Cole can jump realms, remember? Only his entity can appear so technically he could appear to Phoebe, but he chose not to knowing what her reaction would be.
Cole is neither dead, nor alive and no, he's not hovering between the two; he was when talking to Piper in The Seven Year Witch, but he found a way to escape, as that was the plan he told Piper of.
