lives.

    Respect the law and this stuff will never happen.

  • Since when can a person run from the cops and say oh ok your drunk, with drugs in your system, eh... we will give you a warning for speeding at 90MPH in a Residental zone, and driving down the wrong way on Route 46. Maybe you missed the part where they were they were fighting him in the car? Or how he almost almost crushed Officer Byrne or ran over Officer Fernandez

  • Repo, give me an example of what the cops should of done. The kid was struck by the officers and that didn't work. The kid got it in gear and took off with a cop in the car as he was trying to take the keys out of the ignition. YOU DO SHOOT HIM otherwise one of those officers don't go home. It sucks that somebody had to die but stop trying to play monday morninng quarterback.

  • jlesternj, you clearly have no knowledge of police regulations. Officers are not allowed to shoot out tires, fire warning shots, etc as hontagi clearly stated. Even with a flat tire, the car can easily move. Your bright idea does nothing but create a more dangerous situation. Byrnes did not "stupidly" jump into the car, it was an attempt to take the keys. Mr. Martinez was determined to flee at all costs...and this time it cost him his life. Better than losing an officer or two in addition.

  • Moronic according to whom? You? You become a cop then and do things "your way" then see how things turn out. Police are instructed to utilize their weapons to eliminate a threat. If their life or lives of others are immediately in danger, the officer is to utilize whatever means necessary to elimitate that danger. Taking off down the road in a high performance car at high speeds is a direct threat to the officer and others in the neighborhood and he eliminated that threat.

  • Flattening a tire on the car makes the car harder to control, and if you watch the video you can tell that Mr. Martinez is doing anything he can to get that Mustang into gear and take off. He had complete disregard for everything and everyone around him and it put lives in jeopardy. You can have any opinion you like, but the fact is that Byrnes was completely within his rights as a police officer to do what he needed to do in order to end the situation as quickly as possible.

  • And the last thing: the reason you cannot shoot warning shots or shoot at tires is because that creates the possibility of a ricochet or stray bullet to injure or kill someone else, or cause damage to property. The chase never reached a point at which the officer needed to stop the vehicle - the Mustang spun out where it should have ended - but what happened after that was the immediate threat to life and required deadly force.

Trust me I have shoot many guns and also have been to war.If you shoot you run the chance to have a bullet ricochet and kill someone else you aim centermass because you are less likely to miss. If you have any questions on Richochet rounds please youtube videos and see how un pridictable bullets are. I am so sorry a kid so young had to die but he drew the path he walked down...If you shoot at tires you will risk skipping bullets off the pavement and hiting a house.

Officer Byrnes obviously went in to the car to take the keys out of the ignition, that was clear on the video, not to mention that Fernandez was trying to stop the driver as well. What would you have done differently? Your in a car with a guy you don't know who at gun point never complied with commands, who knows that he heck he has in the car, gun or a knife.

  • Clearly you didn't do your homework. He instructed the driver numerious times to get out of the car, and the two officers physically trying to over come the suspect was in my opinion a last resort until deadly force had to be used, especially when he took off in a violient matter as he did. Yes the loss of Mr. Martinez is very tragic, but consider what he was doing before the Police became involved.

  • That story was never told by the media, also consider what would have happened if Mr. Martinez killed himself and the cop. What then? Or how about if Officer Byrnes or Fernandez was killed as a result of the car rocking back and forth? As much technology and techniques the police have, rarely they will lose control of a situation. Sometimes situations escalates way beyond what was orginally intended. Think Officer Byrnes and his family wanted this to happen. Mr Martinez wasn't the only victim.
